Town Clerks report for February 2018: Fees paid to the NYS Dept. of Agriculture and Markets for the Animal Population Control Program $50.00. Fees paid to New York D.E.C. for hunting and fishing licenses $23.62. Fees paid to the New York State Health Department for Marriage licenses $0. Dog license fees to Supervisor Thomas Wood $220.00. Miscellaneous Clerk fees to Supervisor Thomas Wood $21.13. Total State and Local Revenues received were $314.75.
Zoning Officers report for February 2018: Gil Albert reported: 4 Building Permits Issued, 18 Building Inspections, 8 Certificates of Occupancy, 0 Junkyard Permits, 0 Complaints, 1 Fire inspection, 0 Orders to Remedy, 3 misc., 2 Building Permit Renewals, 1 Property Maintenance Inspection. A check for $1,531.25 was given to Supervisor Thomas Wood.
Dog Control officers report for February 2018: The report was read by Supervisor Thomas Wood: Dog
Control Officer Ed Cross answered 25 complaints, took 0 dog
to the shelter, traveled 48 miles, issued 18 warnings and 2 summons were issued and 0 bite cases.
Town Court report for February 2018: The following were closed: 50 Vehicle & Traffic, 11 Criminal/Penal Law, 1 DEC/ENCON, 2 Dog cases, 3 DWIs, 0 Town & Village Ordinance, 0 Small Claims/Civil, 2 Evictions, 2 Hearings, 3 (case transfer) Divestiture Forms sent to County Court, 2 Probation, 0 hours of Community Service issued, 0 days of jail time issued, 0 Orders of Protection issued, and $8,408.00 in fees were paid to the NY State Comptroller.
Tax Collectors report: Supervisor Thomas Wood read Tax Collector Marge Kirkpatricks
report. As of the morning of March 7th, the Tax Collector has collected $3,097598.81 which
is 82% of taxes paid. There were 26 payments on-line, 1,847 through the
mail and 869 at the bank and/or in office.
Historians report for February
2018: Supervisor Thomas Wood read the following report: The Historian Office
has been focused on photos taken in the late 1980s by Historian Tom Wood as
well as the Gamache Collection. The
community has been very helpful in identifying the photos and they will be
shared on the Historians Blog.
March 17, 2018
- Heritage Hunters of Saratoga County will meet at 1 p.m. at Town Hall, with
Benjamin Kemp, a Civil War re-enactor and site coordinator of the Grant
Cottage, presenting United States President and Union General, Ulysses S.
Grant, and Grants relationship with the Irish.
March 20, 2018
- Deputy Historian Pat Peck will lead a genealogy group at the Schuylerville
Public Library at 10 a.m.
March 22, 2018
- The Old Saratoga Historical Association will meet with Village Historian,
Krissy Saddlemire, on the history of Schuylerville, at 7:30 pm.
Assessors report for February 2018: Supervisor Thomas Wood read the Assessor's
report. It stated it had been an
incredibly busy month at the Assessors office.
All new exemption applications and renewal application were due March 1st. Applications have been processed and exemption
removal notices will be sent out to those residents that did not submit their
renewal applications.
He
will begin their two day a week office hours.
The office is now open:
Tuesdays
- 5:00 p.m. 8:00 p.m.
Thursdays
- 9:00 a.m. - 3:00 p.m.
The
Assessor's Clerk, Dorothy Lavazzo, is in the office on Thursdays, and the
Assessor is in the office Tuesdays and Thursdays.
Over
the next few weeks he will be updating assessed values to include changes made
over the last year and he will be conducting field review of new
construction.
Property
sales have slowed down, which is to be expected this time of year. Since last months meeting his office
processed 7 sales; of which 2 sales were
valid and 5 were non-valid sales.

WHEREAS, this agreement, made the 12th day of March, 2018, between the Town of Saratoga, hereinafter referred to as the "Landlord", and Lori Solomon, hereinafter referred to as the "Tenant"; and
WHEREAS, the Tenant has previously leased from the Landlord real property premises known as 12 Spring Street, Suite 203, Room 2W, Schuylerville, New York, pursuant to a lease dated December 2017; now, therefore, be it
RESOLVED, that it is the desire of the Tenant that the Tenant surrender the leased premises to the Landlord, and that the Landlord accept the surrender of the leased premises, it is now therefore agreed as follows:
1. In consideration of the forfeiture by the Tenant of security in the amount of $119.00, the Landlord releases the Tenant from any and all obligations of the aforesaid lease agreement, and the Tenant releases and relinquishes any and all right, title, claim or interest in and to the leased premises.

