MINUTES OF THE REGULAR MEETING OF THE TOWN BOARD

OF THE TOWN OF SARATOGA,

30 FERRY ST., SCHUYLERVILLE, NY

September 11, 2006

Supervisor Thomas Wood opened the meeting with the Pledge of Allegiance

at 7:00 p.m. and called for a moment of silence to commemorate the five year anniversary of the terrorist attacks of September 11, 2001.

Resolution # 06-91 Honoring Michael F. Nolan, was presented to Betty Nolan, Mark Nolan, and Mary Green by Supervisor Thomas Wood as follows:

WHEREAS, Michael F. Nolan was a long time resident of the Village of Schuylerville and the Town of Saratoga, and

WHEREAS, Michael F. Nolan served as a member of the United States Army in World War II, and

WHEREAS, Michael F. Nolan was a teacher of French and Latin at Schuylerville Central School for 27 years, and

WHEREAS, Michael F. Nolan served as Mayor for the Village of Schuylerville for 10 years, and

WHEREAS, Michael F. Nolan was instrumental in the formation of the Old Saratoga Athletic Association and Little League baseball, and

WHEREAS, Michael F. Nolan served as Assessor for the Town of Saratoga from January 1, 1958 to December 31, 1963, and

WHEREAS, Michael F. Nolan served as Tax Collector for the Town of Saratoga from January 1, 1964 to December 31, 1969, and

WHEREAS, Michael F. Nolan served as Town of Saratoga Supervisor from January 1, 1978 to December 31, 1981, and

WHEREAS, Michael F. Nolan served as Saratoga County Supervisor from January 1, 1978 to December 31, 1981, and

WHEREAS, Michael F. Nolan served as Town Councilman from January 1, 1984 to December 31, 1995, now therefore be it

RESOLVED, that the Town of Saratoga extends our belated condolences to all of the members of the Nolan Family for their loss, and be it further

RESOLVED, that the Town Board of the Town of Saratoga does hereby recognize and honor to the highest degree possible Michael F. Nolan for his patriotism, devotion, commitment, and service to his village, town and country, and be it further

RESOLVED, that the Town of Saratoga will hold Michael F. Nolan�s name and record of service in the highest esteem and he will always be remembered as a member of the greatest generation and one of Schuylerville�s best.

Resolution #06-97 - First Responder Recognition - James �Jay� Bodnar Jr.:

WHEREAS, on September 11th, 2001, terrorists attacked the World Trade Center intent upon killing Americans and destroying our freedom; and

WHEREAS, five years have elapsed since that day of infamy that will always be remembered in the annals of history for the loss to our state and nation of so many
bright, shining stars; and
WHEREAS, there was an immediate response by brave, patriotic New Yorkers who answered the call; responding to evil with good; answering terror with strength; meeting adversity with resolve; and
WHEREAS, the determination and spirit of New Yorkers was demonstrated by town highway department employee, James "Jay" Bodnar Jr., who responded to the World Trade Center as a volunteer as part of the Capital District Urban/Technical
Search and Rescue Regional Response (USAR) Team for 11 days; and
WHEREAS, James �Jay�Bodnar Jr. is a native of the Town of Saratoga, has been a member of the Quaker Springs Fire Department for 12 years, formerly serving as 3rd Captain and 2nd Captain, and is currently serving his second year as Assistant Fire Chief, and
WHEREAS, James �Jay�Bodnar Jr., was selected as a9/11 volunteer to represent Saratoga County as a first responder at the five year, New York State Commemoration Ceremony held at the World Trade Center site in lower Manhattan on September 10th ; now therefore be it

RESOLVED, by the Town Board of the Town of Saratoga to proudly honor and commend James "Jay" Bodnar Jr., for demonstrating the invincible spirit, a spirit of compassion and courage, that can be found in the first responders who answered the alarm of September 11, 2001; and be it further
RESOLVED, that the Town Board of the Town of Saratoga does hereby recognize and honor to the highest degree possible James �Jay� Bodnar Jr. for his patriotism, devotion, commitment, and service to his town and country.

