Supervisor Thomas Wood opened the meeting with the Pledge of Allegiance

at 7:00 p.m.

 

Roll call: Town Clerk, Linda McCabe, called the roll.Supervisor Thomas Wood- present, Councilman Michael McLoughlin � present, Councilman Charles Hanehan- present, Councilman James Jennings � present, Councilman Gary Squires - present.

 

Also present: Deputy Town Clerk Michelle Conover, Town Attorney William Reynolds, Zoning Officer Gil Albert, Highway Superintendent Don Ormsby Jr., Bridget Cuddihy, Steven Erby and Francoise Thomas.

 

Recognitions/Presentations/ Bid openings/ Public Hearings:

Supervisor Thomas Wood introduced Local Law #1 of 2017 and stated the Town currently has a solar law in effect at this time with allowance in the Rural and Rural Residential districts only.It was brought to the Town�s attention that there are some homes and/or businesses in the Lake Residential and Lake Commercial districts that have enough area to accommodate the solar collection systems, so this law amends the previous major solar collection systems law and now allows this in the Lake Residential and Lake Commercial districts as well as the Rural and Rural Residential districts.

 

Supervisor Thomas Wood opened the Public Hearing at 7:03 p.m. asking those wishing to speak to please stand and state their name and address; no one spoke.

 

Supervisor Thomas Wood made a motion, seconded by Charles Hanehan, to close the Public Hearing at 7:04 p.m. Supervisor Thomas Wood - aye, Councilman Michael McLoughlin � aye, Councilman Charles Hanehan � aye, Councilman James Jennings � aye, Councilman Gary Squires - aye.

Supervisor Thomas Wood next introduced Local Law #2 of 2017, stating this law authorizes the Town�s Zoning Officer to issue court appearance tickets in local justice court for any violations of the provisions of the Zoning Ordinance pertaining to building permits and certificates of occupancy.All other legal actions requiring compliance or abate violations, shall require consultation with, and approval of, the Town Board.Supervisor Thomas Wood then stated that after speaking to Town Attorney William Reynolds, Local Law #2 of 2017 does not require the environmental review as it is not relevant to the law.

Resolution #17-01 - setting the �Rules of the Board�:

WHEREAS, �63 of the Town Law provides that the Town Board may determine the rules of its procedures; now, therefore be it

RESOLVED, that the following Rules of Order be and the same are hereby adopted pursuant to �63 of the Town Law:

RULES OF ORDER OF THE TOWN BOARD OF THE TOWN OF SARATOGA

  1. The Supervisor shall preside at all meetings of the Board and shall preserve order and decorum in debate.
  2. The Board shall be called to order by the Supervisor.A quorum must be present in order to conduct business of the Town.A quorum shall be defined as three members of the Town Board.
  3. The Supervisor, immediately following the opening of every regular meeting of the Board, shall proceed to the regular order of Town business as follows: Roll Call, Approval of Minutes, Town Clerk�s Report, Zoning Officer�s Report, Dog Control Officer�s Report, Town Court Report, Tax Collector�s Report, Historian�s

Report, Assessor�s Report, Highway Superintendent�s Report, Supervisor�s Report, Public comments on agenda items, Committee Reports, Old Business, New Business, Communications, Privilege of the Floor, Auditing Bills, Establishment of the Next Regular Meeting, Adjournment.

  1. Public Hearings:It shall be the duty of the Supervisor to preside at all general or special business hearings, to instruct all persons addressing the Board to state their names, addresses, and to state whether they are for or against the proposal. Those in favor of the proposal before the Board should speak first and those in opposition should speak last.At such hearings the Board may have special rules and prescribe the time to be allotted as 3 minutes to each speaker.Once all persons wishing to speak have spoken once, any person wishing to speak a second time may do so for a maximum of 2 minutes.
  2. At the close of the public hearing as provided for in paragraph �4� above, the Supervisor may grant any member of the general public in attendance at such meeting a reasonable opportunity to be heard on any question or subject in which the Town is concerned.
  3. Every resolution or motion must be seconded before being put to a vote by the Supervisor and all resolutions or motions shall be recorded in their entirety in the official minutes of the Town Board.
  4. The Supervisor may offer or second a resolution or a motion and need not relinquish the chair for such purpose.
  5. No motion or resolution may be brought to a vote except by the majority consent of those present unless printed or typewritten copies thereof are presented to each member of the Town Board 48 hours prior to the opening of the meeting at which such motion or resolution is offered.
  6. No member shall speak more than once on any questions until every member choosing to speak shall have spoken, no more than twice, in any case, without leave of the Town Board.
  7. When a question is under debate, no motion shall be entertained unless (a) for an adjournment or recess, (b) for the previous question to lay on the table, (c) to postpone to refer to a committee, or (d) to amend.
  8. A majority vote of all the members of the Town Board shall be required to suspend these rules of order.A majority of the Town Board shall constitute a quorum.
  9. If the above stated rules are or become at any time in conflict with the statutory law, the statutory law shall take precedence.
  10. No member of the public shall engage in any demonstration, booing, hand clapping or otherwise disrupt the formality of a Town Board meeting.
  11. Any persons speaking to the Town Board with the consent of the Supervisor shall address their remarks to the town board, not to other members of the audience in the form of a debate.Residents will be limited to speaking for three minutes unless extended by permission of the majority consent of the Town Board.All persons speaking will be given respect and courtesy and in return are expected to be respectful and courteous.The use of profane and inappropriate language is not acceptable.

