Supervisor Robert Hall opened the meeting with the Pledge of Allegiance at 7:40 p.m.

 

Roll call: Ruth Drumm, Deputy Town Clerk, called the roll. Supervisor Robert Hall- present, Councilman Bruce Cornell - present, Councilman Michael McLoughlin - present, Councilman Fred Drumm- present, and Councilman Phil Griffen- present.

Approval of Minutes: All Board Members had read the minutes of the April 14, 2003 meeting. A motion was made by Councilman Bruce Cornell and seconded by Councilman Michael McLoughlin that the minutes of April 14, 2003 be accepted as read. Supervisor Robert Hall – aye, Councilman Philip Griffen – aye, Councilman Fred Drumm – aye, Councilman Michael McLoughlin – aye, Councilman Bruce Cornell - aye. Carried 5 – 0.

 

Town Clerk’s report: Fees paid to the County treasurer for Dog licenses $278.60. Fees paid to the NYS Dept. of Agriculture and Markets for the spay/neuter program $111.00. Fees paid to NY D.E.C. for hunting/fishing licenses $180.43. Fees paid to The State Health Dept. for marriage licenses $11.25. Dog license fees to Supervisor Robert Hall $702.40. Clerk fees to Supervisor Robert Hall $66.07. Total State, County, and Local Revenues received were $1,349.75.

 

Zoning Officer’s report: Robert Hathaway is on vacation. Councilman Michael McLoughlin read Robert Hathaway’s monthly report for April: 12 Building permits were issued and 15 inspections were done. A check for $998.00 was given to Supervisor Robert Hall.

Councilman Philip Griffen remarked that the house at the end of Hanehan Road and Route 4 is in very bad condition and suggested that Bob Hathaway should look at it. Supervisor Robert Hall will mention it to Bob Hathaway when he gets back from vacation.

 

Supervisor’s report: Supervisor Hall presented April balances in Town funds as follows: General A $562,377.70, General B $99,055.42, Highway Outside $404,289.58, Youth Recreation & Services $1,289.17, Highway Equipment Reserve $59,603.38, Building Reserve $815,095.03 and Fire Protection $0.03. April revenues were $198,583.55 and expenses were $252,614.11, making the total April balance $1,941,710.31.

 

Highway: Councilman Philip Griffen introduced a resolution #03-20, to accept the highest bid for the 1990 John Deere 544E Loader from Curtis Lumber for $32,999.00 and the highest bid for the 1992 Ford Dump Truck with snowplow equipment from Richard Wiley for $8,277. Councilman Bruce Cornell seconded this. Supervisor Robert Hall – aye, Councilman Philip Griffen – aye, Councilman Fred Drumm – aye, Councilman Michael McLoughlin – abstain, Councilman Bruce Cornell - aye.

Carried 4 – 0. (1 abstained)

Grant Seymour, Highway Superintendent, said that the town crews are busy sweeping the roads and replacing damaged culverts. He mentioned that the new mower on order should be ready for delivery in about one month.

 

 

Landfill: No report.

 

Insurance: No report.

 

Youth Committee report: No report.

 

Buildings: Supervisor Robert Hall reported on Dente Engineering’s findings from the six test borings and foundation assessments that have been done. He explained that the results suggest that it will cost more than the building is worth to fix the foundation and that a formal report will be coming. It will be discussed at the next board meeting in June.

 

 

Senior Citizens report: Councilman Bruce Cornell expressed what a great time the fifty some Quaker Spring’s seniors had this afternoon with the Moreau Band performing for them. The Schuylerville Seniors had 68 in attendance at their last meeting and had a guest speaker from Saratoga County, reporting on how to eliminate pests and rodents in their gardens.

Supervisor Robert Hall mentioned that suggestions for candidates for a Lifetime Achievement Award are needed, this is for seniors 85 and over and is given by the Capital District Senior Issues Forum. A nomination form is available at the town office and must be in to the Steering Committee by June 15th. Councilman Bruce Cornell will check with the Schuylerville and Quaker Springs seniors for candidates.

 

Park Committee report: Councilman Michael McLoughlin reported that the committee is considering several sites for recreation fields and will be walking the proposed sites to see if they are feasible. The Old Saratoga Athletic Association (OSAA) has given the committee their recommendations which includes a site that is at least 17 acres. It is planned to find a site that will fit well with the Master Plan for the Town and the Schuyler Park Plan. After a general discussion, Councilman Michael McLoughlin assured the public that a better site would be in place before anyone has to leave the present fields.