Resolution #06-98 � First Responder Recognition � Richard H. Behrens:

WHEREAS, on September 11th, 2001, terrorists attacked the World Trade Center intent upon killing Americans and destroying our freedom, and

WHEREAS, five years have elapsed since that day of infamy that will always be remembered in the annals of history for the loss to our state and nation of so many
bright, shining stars; and
WHEREAS, there was an immediate response by brave, patriotic New Yorkers who answered the call; responding to evil with good; answering terror with strength; meeting adversity with resolve; and
WHEREAS, the determination and spirit of New Yorkers was demonstrated by Town of Saratoga and Village of Schuylerville resident, Richard H. Behrens, who responded to the World Trade Center catastrophe by serving as a volunteer auxiliary fireman at Squad 252 in Brooklyn, supporting the station and families that had lost members in the World Trade Center Buildings; and
WHEREAS, Richard H. Behrens has been a member of the General Schuyler Emergency Squad for 31 years, formerly serving as Captain, President, and Vice President, and currently serving as treasurer; and
WHEREAS, Richard H. Behrens has been a member and firefighter of the Schuyler Hose Fire Department for twelve years, currently serving as Safety Officer; now therefore be it

RESOLVED, by the Town Board of the Town of Saratoga to proudly honor and commend Richard H. Behrens, for demonstrating the invincible spirit, a spirit of compassion and courage, that can be found in all the volunteers that answered the alarm of September 11, 2001, and be it further
RESOLVED, that the Town Board of the Town of Saratoga does hereby recognize and honor to the highest degree possible Richard H. Behrens for his patriotism, devotion, commitment, and service to his town and country.

Resolution #06-99 � First Responder Recognition �Thomas Benton:

WHEREAS, on September 11th, 2001 terrorists attacked the World Trade Center intent upon killing Americans and destroying our freedom; and

WHEREAS, five years have elapsed since that day of infamy that will be always remembered in the annals of history for the loss to our state and nation of so many
bright, shining stars; and
WHEREAS, there was an immediate response by brave, patriotic New Yorkers who answered the call; responding to evil with good; answering terror with strength; meeting adversity with resolve; and
WHEREAS, the determination and spirit of New Yorkers was demonstrated by Town of Northumberland resident and Schuyler Hose Fire Department member, Thomas Benton, who responded to the World Trade Center Catastrophe serving as a Captain in the joint Army � Air Force National Guard Weapons of Mass Destruction Civil Support Team at the World Trade Center Buildings; and

WHEREAS, Thomas Benton, as a member of the Weapons of Mass Destruction Civil Support Team was dispatched to the World Trade Center on the morning of September 11, 2001 and served through January, 2002 monitoring the area for weapons of mass destruction and providing hazardous material support to New York City; and
WHEREAS, Thomas Benton has been a member and firefighter of the Schuyler Hose Fire Department for thirteen years serving as Captain for the past 8 � years; now therefore be it

RESOLVED, that the Town Board of the Town of Saratoga proudly honors and commends Thomas Benton, for demonstrating the invincible spirit, a spirit of compassion and courage, that can be found in all of the volunteers that answered the alarm of September 11, 2001; and be it further
RESOLVED, that the Town Board of the Town of Saratoga does hereby recognize and honor to the highest degree possible Thomas Benton for his patriotism, devotion, commitment, and service to his town and country.

 

Supervisor Thomas Wood presented Ian Murray and Brookside Nursery with a Certificate of Appreciation from the County Board of Supervisors for the outstanding landscaping of the Vietnam Veterans� Memorial Moving Wall display that was so generously donated.

Resolution #06-92 � Honoring the 229th Anniversary of the American Victory at Saratoga & October 10th to October 17th, 2006 as Surrender Week:

WHEREAS, the Town of Saratoga and the Village of Schuylerville are celebrating the 229th Anniversary of the American Victory at Saratoga on October 17, 2006; and

WHEREAS, between October 10, 1777 and October 17, 1777 the Americans held the British Army in what amounted to a siege, with the British soldiers pinned behind earthworks, lacking supplies and water, and subjected to constant fire; and

WHEREAS, the Schuylerville area is the location that British General John Burgoyne surrendered at the Battles of Saratoga which is recognized as one of the fifteen most decisive battles in world history; and

WHEREAS, the news of the American Victory at Saratoga was �occasioned as much general joy in France as if it had been a Victory of their own troops over their own Enemies,�; and

WHEREAS, the American Victory at Saratoga was a major reason that France signed a treaty with the Congress on February 6, 1778, that French King Louis XVI describes as �firmly assure Congress of my friendship,�; and

WHEREAS, October 19, 2006 is the 225th Anniversary of when an American and French Army forced British General Lord Charles Cornwallis to surrender at Yorktown in Virginia; and

WHEREAS, the two events of the Surrenders of complete British Armies at Saratoga and Yorktown during the American Revolution are unparalleled in the annals of history; and