v  Resolution #17-24 - Blanket Official Undertaking for Town Officers:

����������� WHEREAS, certain Town Officers are required to execute and file undertakings by reason of certain provisions of the Town Law; and

����������� WHEREAS, Public Officers Law �11 allows for the substitution of a blanket undertaking for such individual undertakings; and

����������� WHEREAS, the Town of Saratoga has in effect a blanket undertaking for all Town Officers required by law to execute and file undertakings; and

����������� WHEREAS, said blanket undertaking provides coverage for the failure of said officers to faithfully perform their duties or to account for all moneys or property received by them by virtue of their positions, and for their fraudulent or dishonest acts; and

����������� WHEREAS, Public Officers Law �11 requires this Board to approve blanket undertaking as to form and sufficiency of coverage; now, therefore be it

����������� RESOLVED, that the Town Board hereby approves Crime Policy 106146652 issued by Selective Ins. Co. of New York and Public Officials Liability Policy MPOTSARA001 with NYMIR to the Town of Saratoga as a blanket undertaking for all Town Officers required to execute and file undertakings including but not limited to the Supervisor, Town Clerk, Tax Collector, Justices, and Superintendent of Highways; and be it further

����������� RESOLVED, that the blanket undertaking shall have $100,000.00 (One Hundred Thousand) coverage per employee with excess indemnity on the Tax Collector in the amount of $1,000,000.00 (one million), the Supervisor in the

Amount of $150,000.00 (One hundred-fifty thousand) and shall provide employee dishonesty coverage and faithful performance of duty coverage for said Officers as required by Public Officers Law � 11, with an appropriate deductible established at the time of the purchase of the policy in accordance with the usual practice of the Town; and be it further

����������� RESOLVED, that a certified copy of this Resolution be attached to said blanket undertaking and a copy thereof be filed in the Office of the Town Clerk.

Town Clerk�s report for December 2016:Fees paid to the NYS Dept. of Agriculture and Markets for the Animal Population Control Program $52.00. Fees paid to New York D.E.C. for hunting and fishing licenses $75.58. Fees paid to the New York State Health Department for Marriage licenses $0. Dog license fees to Supervisor Thomas Wood $245.00. Clerk fees to Supervisor Thomas Wood $94.42. Total State and Local Revenues received were $467.00.

 

Zoning Officer�s report for December 2016: 5 Building Permits, 20 Building Inspections, 7 Certificates of Occupancy, 0 Junkyard Permits, 0 Complaints, 4 Fire Inspections, 1 Order to Remedy, 8 misc. appointments, 3 Building Permit Renewals and 0 Property Maintenance Inspections.A check for $917.50 was given to Supervisor Thomas Wood.

 

Dog Control officer�s report for December 2016: The report was read by Supervisor Thomas Wood: answered 20 complaints, took 0 dogs to the shelter, 0 bite cases, traveled 124 miles, issued 14 warnings and 4 summons were issued.

 

Town Court report for December 2016: The following were closed: 37 Vehicle & Traffic, 3 Criminal/Penal Law, 3 DEC/ENCON, 3 Dog cases, 2 DWIs, 0 Town & Village Ordinance, 0 Small Claims/Civil, 1 Evictions, 0 Bench trials, 0 (case transfers) Divestiture Forms sent to County Court, 1 Defendants sentenced to probation, 0 hours of community service issued, 0 Orders of Protection issued, and $4,665.00 in fees were paid to the NY State Comptroller.