RESOLVED, that the Town Board of the Town of Saratoga authorizes the Town Supervisor to apply for the $140,000.00 Empire State Trail Grant and enter into contract with New York State and The LA Group to develop plans for and construct the trail from the footbridge on the tow path over Fish Creek to Red's Road and to Curtis Lumber.

- Declaring
the CDBG Home Improvement Program, using 2107 NYS Community Development Block
Grant Funding, to consist of Type II Actions under State Environmental Quality

WHEREAS, federal grant funding is available through the NYS
Homes and Community Renewal to support local housing and community development
activities which are undertaken by eligible municipalities; and
WHEREAS, the Town of Saratoga has been awarded such funding through the 2017
Program Year funding competition under the NYS Community Development Block
Grant (CDBG) Program; and
WHEREAS, the Town of Saratoga will
use the 2017 CDBG funds to implement a community-wide housing rehabilitation
program for existing eligible single family owner occupied homes located within
the Town of Saratoga, including the Villages of Schuylerville and Victory; and
WHEREAS, the Town of Saratoga is
required by federal regulations to undertake an environmental review of 2017
CDBG Program activities, included under NEPA and SEQRA, prior to the Release of
Funds being issued by the NYS Office of Community Renewal; now, therefore, be
it
RESOLVED, that the Town of Saratoga
has completed the attached SEQR short environmental assessment form (EAF on
file in the Clerk's office) for the CDBG Housing Rehabilitation 2017 Program;
now, therefore, be it
FURTHER
RESOLVED, that the
Town Board of the Town of Saratoga has
declared the CDBG Housing Rehabilitation 2017 Program to consist of Type II
Actions under SEQRA in accordance with 6 NYCRR §617.5(c)(1), (2), and (11).

the services of Flatley Read to Administer the DASNY SAM Salt Storage Shed

WHEREAS, the
Town of Saratoga has received a signed contract from DASNY SAM (Dormitory
Authority of the State of New York and State and Municipal Facilities) in the
amount of $100,000.00 for a salt storage shed; and
WHEREAS, there are very strict rules and procedures that must be
followed in the administration and execution of this grant; now, therefore, be
it
RESOLVED, that the Town Board of the
Town of Saratoga, engage the services of Flatley Read, LLC at a rate of $75.00
per hour, not to exceed a total of $500.00, for the administration of this
grant.

Construction of Saratoga Country Inn PUD until May 12, 2020, was adopted by

WHEREAS, on February 14, 2005, the Town Board of the Town of
Saratoga granted final approval for the Saratoga Country Inn PUD, by amending
the Zoning Ordinance of the Town; and
WHEREAS, Article X, Section 3(J) of
the Zoning Ordinance provides that approval for a PUD development project shall
become null and void if construction has not begun within two years of the Town
Board approval; and
WHEREAS, due to circumstances beyond control of the
owner and applicant, said construction work has not begun as planned, and for
good cause shown to the Town Board; it is therefore
RESOLVED, that there is hereby
granted an extension of time until May 12, 2020, within which construction work
must begin for the Saratoga Country Inn PUD and such construction must be
completed on or before eighteen (18) months of issuance of the first building
permit, and it is further
RESOLVED, that if the aforesaid time limitations are
not met, then the approval for this development project shall become null and
void.

seconded by Councilman Gary Squires, the following Resolution #18-52 - Agreement Between the Town Board of the Town of
Saratoga and the Highway Superintendent of the Town of Saratoga, for the
Expenditure of the 2018 Highway Moneys, pursuant to the provisions of Section
284 of the Highway, was adopted by vote: Supervisor Thomas Wood -

RESOLVED,
Pursuant to the provisions of Section 284 of the Highway Law, the
Town Board and the Town Highway Superintendent agree
that moneys levied and
collected in the Town for the repair and improvement
of highways, and received from
the State for State Aid for the repair and improvement
of highways, shall be expended as
follows:
1.
GENERAL REPAIRS: The sum of $90,000.00 shall
be set aside to be expended for primary work and general repairs upon 60 miles
of town highways, including sluices, culverts and bridges having a span of less
than five feet and boardwalks or renewals thereof.
2.
PERMANENT
IMPROVEMENTS: The following sums shall be set aside to be expended for the
permanent improvement of Town Highways:
a.
On the road
commencing at NYS Rt. 32 and leading to Duell Rd., a distance of 1 mile, there
shall be expended not over the sum of $125,000.00; using Blacktop Type 6, 21
width of traveled surface, 1.5 T & L thickness, subbase of gravel, stone
and oil - shimming - blacktop, Wilbur Rd, NYS Rt. 32 to Duell Rd. (CHIPS)
b.
On the road
commencing at NYS Rt. 4 and leading to Wilbur Rd. Ext., a distance of .75
miles, there shall be expended not over the sum of $80,000.00; using Blacktop
Type 6, 20 width of traveled surface, 1.5 T & L thickness, subbase of
grave, stone and oil - shimming - blacktop, River Rd. to NYS Rt. 4 to Wilbur
Rd. Ext. (CHIPS Balance and Pave NY)
c.
On the road
commencing at NYS Rt. 4 and leading to Evans St., a distance of 1.25 miles,
there shall be expended no over the sum of $130,000.00; using Blacktop Type 6,
20width of traveled surface, 1.5 T & L thickness and subbase of gravel,
stone and oil - shimming - blacktop, Haas Rd. - NYS Rt. 4 to Evans St. (2018 Budget DB5112.4.)