WHEREAS, a partnership lead by the Fort Hardy Committee and including the Historians� Offices of Saratoga and Schuylerville, Old Saratoga Historical Association, Saratoga National Historical Park, Schuylerville Visitors Center, and the Schuylerville Public Library have planned a series of events from October 10, 2006 to October 17, 2006;

BE IT RESOLVED, by the Town Board of the Town of Saratoga, New York and the Village Board of the Village of Schuylerville, New York that we honor and recognize the 229th Anniversary of the American Victory at Saratoga and we declare that October 10, 2006 to October 17, 2006 as Surrender Week; and be it further

RESOLVED, that a suitable copy of this resolution be posted as an expression of our commemoration of this Anniversary.

 

Public Hearings:

Supervisor Thomas Wood reviewed Local Law #7 that provides for Adult Business Use Regulations in the Rural District.He noted that an Adult Business would require a Special Use Permit from the Planning Board.Just a couple of the specifics of the regulations are that an Adult Use Business would require at least 5 acres and 300� of frontage along with locational requirements in the Rural District. (The full text of LocalLaw #7 is on file in the Town Clerk�s Office and is also on the Town�s website: townof saratoga.com).

 

Proof of Legal Notice by newspaper on September 2, 2006 having been furnished, the Public Hearing on Local Law #7, Adult Use Business Regulations, was opened by Supervisor Thomas Wood at 7:32 p.m.

Kurt Mausert spoke against the use in the Rural District, adding that it should be in a Commercial District.

Ian Murray suggested a wording change in Section 6 of the law to read must not shall and suggested that the Special Use Permit required be renewable annually with fees.

Bob Hathaway questioned why they can�t be outlawed throughout the town?Town Attorney William Reynolds responded that the courts have ruled that they cannot be prohibited totally.Supervisor Thomas Wood noted that regulations are needed since without them in place we are wide open without regulation.

Stephen Bodnar agreed with Ian Murray�s comments.

Sean Kelleher urged the board to keep them out of the Lake Commercial District.

 

Everyone wishing to speak having spoken, Supervisor Thomas Wood made a motion to close the public hearing at 7:42 p.m. and Councilman Fred Drumm seconded it. Approval of Minutes: A motion was made by Councilwoman Betty Koval and seconded by Councilman Charles Hanehan to accept the minutes of the regular meeting on August 14, 2006 as written.

Town Clerk�s report for August 2006: Fees paid to the County Treasurer for Dog Licenses $72.85. Fees paid to the NYS Dept. of Agriculture and Markets for the spay/neuter program $15.00. Fees paid to New York D.E.C. for hunting and fishing licenses $2,505.35. Fees paid to the New York State Health Department for Marriage licenses $90. Dog license fees to Supervisor Thomas Wood $212.15. Clerk fees to Supervisor Thomas Wood $399.40. Total State, County, and Local Revenues received were $3,294.75.

 

Zoning Officer�s report: August 2006 report: 7 Building Permits and 8 CO�s were issued, and 17 building inspections were done.A check for $1,935 was given to Supervisor Thomas Wood.

 

Dog Control officer�s report for August 2006: The report was read by Supervisor Thomas Wood which stated Rick Sullivan answered 17 complaints, responded to 1 dog bite incidence, took 6 dogs to the shelter, traveled 238 miles, issued 20 warnings and 2 summons� were issued.

 

Town Court report: Justice Jack Ditch read the court report and the following cases were closed in August 2006:90 Vehicle & Traffic, 20 Criminal/Penal Law, 7 DEC/ENCON, 7 Dog cases, 3 DWI, 3 Town & Village Ordinances, 5 Small Claims/Civil, 1 Eviction, 1 Bench trial, 3 (case transfers) Divestiture Form sent to County Court, 6 attended the Science of Speed School, 0 Defendants sentenced to probation, 450 hours of community service issued, 0 days of jail time issued, 2 Orders of Protection issued, and $7,190 in fees were paid to the NY State Comptroller.

Justice Ditch added that the interns have started with three from local schools and one from Skidmore College.

 

Historian�s report: Highlights of Sean Kelleher�s report are as follows: He reported that the town has been involved in a number of historic activities and he has been busy documenting them.Unfortunately, many of which have been tragic such as the five year anniversary of the terrorist attack on the World Trade Center Buildings and the two State Troopers, one injured, and one who gave his life in service to his state and country.

 

He noted that work continues on putting together the activities for Surrender Week celebrating the 229th Anniversary of the Battles of Saratoga from October 10th through 17th.