 

Tax Collector�s report: Tax Collector Marge Kirkpatrick submitted the following:

As of January 4th, 2017, 64 residents had paid their tax bills which brought the total amount collected to $37,009.31.The Town is now accepting credit cards for tax payments and she had two residents who paid with their credit cards and appreciated the convenience of being able to pay with their credit cards.

 

The Tax Collector collects taxes in January on Monday, Wednesday and Friday from 9:30 am to 4:00 pm and on the last Saturday of January, which is January 28th, from 8:30 am to noon. (Due to the office being closed on Martin Luther King Jr. Day)

 

All Town offices will be closed on January 16th, Martin Luther King Jr. Day.��

 

Historian�s report: Supervisor Thomas Wood stated that Historian Sean Kelleher submitted a summary of the 2016 monthly reports he has previously submitted to the Town; the multi-page summary report is on file in the Town Clerk�s office.

 

Assessor�s report: Victoria Hayner submitted the following:

Tax Exemption Renewal applications were sent out in December.

During the month of December she saw 8 valid sales and 4 non-valid sales; 6 were residential sales, 4 were vacant land sales and 1 was a commercial sale.

The Assessor�s office will be reviewing open building permits during the next couple of months to determine % complete for valuation purposes and updating pictures.��

During the month of January, the office will be open Mondays - 10 a.m. � 2 p.m. and Tuesdays & Wednesdays - 9 a.m. � 1 p.m.��������

The Assessor will be in the office on Mondays and Wednesdays.

 

Highway Superintendent�s report: December 2016

v  Addressing trees & limbs in ditch lines

v  General garage & truck cleaning

v  Repairs on dump boxes of Trucks 5 & 6

v  Rear cam replaced on Truck 3

v  Water trailer cleaned of rust and painted

v  Needed Roberts Towing to remove Truck 2 from a ditch

v  Office has been newly painted and new garage lighting is complete

v  Employee certification for Bucket Truck has been completed

v  Sanded for 11 storms and plowed for 8

 

The Board told Superintendent Don Ormsby they were very glad no one was hurt in the accident that occurred with one of the fully loaded salt trucks, which ended up in a ditch.They questioned the cost of removing the truck from the ditch and Superintendent Don Ormsby stated the cost was $1,350.00 to bring it out of the ditch and added there was no damage to the truck.

Supervisor�s report: Supervisor Thomas Wood reviewed the 2016 goals set by the Board, stating some had been accomplished and some not.Those issues not accomplished will serve as the basis for some of the 2017 goals.

2016 Goals were as follows:

Goal #1: Keep Town property taxes as low as possible: Supervisor Thomas Wood stated has been accomplished by closely monitoring all town expenditures and he will continue to do so.

 

Goal #2:Complete construction of the new salt storage shed:That has not been accomplished as of yet.

 

Goal #3:Complete negotiations and enter into multi-year contract with highway department Teamsters local 294 union:This has been accomplished.

 

Goal #4: Start and complete a new towpath trail from the Germain property to the Garnsey property, obtain the deed from NYS for the boat launch property and construct a paved launch:Supervisor Thomas Wood stated the trail work has begun and is a work in progress.He also stated that NYS won�t give a deed for the boat launch property, but the they will give the Town a 99 year Use & Occupancy Permit.

 

Goal #5:Update Town Comprehensive Plan:Some adjustments have been made to the zoning ordinance of the Town and the Town is in the process of looking at farmland protection plans for 2017.

 

Goal #6: Assist with Phase I construction of the new regional gateway visitors center, located at 30 Ferry St. in Schuylerville:The building will be enclosed by next fall and the town is helping with the bookkeeping aspect of the project.

 

Goal #7:Complete and have online the solar panel project at the Town Highway Garage: That project fell through due to potential conflicts.

 

Supervisor Thomas Wood then reviewed the 2017 Goals:

2017 Goals

 

Goal#1: Keep Town property taxes as low as possible, closely monitor all Town expenditures and strive to have no additional tax increases in the upcoming years.

 

Goal#2: Complete construction of the new salt storage shed.

 

Goal #3:Complete work on the new tow path trail from the Germain property to the Garnsey property as well as constructing the paved boat launch with an adjacent dock on US Rt. 4, south of Schuylerville.

 

Goal #4:Complete Farmland Protection Comprehensive Plan Grant project and amend Zoning Ordinance to reflect recommendations of the plan.