WHEREAS,
the Historic Hudson-Hoosic Rivers Partnership is an entity formed of
local municipalities, county, state and federal agencies and not-for-profit
community organizations which was created by New York State Legislation in 2006
and 2009, which evolved into a nonprofit organization; and
WHEREAS, the mission of the Historic
Hudson-Hoosic Rivers Partnership is to preserve, enhance and develop the
historic, agricultural, scenic, natural and recreational resources and the
significant waterways within the Partnership region; and
WHEREAS, the Partnership advances collaborative projects with non-profit and governmental entities with an emphasis on both agricultural and open space protection, economic and tourism development, and the protection and interpretation of our natural and cultural heritage; and
WHEREAS, the Town of Saratoga shares the Partnership's goals and supports fostering collaborative approaches to preserve a landscape supporting the historic, cultural and environmental assets of the upper Hudson Valley watershed, to protect its traditional land uses and environmental quality and to develop the economic potential of heritage and outdoor recreational tourism; and
WHEREAS, the Historic Hudson-Hoosic Rivers Partnership has invited our municipality to become a member; now, therefore, be it
RESOLVED, that the Town Board of the Town of Saratoga pass this resolution at a regularly scheduled meeting held on March 12, 2018, to join the Historic Hudson-Hoosic Rivers Partnership.

the following Resolution #18-54 - Lease Agreement with Austin Dean and Jeremy Messini of Evolve Media, Suite 203, Room 2E, North Wing, Second Floor, was

WHEREAS, the Town has excess space in the Town Hall at 12
Spring Street, Schuylerville, NY which is unneeded for Town purposes, and which
has been leased previously; and
WHEREAS, the Town Board desires to lease such excess space for
fair and adequate consideration; it is hereby
RESOLVED, that Suite 203, Room 2E, be leased to Austin Dean and Jeremy Messini, Evolve Media, 382 Co. Rt. 77, Greenwich, NY 12834, annually beginning on March 15, 2018, for a monthly rental amount of $225.00, 4% cost of utilities each month and other terms as set forth under a form of lease agreement presently in use for other business tenants in the Town Hall; and it is further
RESOLVED, that the Town Supervisor is authorized to enter into a lease agreement to carry out this resolution, subject to approval of the Town Attorney as to form.

WHEREAS, the Town of Saratoga is engaging in a contract with
the New York State Empire Trail Program and with The LA Group for the
preparation, planning, construction and monitoring of the grant; and
WHEREAS, the grant is for
$140,000.00 and is a reimbursable grant; now, therefore, be it
RESOLVED,
by the Town Board of the Town of
Saratoga, to authorize the transfer of $140,000.00 from Parks Reserve to
construct the Empire State Trail/Champlain Canalway Trail, from the pedestrian
footbridge over Fish Creek (south of Ferry St.), north to Red's Rd. and to
Curtis Lumber; and this reserve account will be reimbursed upon completion of
the project.

Facilities) Grant for construction of a salt storage shed; and
WHEREAS, the grant is a reimbursable grant; now, therefore, be it
RESOLVED, by the Town Board of the
Town of Saratoga, to authorize the transfer of $100,000.00 from Building
Reserve to complete construction of the salt storage shed at the Town of
Saratoga Highway Garage and this reserve account will be reimbursed upon
completion of the project.

WHEREAS, the Town of Saratoga is being awarded a DASNY SAM
(Dormitory Authority of the State of New York and State and Municipal
Facilities) Grant for $125,000.00 for the construction of a boat launch on the
Hudson River on US RT 4, south of the Village of Schuylerville; and
WHEREAS, the grant is a reimbursable
grant; now, therefore, be it
RESOLVED, that the Town Board of the
Town of Saratoga, authorizes the transfer of $125,000.00 from Building Reserve
for the construction of the boat launch and this reserve account will be
reimbursed upon completion of the project.

RESOLVED, that the Town Clerk is authorized to send a written waiver
of the Town of Saratogas rights to the 30 day hold and that the Town of
Saratoga Town Board consents to the processing and issuance of the license by
the New York State Liquor Authority.