 

He added that the last bit of good news is that Governor Pataki has received from the Senate the �Historic Saratoga-Washington on the Hudson Partnership� bill.It is hoped that he will sign it as this is a great opportunity for the region to address such matters as collaborative agriculture and open space protection, tourism development and revitalization of main streets, recreational development, and protection of natural and cultural heritage.

 

Supervisor�s report: Supervisor Thomas Wood presented August 2006 balances in Town funds as follows: General A $933,340.99 ($50,000. of this is Park Reserve), General B $61,335.64, Highway Outside $147,323.57, Youth Recreation & Services $1,793.82, Highway Equipment Reserve $90,218.75, Building Reserve $966,093.60 and Fire Protection $0.August revenues were $122,244.51 and expenses were $117,820.66.The total August 2006 balance is $2,200,106.37.

 

Supervisor Thomas Wood reported that Budget Workshop #2 has been scheduled for Monday, September 25, 2006 @ 7:00 p.m.

 

 

 

Assessor�s report: Assessor Catherine DeFelice reported that August was a quiet month, with 44 transfers, 22 valid sales, and 22 non-valid sales.She added that there were 3 splits, which created 3 new parcels, 2 parcels merged and 5 parcels were upgraded with revisions.She noted that the town now has 3,000 active parcels.

Committee reports:

Highway: Highway Superintendent Dave Hall reported that winter sand, gravel, diesel fuel and #2 fuel oil will be put out for bid this month.Bids will be opened on October 11th.Highway Superintendent Dave Hall added that if there is a slot open for the 2006 emission engine a bid will be put out for a dump truck this year with delivery next year.A savings of $10,000 to $15,000 could be realized if ordered this year.

He reported that the Town Highway Garage was broken into Thursday, September 7th, with $800 to $1,000 in damages.It is being investigated.Highway Superintendent Dave Hall reports that he has gone on inspections of the Burgoyne Estates project and reports good progress.

 

Landfill: No report.

Insurance: No report.

Youth: Supervisor Thomas Wood reported that on Saturday, September 16th the 2nd Annual Youth Festival will be held from 5:00 � 8:00 p.m. at Ft. Hardy Park.There will be many activities and fireworks at dusk.

Buildings:The Building Committee met with Don Davis and associates of S.D. Atelier on September 6th.They presented new concepts for the Route 32 and Ferry St. sites.The old school has been eliminated as a site.The next Building Committee meeting will be held Wednesday, October 6, 2006 at 6:00 p.m.

Senior Citizens:Councilwoman Betty Koval reported that Schuylerville seniors will meet tomorrow and the Quaker Springs group will meet Wednesday.

 

Park Committee: Supervisor Thomas Wood explained that the water quality should be tested at the Quaker Springs Mineral Spring.Councilman Fred Drumm spoke with Joe Drew and he recommended the Queensbury Lab for the testing as they are reasonable.Councilman Fred Drumm will follow through with the testing.���

Zoning Amendment Advisory Committee (ZAAC): Councilman Charles Hanehan reported that progress is being made as Local Laws are being passed.

 

Committee to Honor Volunteer Firefighters & Emergency Medical Service Workers: Sean Kelleher reported they did not meet in August but will resume meetings this month.

 

 

GSES, QSFD, SLPID/SLA Reports:

Quaker Springs Fire Department:Stephen Bodnar reported that they responded to 8 calls in August. He stated that the budget is done and will be given to the town by September 20th.He added that the tax rate will remain the same.RFP�s for the new fire substation on Rt. 9P will be opened next week.He added that a Building Fund has been established for donations.���

 

Saratoga Lake Protection and Improvement District (SLPID):SLPID is in search of places to off load the weeds harvested.They are a source of fertilizer and possibly farmers would be interested.Contact Supervisor Thomas Wood if interested.

 

Old business:

Supervisor Thomas Wood explained that the town is working with Saratoga Builders on a town park on 26 +/- acres along Route 29 across from the Farmer�s Daughter.The park would have ball fields, a picnic area and walking trails. A name for the park is needed.Anyone with name suggestions should contact Supervisor Thomas Wood.