 

Goal #5:Continue to assist with Phase I construction of the new Regional Gateway Visitor Center, located at 30 Ferry St., Schuylerville.

 

Goal #6:Increase the rental occupancy rate to 100% generating the greatest amount of revenue for the Town as possible.

 

Goal #7:Develop a Highway Department Safety Plan, keeping an accident log, and initiating an Accident Prevention and Reduction Training Plan.

 

Goal #8:Investigate solar energy opportunities and implement where applicable and appropriate.

 

Goal #9:Revise and update the Town of Saratoga Emergency Action Plan & Procedures.

 

In summary, Town Supervisor Thomas Wood encourages all residents of the Town to be informed, to participate, and to work cooperatively with spirit and enthusiasm. We all want to see our town be the best possible Town that it can be. We have great things happening and we are going to build on these successes.It is with enthusiasm and excitement that we will move forward and meet the challenges in 2017.

Committee reports:

 

Landfill: Supervisor Thomas Wood reminded the Board of the request from Phoenix Lab. for the Town to put in a new well at the town brush dump.He then stated that Councilman James Jennings will look for, and purchase, a locking well cap for Well #1 at the brush dump.He added that Phoenix Lab. continues to accept no responsibility for failing to put the cap back on after testing the well, which caused the issue of mice getting in, chewing the rope to their test pipe which then clogged the well.He said the Town will cap the well and lock it and going forward, Phoenix will have to notify the Town prior to testing the well, get the key from us to unlock the well cap, complete their tests, remove their equipment, replace and lock the well cap and return the key to us every time they test the well.Simply put, they caused the issue, failed to notify the Town, failed to take responsibility, requested the Town put in a new well after they clogged it and then blamed the Town for their error.Supervisor Thomas Wood directed Councilman James Jennings to remove anything belonging to Phoenix and put a lock cap on the well as soon as possible.

Youth: No report.

Senior Citizens: Councilman James Jennings reported the following:

The Quaker Springs Sunshiners met on December 19th with 30 members in attendance for their Christmas luncheon meeting.They had a roast pork dinner, prepared by Faye Bratage and her girls, for their Christmas luncheon.Entertainment was provided by Amy Gerling and Pete, who played Christmas music for them.

Their next meeting will be February 13th and they are planning a trip sometime in the spring.

Gifts and gift certificates were given to shut-ins for Christmas and food was collected for S.A.F.E.R.

 

The Old Saratoga Serniors met on January 4th with 48 members in attendance for a casserole luncheon.Their next meeting will be held on January 18th for a sandwich luncheon with entertainment by Al and Kathy Bain.

The following trip has been planned:

March 17th - Turning Point Casino - please contact Mary LaMora to sign up.Please take note that February 8th is deadline for reservations.

They noted that they are getting new members all the time and are looking for different trips to take this year.

 

Park Committee: Councilman Gary Squires reported the following:

The Park Committee did not meet in December due to the Christmas holiday and associated reduced level of activity in the off-season at the park.He stated Mike Hayes, Hayes Contracting Corporation, reported that the wall and ceiling panels for the pavilion will be installed next week and the overhead door is due to be installed in about two weeks.He added that the utilities will be enclosed in half of the new storage area and that construction should be completed by the end of January.

 

Office of Emergency Management (OEM): No report

 

GSES, QSFD Reports: Quaker Springs Fire Chief Don Ormsby reported there were 107 total calls in 2016 and that most calls were for motor vehicle accidents.

New business:

Supervisor Thomas Wood stated that Resolution #17-25, Declaring Lead Agency for the purpose of conducting the state environmental quality review (SEQR) for Local Law #1 of 2017, was completed at the January 5th agenda meeting.The Board then went through and completed the state environmental quality review (SEQR) for Local Law #1 of 2017 and no environmental impacts were found.The Board must now go forward and make a Negative Declaration before adoption can be made of Local Law #1, 2017.