A motion was made by Supervisor Robert Hall and seconded by Councilman Michael McLoughlin to replace Councilman Philip Griffen with Councilman Fred Drumm on the committee. Old Business: Rick Sullivan, Dog Control Officer, asked the board’s approval to hire Marshal Truax of 259 Hayes Road as his assistant. He stated that Marshal Truax has past experience as a Dog Control Officer for Schoharie County and would be a great help. Rick Sullivan said that he would split his salary with Marshal Truax so that it would not cost the town anything extra. Marshal would cover the villages of Schuylerville and Victory. A motion was made by Councilman Bruce Cornell and seconded by Councilman Fred Drumm to hire Marshal Truax as Assistant Dog Control Officer effective June 1, 2003. Supervisor Robert Hall – aye, Councilman Philip Griffen – aye, Councilman Fred Drumm – aye, Councilman Michael McLoughlin – aye, Councilman Bruce Cornell - aye. Carried 5 – 0.

Rick Sullivan will train Marshal over the next few weeks.

Councilman Fred Drumm reported that Time Warner Cable has installed cable down Casey Road and it is now available to its’ residents. He also inquired as to when our contract with Time Warner is up for renewal and Supervisor Robert Hall replied it expires on August 31, 2003. Town Attorney Bill Reynolds added that he has spoken to a representative from The Public Service Commission who is assigned to our town, and he will ask her to attend our next board meeting.

 

New Business: A resolution # 03-21 was introduced by Councilman Fred Drumm and seconded by Philip Griffen to increase the Joint Recreation Project account # A7145.4 by $186.00, to $3,900 from $3,714. Supervisor Robert Hall – aye, Councilman Philip Griffen – aye, Councilman Fred Drumm – aye, Councilman Michael McLoughlin – aye, Councilman Bruce Cornell - aye. Carried 5 – 0.

 

Communications: Supervisor Robert Hall read a Proclamation congratulating Joe and Anne McMahon and family for their part in the foaling and raising of Funny Cide, the first NewYork Bred winner of the Kentucky Derby run on May 3, 2003. This Proclamation will be presented to the McMahon’s at a future meeting.

Communications were read by Supervisor Robert Hall from the following: The New York State Canal Conference regarding an Erie Canal Convocation in Utica, New York on June 8-10, 2003. Anyone interested in attending can obtain a registration form at the Town Hall; The New York State Emergency Management Office, regarding a payment to the town for $8,798.03 to help pay for the 2002 Christmas Eve Snowstorm; A letter from Thomas Martin, Schuylerville High School Principal, requesting a donation for the Town of Saratoga Awards to the two seniors having earned the most points under the Student Council point system. The board members agreed to contribute $20 each for a total of $100. Supervisor Robert Hall stated that the Emergency Medical Services Agreement between the Town of Saratoga and the General Schuyler Emergency Squad has been signed by both parties.

 

Privilege of the floor:

Gail Taras addressed the board asking that they adopt a partial tax exemption for real property of persons with disabilities. She also requests that they allow medical expenses to reduce the income of the disabled person. Town Attorney Bill Reynolds will research the state law, check on the options available, and report to the board at their next meeting.

 

Wendy Lucas inquired when the next joint meeting of the town and villages will be held and Supervisor Robert Hall replied Wednesday, May 21, 2003 at 7:00 p.m. She also questioned what the increase in the funding of the Joint Recreational Project was for. It was explained that it is for the swimming program with Northumberland and the increase would enable the town to receive the full amount of grant money for the project. Wendy Lucas asked who is on the Park Committee and Councilman Michael McLoughlin replied it is made up of Councilman Michael McLoughlin, Town Attorney Bill Reynolds, Historian Thomas Wood, Councilman Fred Drumm, Mark Wells, Laurie Griffen, and Eric Weber.

 

Richard Behrens of the General Schuyler Emergency Squad, conveyed that the Basic Life Support (BLS) and Advanced Life Support (ALS) coverage that went into effect March 1, 2003 is going very well with over 100 calls and none missed. He stated that both villages have passed resolutions to be included in the program, with Victory’s posting period ending May 26, 2003. Things should be ready for the town to enact a resolution to direct the preparation of the map plan and report at the June meeting.

 

Steve Mastaitis of Franklin Beach, Saratoga Lake, and who also has property on Route 9P, asked the status of the proposed Zoning Law changes. He was told by Supervisor Robert Hall that the county is reviewing them and then if they approve there should be a vote to adopt it at the Special Town Board meeting scheduled for Thursday, May 22nd at 7:00 p.m. at the Town Hall.