Resolution #06-93 � Lead Agency � Local Law #7 � Adult Use Businesses:

WHEREAS, the Town Board of the Town of Saratoga is amending the Zoning Ordinance with Local Law #7 of 2006, and

WHEREAS, the approval of Local Law #7 of 2006 is an Action subject to the provisions of the New York State Environmental Quality Review Act (S.E.Q.R.) and the regulations promulgated to implement said Environmental Quality Review Act, and

WHEREAS, the provisions of S.E.Q.R. require the designation of a �Lead Agency� to determine the environmental significance of the Action, and

WHEREAS, this agency has complied with the provisions of S.E.Q.R. pertaining to �Lead Agency� designation, now, therefore, be it

RESOLVED, that the Town Board of the Town of Saratoga is hereby designated the �Lead Agency� for the purpose of conducting the S.E.Q.R. review of referenced Local Law #7 of 2006.

 

Supervisor Thomas Wood explained that the Full Environmental Assessment Form was completed at the agenda meeting and it was determined that Local Law #7 of 2006 � Adult Use Businesses would not have a significant impact.

Resolution #06-94 � Negative Declaration - Local Law #7:

�������� �� ��WHEREAS, the Town Board of the Town of Saratoga, Saratoga County, New York (the "Town") is considering enacting certain amendments to the Zoning Ordinance of the Town of Saratoga (the �Action�); and

�������������� WHEREAS, pursuant to Article 8 of the Environmental Conservation Law, Chapter 43-b of the Consolidated Laws of New York, as amended (the "SEQR Act") and the regulations adopted pursuant thereto by the Department of Environmental Conservation of the State of New York ("DEC"), being 6 NYCRR Part 617, as amended (the "Regulations"), the Town desires to determine whether this Action may have a significant effect on the environment and therefore require the preparation of an environmental impact statement; and

�������������� WHEREAS, the Town has prepared an environmental assessment form for the Project (the "EAF"), a copy of which was presented to and reviewed by the Town at this meeting and a copy of which is on file in the office of the Town Clerk; and

�������������� WHEREAS, pursuant to the Regulations, the Town has examined the EAF in order to make a determination as to the potential environmental significance of Action; and

�������������� WHEREAS, the Action appears to constitute a "Type I Action" (as defined by the Regulations);

�������������� NOW, THEREFORE, BE IT RESOLVED BY THE TOWN BOARD OF THE TOWN OF SARATOGA, SARATOGA COUNTY, NEW YORK AS FOLLOWS:

�������������� 1.��� Based on an examination of the EAF and based further upon the Town's knowledge of the area and such further investigation of the proposed zoning amendments and their environmental effects as the Town has deemed appropriate, the Town makes the following findings:

(a)�� The zoning amendments are described in the EAF;

(b)�� The Plan constitutes a "Type 1 Action" (as defined in the Regulations);

(c)No potentially significant effect on the environment is noted in the EAF for this Action, and none are known to the Town;

(d)�� This Action will not have a significant effect on the environment; and the Town will not require the preparation of an environmental impact statement with respect to the Action; and

(e)As a result of the foregoing, the Town has prepared a negative declaration with respect to the Action.

��������������� 2.��� The Town Clerk is hereby directed to file a negative declaration with respect to the Action (said negative declaration attached hereto); and a copy of the negative declaration shall be maintained in the office of the Town Clerk in a file that will be readily accessible to the public.

3.          This resolution shall take effect immediately.

 

Supervisor Thomas Wood reported that there is an opening on the Board of Assessment Review and anyone interested should contact him. He added that he regretfully accepted Susan Cummings� resignation from the Planning Board.She served as a Planning Board member for 14 years and will be missed.

Resolution #06-96 Appointment of Robert McConnell:

WHEREAS, Susan Cummings, after serving from March 1, 1991 on the Planning Board, has decided to step down, therefore be it

RESOLVED, that the Town Board hereby appoints Robert J. McConnell as a regular member of the Planning Board for the remaining term of Susan Cummings from September 11, 2006 to December 31, 2008.

 

Supervisor Thomas Wood announced that the Saratoga County Planning Board will host a Training Session for Planning and Zoning Boards along with Elected Officials and Code Enforcement Officers on Thursday, September 28, 2006 from 6:30 to 8:30 p.m. at the Solar Building, 50 West High Street, Ballston Spa.

Stephen Bodnar asked what qualifications are needed to serve on the Board of Assessment Review?Supervisor Thomas Wood responded that persons with knowledge of Real Estate Values are helpful and common sense.Training sessions are provided.

Resolution #06-95 -Approving the payment of bills on Abstract 9G dated 9/11/2006 as follows: General A $14,553.04, General B $2,224.27, Highway Outside $27,197.22,and Youth $96.29 for a total expense of $44,070.82.