WHEREAS, the Town Board of the Town of Saratoga, Saratoga County, New York (the "Town") is considering enacting a certain amendment to the Zoning Ordinance of the Town of Saratoga (the �Action�); and

�������������� WHEREAS, pursuant to Article 8 of the Environmental Conservation Law, Chapter 43-b of the Consolidated Laws of New York, as amended (the "SEQR Act") and the regulations adopted pursuant thereto by the Department of Environmental Conservation of the State of New York ("DEC"), being 6 NYCRR Part 617, as amended (the "Regulations"), the Town Board as lead agency desires to determine whether this Action may have a significant effect on the environment and therefore require the preparation of an environmental impact statement; and

�������������� WHEREAS, there has been prepared a full environmental assessment form (EAF) for the Project, a copy of which was previously reviewed by the Town Board and a copy of which is on file in the office of the Town Clerk; and

�������������� WHEREAS, pursuant to the Regulations, the Town has examined the EAF in order to make a determination as to the potential environmental significance of Action; and

�������������� WHEREAS, the Action appears to constitute a "Type I Action" (as defined by the Regulations);

�������������� NOW, THEREFORE, BE IT RESOLVED BY THE TOWN BOARD OF THE TOWN OF SARATOGA, SARATOGA COUNTY, NEW YORK AS FOLLOWS:

�������������� 1.��� Based on an examination of the EAF and based further upon the Town's knowledge of the area and such further investigation of the proposed zoning amendment and its environmental effects as the Town has deemed appropriate, the Town makes the following findings:

(b)��� The Action constitutes a "Type 1 Action" (as defined in the Regulations);

(c)�� No potentially significant effect on the environment is noted in the EAF for this Action, and none are known to the Town;

(d)�� This Action will not have a significant effect on the environment; and the Town will not require the preparation of an environmental impact statement with respect to the Action; and

(e)As a result of the foregoing, the Town has prepared a negative declaration with respect to the Action.

��������������� 2.�� The Town Clerk is hereby directed to file a negative declaration with respect to the Action (said negative declaration attached hereto); and a copy of the negative declaration shall be maintained in the office of the Town Clerk in a file that will be readily accessible to the public.

Section 1. Section 400-16.3 (B) of the Zoning Regulations of the Town of Saratoga is amended to read as follows:

 

Solar Collection Systems

 

B.Definitions

 

MAJOR SOLAR COLLECTION SYSTEM:

An area of land or other area used for a solar collection system principally used to capture solar energy and convert it to electrical energy to transfer to the public electric grid in order to sell electricity to or receive a credit from a public utility entity, but which also may be for on-site use.Major solar collection systems consist of one or more freestanding ground or roof mounted solar collector devices, solar related equipment and other accessory structures and buildings, including light reflectors, concentrators, heat exchangers, substations, electrical infrastructure, transmission lines and other appurtenant structures and facilities in which the total surface area of all solar collectors exceeds 2000 square feet. Major systems are allowed only in the Rural and Rural Residential zoning districts of the town, except that roof mounted systems may also be allowed in the Lake Residential and Lake Commercial zoning districts.

 

Section 2.Effective Date

This Local Law shall take effect immediately upon filing with the Secretary of State of

the State of New York.

WHEREAS, all other legal actions to require compliance or abate violations shall require consultation with and approval of the Town Board; now, therefore be it

RESOLVED by the Town Board, of the Town of Saratoga, to adopt Local Law #2 of 2017 � Authorizing the Zoning Officer of the Town to issue court appearance tickets for any violations of the provisions of the Zoning Ordinance related to building permits and certificates of occupancy. Section 1. Section 400-59 (B) (6) of the Zoning Regulations of the Town of Saratoga is amended to read as follows:

 

The Zoning Officer is authorized and delegated by the Town Board to issue appearance tickets in local justice court for any violations of the provisions of the Zoning Ordinance related to building permits and certificates of occupancy. All other legal actions to require compliance or abate violations shall require consultation with, and approval of, the Town Board.

 

Section 2.Effective Date

WHEREAS, the Town of Saratoga has worked with the LA Group in preparing plans for the boat launch on US RT 4, south of the Village of Schuylerville; and

WHEREAS, the next step in the process is to contract for professional services for the final design and engineering, permitting, bidding, construction, administration and oversight, now, therefore be it

RESOLVED, that the Supervisor, of the Town of Saratoga, is authorized to enter into a contract with the LA Group for the amount of $35,900.00, for completing the above specified duties.

WHEREAS, in regards to the above matter, an appeal has been taken by the petitioner, naming the Town as a respondent; and

WHEREAS, it is necessary for the Town to defend this appeal, it is now, therefore,

����������� RESOLVED, by the Town Board, of the Town of Saratoga, to authorize Town Attorney William Reynolds to provide legal services on behalf of the Town at the agreed upon contract rate of $150.00 per hour plus necessary costs and disbursements.