 

Doug Niles of Route 9P, Saratoga Lake, commented on the need for a stone wall along part of Route 9P where he lives due to backfill problems. He was concerned that the town would not approve of the stone wall. Supervisor Robert Hall replied that he only needs to work with the NYS DOT for approvals, as the town does not own it.

 

Doug Niles also requested that No Littering signs (with hefty fines) be placed along Route 9P, as there is a real need for them. He would also like signs placed near the corner of Fitch Road and Route 9P, where the weed harvesters are parked seasonally, stating No Launching of Boats and No Littering signs, due to a beer can litter problem. Supervisor Robert Hall will speak to the County Attorney to see what can be done.

 

Historian Thomas Wood presented the town board with his Annual Report along with materials on WHO’S WHO IN THE TOWN OF SARATOGA and the Major Events of 2002 in the Town of Saratoga, Village of Schuylerville and Village of Victory. He shared copies of 3 of his research projects with the board and the public. The research projects were on The Fort Hardy Park, The Dix Bridge, and a 1950 Historian’s report to the Town of Saratoga and Village of Schuylerville. He gave an interesting power point presentation of the local events of the past year. Tom thanked the board for their support.

 

Supervisor Hall presented a letter/invoice for $150.00 from Jim Vianna, Land Surveyor, for his services regarding the Mineral Springs Property in Quaker Springs. Jim Vianna stated that he would give us credit for the $150.00 towards future surveying of the property. The letter stated that the deed title to the Mineral Springs was obtained by The Quaker Springs Mineral Springs Corp., a membership corporation, from Nellie Russell in February 1948. There was a clause reverting ownership back to Nellie Russell and her heirs if the spring should become neglected. Town Attorney, Bill Reynolds, will check into ownership and the possible purchase of the Mineral Springs, which could be obtained by a Quick Claim Deed from her heirs. The Town would then make it into a Historical Pocket Park. Councilman Michael McLoughlin will help to locate the heirs of Nellie Russell.

 

Audit the Bills: General A $9,086.03, General B $1,606.52, Highway Outside $4,545.07, Building $246.25 for a total expense of $15,483.87.

Supervisor Robert Hall opened the meeting and turned the floor over to Tracey Clothier, Senior Planner of the L.A. Group. Tracey Clothier gave a brief overview of the five areas where recommendations for revisions are being proposed. They include:

Conservation Subdivision Development Ordinance

Steep Slopes, Erosion, and Sediment Control Ordinance

Flag Lot Standards

Keeping of Animals for Non-Farm Purposes Standards

Zoning Map Change from Lake District to Lake Commercial District and Lake Residential District

Copies of the Proposed Zoning Revisions were given to the public attending.

The floor was given to the public:

 

Ralph Pascucci suggested that the moderate density area along Rt. 29, which requires 40,000 sq.ft. be changed to 60,000 sq. ft. to be the same as rural residential. He also mentioned that if the Conservation Design was used then 40,000 sq. ft. could be acceptable.

 

Allen Wood spoke against increasing the size of lots to 60,000 sq. ft. since that would use up more farmland.

 

Tom Wood suggested that under Preliminary Subdivision Design Plan, #5 which states Draw property lines so that no property is less than one-half an acre, should state - Draw property lines so that no property without municipal services is less than one-half an acre.

 

Supervisor Robert Hall stated that flag lots in hamlets wasn’t mentioned and should be included. Allen Wood questioned if Grangerville is a hamlet. Tracey Clothier added that the only hamlet on the Zoning map is Quaker Springs. Ralph Pascucci suggests some investigation into hamlets is needed.

 

Sue Cummings questioned if under Ownership, Use and Maintenance of Open Space if the three conditions listed were the only options. Ralph Pascucci suggested adding other options as approved by the Planning Board.

 

Albert Baker suggested clarification under Keeping of Animals for Non-Farm Purposes regarding the first one-acre of open space: two- (2) large animal’s section. He suggested a change to minimum lot size of two acres; one acre for the house and the second acre is the open space acre for two (2) large animals.

Ed Dwek commended Tracey Clothier and the boards for a great job.

 

Supervisor Robert Hall introduced a Resolution # 03-19 determining that action to enact amendments to the Zoning Ordinance of the Town of Saratoga will not have a significant effect on the environment. The Town has prepared a negative declaration with respect to the Action. The motion was made by Councilman Fred Drumm and seconded by Councilman Bruce Cornell to adopt Resolution # 03-19.

