Supervisor Thomas Wood opened the meeting with the Pledge of Allegiance
at 7:00 p.m.
Roll call: Linda McCabe, Town Clerk,
called the roll. Supervisor Thomas Wood-
present, Councilman Michael McLoughlin- absent (arrived at 7:34 p.m.),
Councilman Charles Hanehan-absent, Councilman James Jennings – present,
Councilman Gary Squires - present.
Also present: Town Attorney William Reynolds, Deputy Clerk Michelle Conover, Zoning Officer/Building Inspector Gil Albert, Maribeth & Chris Macica, Jean Seiler, Jan & Paul Murphy, Russell & Lauren Kirkwood, Michelle DeGarmo, Hub & Kate Miller, Sue Hermitage, Marjorie McShane & Sergei Niremburg, Terri Korb and Jerry Meehan. Michelle DeGarmo, Flatley Read, addressed the Board concerning the new rounds of Mobile
Home Replacement grants and Home Improvement grants. She said these grants are the same as the previous
grants they've administered for the Town.
They currently have had three requests for the replacement of mobile
homes and all are below median income for the county. The deadline for the new round is April
26th. The average cost for replacing a
mobile home is $100,000.00 plus the cost of demo and environmental needs that
must be met. They can do 5 - 10 homes,
dependent upon the site; they still have a waiting list from the last
rounds. To date, she doesn't know what
the funding round is for the home improvement program. She then explained how the grants work and
that normally the Town is charged $1500.00 for administrative fees, but this
year they are asking for in-kind services instead. They'd like the Town to consider putting in
another door in her offices in lieu of the monetary fee.
Supervisor Thomas Wood said
the Board will consider that. He then
asked if they'll get information on the Home Improvement grant to the Board and
Michelle DeGarmo said once she receives it she will.
Supervisor Thomas Wood stated
no action will be taken on this tonight; that will take place on Monday at the
regular meeting, to give the Board a chance to absorb the information provided.

a motion by Councilman Michael McLoughlin and seconded by Councilman Gary
Squires, the following Resolution #19-47,
Lead Agency Declaration, was adopted
by vote: Supervisor Thomas Wood - aye, Councilman Michael McLoughlin – aye,
Councilman Charles Hanehan – absent, Councilman James Jennings – aye,
Councilman Gary Squires – aye.
Carried 4 – 0
WHEREAS, the Town of Saratoga, desires to declare Lead Agency
for the Empire State Trail, Town of Saratoga Segment, from the Fish Creek
Pedestrian Bridge, north to the intersection of Towpath Road and Saratoga
Street in the Village of Schuylerville, plus a small trail improvement area at
the Hudson Crossing Park Gate on Lock 5 Island; and
WHEREAS, the
Village of Schuylerville Board of Trustees has passed a resolution allowing the
Town of Saratoga to take the Lead Agency and complete the SEQR process on the
Empire State Trail, Town of Saratoga Segment Project; and
WHEREAS,
said project is an Action subject to the provisions of the New York State
Environmental Quality Review Act (SEQR) and the regulations promulgated to
implement said Environmental Quality Review Act, and
WHEREAS,
the provisions of SEQR require the designation of a "Lead Agency” to
determine the environmental significance of the Action, and
WHEREAS,
this agency wishes to function as “Lead Agency” in this matter, and
WHEREAS,
this agency has complied with the provisions of SEQR pertaining to “Lead
Agency” designation, now, therefore, be it
RESOLVED,
that this agency be and is the same hereby designated the “Lead Agency” for the
purpose of conducting the SEQR review of this project.
On a motion by Councilman
Michael McLoughlin and seconded by Councilman Gary Squires, the following Resolution #19-48, Negative Declaration for
SEQR Purposes of the Empire State Trail, Town of Saratoga Segment in the
Village of Schuylerville, was
adopted by vote: Supervisor Thomas Wood - aye, Councilman Michael
McLoughlin – aye, Councilman Charles Hanehan – absent, Councilman James
Jennings – aye, Councilman Gary Squires – aye.

WHEREAS, the Town Board of the Town of Saratoga, Saratoga
County, New York (the "Town") is declaring Lead Agency for SEQR
purposes for the Empire State Trail, Schuylerville section; and
WHEREAS, pursuant to
Article 8 of the Environmental Conservation Law, Chapter
43-b of the
Consolidated Laws of New York, as amended (the "SEQR Act") and the
regulations adopted pursuant thereto by the Department of Environmental
Conservation of the State of New York ("DEC"), being 6 NYCRR Part
617, as amended (the "Regulations"), the Town Board as lead agency
desires to determine whether this Action may have a significant effect on the
environment and therefore require the preparation of an environmental impact
statement; and
WHEREAS, there has been
prepared a full environmental assessment form for the Project (the
"EAF"), a copy of which was previously reviewed by the Town
Board, and a copy of which is on file in
the office of the Town Clerk; and
WHEREAS, pursuant to the
Regulations, the Town has examined the EAF in order to make a determination as
to the potential environmental significance of Action; and
WHEREAS, the Action
appears to constitute a "Type I Action" (as defined by the
Regulations);
NOW, THEREFORE, BE IT RESOLVED BY THE
TOWN BOARD OF THE TOWN OF
1.
Based on an examination of the EAF and based further upon the Town's
knowledge of the area, the Town makes the following findings:
(a) The Action constitutes a "Type 1
Action" (as defined in the Regulations);
(b)
No potentially significant effect on the environment is noted in the EAF
for this Action, and none are known to the Town;
(c) This
Action will not have a significant effect on the environment; and the Town will
not require the preparation of an environmental impact statement with respect
to the Action; and
(d)
As a result of the foregoing, the Town has prepared a Negative
Declaration with respect to the Action.
2. The Town Clerk is hereby directed to file a
Negative Declaration with respect to the Action (said Negative Declaration
attached hereto); and a copy of the negative declaration shall be maintained in
the office of the Town Clerk in a file that will be readily accessible to the
public.
3.
This resolution shall take effect immediately.
The
foregoing resolution was thereupon declared duly adopted.

Supervisor Thomas Wood showed
Board members the proposed sketch for a historical mural that local artist,
Paul Anderson, has offered to paint for the Town. He said that Paul Anderson said there will be
local organizations raising funds to pay for the mural. The mural will be four panels with a combined
size of 4' x 16'. Attorney William
Reynolds questioned if it will be donated to the Town and will ownership become
the Town. Supervisor Thomas Wood replied
he will ask that question. After some
discussion with the Board it was decided they need a better sample of what the
mural will be.
Supervisor Thomas Wood stated
the Board needed to go into Executive Session to discuss litigation issues. A
motion was made by Councilman Gary Squires, seconded by Councilman Michael McLoughlin, to
enter into Executive Session at 8:40 p.m. Supervisor Thomas Wood- aye, Councilman
Michael McLoughlin- aye, Councilman Charles Hanehan- absent, Councilman James
Jennings – aye, Councilman Gary Squires - aye.

A motion to exit Executive
Session was made at 9:18 p.m by Councilman James Jennings, seconded by Councilman