Anyone interested in attending can obtain a registration form at the Town Hall; The New York State Emergency Management Office, regarding a payment to the town for $8,798.03 to help pay for the 2002 Christmas Eve Snowstorm; A letter from Thomas Martin, Schuylerville High School Principal, requesting a donation for the Town of Saratoga Awards to the two seniors having earned the most points under the Student Council point system. The board members agreed to contribute $20 each for a total of $100. Supervisor Robert Hall stated that the Emergency Medical Services Agreement between the Town of Saratoga and the General Schuyler Emergency Squad has been signed by both parties.

 

Privilege of the floor:

Gail Taras addressed the board asking that they adopt a partial tax exemption for real property of persons with disabilities. She also requests that they allow medical expenses to reduce the income of the disabled person. Town Attorney Bill Reynolds will research the state law, check on the options available, and report to the board at their next meeting.

 

Wendy Lucas inquired when the next joint meeting of the town and villages will be held and Supervisor Robert Hall replied Wednesday, May 21, 2003 at 7:00 p.m. She also questioned what the increase in the funding of the Joint Recreational Project was for. It was explained that it is for the swimming program with Northumberland and the increase would enable the town to receive the full amount of grant money for the project. Wendy Lucas asked who is on the Park Committee and Councilman Michael McLoughlin replied it is made up of Councilman Michael McLoughlin, Town Attorney Bill Reynolds, Historian Thomas Wood, Councilman Fred Drumm, Mark Wells, Laurie Griffen, and Eric Weber.

 

Richard Behrens of the General Schuyler Emergency Squad, conveyed that the Basic Life Support (BLS) and Advanced Life Support (ALS) coverage that went into effect March 1, 2003 is going very well with over 100 calls and none missed. He stated that both villages have passed resolutions to be included in the program, with Victory’s posting period ending May 26, 2003. Things should be ready for the town to enact a resolution to direct the preparation of the map plan and report at the June meeting.

 

Steve Mastaitis of Franklin Beach, Saratoga Lake, and who also has property on Route 9P, asked the status of the proposed Zoning Law changes. He was told by Supervisor Robert Hall that the county is reviewing them and then if they approve there should be a vote to adopt it at the Special Town Board meeting scheduled for Thursday, May 22nd at 7:00 p.m. at the Town Hall.

 

Doug Niles of Route 9P, Saratoga Lake, commented on the need for a stone wall along part of Route 9P where he lives due to backfill problems. He was concerned that the town would not approve of the stone wall. Supervisor Robert Hall replied that he only needs to work with the NYS DOT for approvals, as the town does not own it.

 

Doug Niles also requested that No Littering signs (with hefty fines) be placed along Route 9P, as there is a real need for them. He would also like signs placed near the corner of Fitch Road and Route 9P, where the weed harvesters are parked seasonally, stating No Launching of Boats and No Littering signs, due to a beer can litter problem. Supervisor Robert Hall will speak to the County Attorney to see what can be done.

 

Historian Thomas Wood presented the town board with his Annual Report along with materials on WHO’S WHO IN THE TOWN OF SARATOGA and the Major Events of 2002 in the Town of Saratoga, Village of Schuylerville and Village of Victory. He shared copies of 3 of his research projects with the board and the public. The research projects were on The Fort Hardy Park, The Dix Bridge, and a 1950 Historian’s report to the Town of Saratoga and Village of Schuylerville. He gave an interesting power point presentation of the local events of the past year. Tom thanked the board for their support.

 

Supervisor Hall presented a letter/invoice for $150.00 from Jim Vianna, Land Surveyor, for his services regarding the Mineral Springs Property in Quaker Springs. Jim Vianna stated that he would give us credit for the $150.00 towards future surveying of the property. The letter stated that the deed title to the Mineral Springs was obtained by The Quaker Springs Mineral Springs Corp., a membership corporation, from Nellie Russell in February 1948. There was a clause reverting ownership back to Nellie Russell and her heirs if the spring should become neglected. Town Attorney, Bill Reynolds, will check into ownership and the possible purchase of the Mineral Springs, which could be obtained by a Quick Claim Deed from her heirs. The Town would then make it into a Historical Pocket Park. Councilman Michael McLoughlin will help to locate the heirs of Nellie Russell.

 

Audit the Bills: General A $9,086.03, General B $1,606.52, Highway Outside $4,545.07, Building $246.25 for a total expense of $15,483.87.

SPECIAL MEETING OF THE TOWN BOARD

ZONING ORDINANCE AND ZONING MAP REVISIONS

May 22, 2003, 7:00 p.m.

Supervisor Robert Hall opened the meeting with the Pledge of Allegiance at 7:15 p.m.

 

Roll call: Supervisor Robert Hall- present, Councilman Bruce Cornell - absent, Councilman Michael McLoughlin - present, Councilman Fred Drumm- present, and Councilman Phil Griffen- present.

 

Also present: Deputy Clerk Ruth Drumm, Senior Planner L.A. Group Tracey Clothier, Town Attorney William Reynolds, ZBA Chairman Thomas Wood, Zoning Officer Robert Hathaway, Charles Hanehan, Thomas Carringi, Mario DeSiena, Chris DiSiena, Ed Dweck, and Mark Smith.

 

 

Old Business: Supervisor Robert Hall announced that the proposed revisions to the present Zoning Ordinance have been approved with high ratings by the Saratoga County Planning Board.

Tracey Clothier added the following recommended changes resulting from the May 5, 2003 public hearing to the revised Zoning Ordinance and map amendments draft of May 22, 2003:

Under Conservation Subdivision Development Ordinance –

Page 2 section A) delete the following words from the first paragraph, last two sentences- and must be attempted first by the developer. Other design approaches will be considered if an appropriate and logical argument is presented. It is the board’s intention not to have CSD mandatory.

Page 5 section 5) – add unless municipal sewer and water are present. This will make it clear and consistent with the Page 6 Section E) requirements.

Page 9 section H) – delete the last sentence in the paragraph -The Town Board must approve any other type of use. This was deleted upon the recommendation of Town Attorney Bill Reynolds. He suggested that it gives too much discretion to the town board to vary the intent of the ordinance. The town board agreed.

Under Proposed Zoning Map Amendment -

Schedule of uses and Regulations: Lake Commercial District

Uses Requiring Special Permit – add w. Professional Office. The Zoning Officer, Bob Hathaway, recommended this.

Tracey Clothier added that the only moderate density zone (requiring a minimum of 40,000 sq.ft. per lot) left in the town will be eliminated and replaced by Rural Residential which requires a minimum of 60,000 sq. ft. per lot. Robert Hathaway commented that mining is allowed in the Rural Residential District where it is not in Moderate Density. After some discussion, it was decided to allow the special permitted uses per the Rural District schedule in the Rural Residential District. This will include mining as a special permitted use.

After some discussion, Attorney Bill Reynolds suggested that the following be added to the Rural Residential District since they were permitted in the Moderate Density Zone (the board agreed):

Privilege of the floor:

Mario DiSiena presented the board with a copy of a petition, which was read by Councilman Michael McLoughlin. The petition, objecting to any and all changes in the rezoning of the Lake District from Commercial to Residential had 51 signatures. Mario DiSiena stated that this change which puts his business in the Lake Residential District, would negatively effect his livelihood, creating a very real hardship for him.

Tracey Clothier, Senior Planner L.A.Group, responded that this change would concentrate businesses near the top end of the lake near the boat launch and the marinas and would discourage it in the primarily residential areas. She also added that during the public hearings on the zoning changes there was a lot of support from Barbara Farone and the Saratoga Lake Association due to the traffic issues on Route 9P and with parking problems. Tracey Clothier suggested that with a hardship requirement met that a Use Variance could be sought through the Zoning Board of Appeals (ZBA).

Charlie Hanehan commented that, as a member of the Comprehensive Plan Committee, there has been a lot of favorable feedback for no expanded commercial development around the lake.

A resolution # 03-22 was introduced by Councilman Fred Drumm and seconded by Philip Griffen to adopt the proposed Zoning Ordinance revisions and map amendments as stated in the attached Local Law No. 1 of the year 2003, a local law amending the Zoning Ordinance of the Town of Saratoga (Local Law # 1 of 1981). Supervisor Robert Hall – aye, Councilman Philip Griffen – aye, Councilman Fred Drumm – aye, Councilman Michael McLoughlin – aye, Councilman Bruce Cornell - absent.

Carried 4 – 0.

 

 

 

Mario DiSiena requested a copy of the minutes and a receipt for his petition. Town Attorney Bill Reynolds stated that mention of the petition in the minutes would constitute a receipt and that a FOIL request application should be sent to him so that a copy of the minutes could be obtained.
