TOWN BOARD MEETING OF THE TOWN OF SARATOGA

12 SPRING ST., SCHUYLERVILLE, NY

 

June 13, 2016

7:00 P.M.

 

Supervisor Thomas Wood opened the meeting with the Pledge of Allegiance

at 7:00 p.m.

 

Roll call: Town Clerk Linda McCabe, called the roll.  Supervisor Thomas Wood – present, Councilman Charles Hanehan - present, Councilman Michael McLoughlin – present, Councilman James Jennings – present, Councilman Gary Squires – present.

 

Also present: Zoning Officer/Building Inspector Gil Albert, Highway Superintendent Don Ormsby Jr., Deputy Clerk Michelle Conover, Town Attorney William Reynolds, Dave Cummings, Jaime O’Neill and other interested  persons.

 

Recognitions/Presentations/ Bid openings/ Public Hearings:

Dave Cummings addressed the Board stating the town entered into a sister-city relationship with Fethard/Kilusty, Ireland in June, 2007.  He said he was happy to announce an upcoming trip to our sister-city, Fethard/Kilusty Ireland.  The trip is planned for October 15 – 22, 2016.  He added that there is a minimum of 10 people required for this tour; to date they have 9 signed up.  For futher details, please contact Dave Cummings, (518) 695-6374 or Celtic Tours (Group Dept.) at (518) 862-0042 or (800) 833-4373.

 

Jaime O’Neill, of Saratoga County Planning Dept., addressed the Board concerning grants through the Farmland Protection Plan.  She stated the grants of $25,000 (or 75% of the cost, whichever is less) are available from NYS Ag & Markets.  She explained that two municipalities can apply together to request up to $50,000.  This is a rolling application period; no deadline and $165,000 in awards has been announced.  This is approximately an 18 month process, although extensions can be received as long as progress is demonstrated.  Towns can hire a consultant to write the grant, with the understanding that they will do the work when awarded.  She then reviewed the components of the plan as well as helpful recommendations on supporting agriculture in towns and said it is expected that the Farmland Protection Plan will become part of a Town’s Comprehensive Plan.  She will be happy to provide applications and can be contacted for said applications and/or questions at #884-4705 or email: joneill@saratogacountyny.gov. 

 

Supervisor Thomas Wood stated that tonight’s public hearing is for some amendments to the Town’s Zoning Regulations that have been quite restrictive compared to neighboring towns.  These amendments are in the Lake Residential and Lake Commercial Districts.  He added that the Joint Board has worked very hard updating these much needed amendments to our regulations. 

 

Public Hearing on Local Law #6 of 2016- Zoning Regulations Amendments - Proof of notice in the Saratogian on June 3, 2016 having been provided, Supervisor Thomas Wood opened the Public Hearing at 7:30 p.m. for Local Law #6, asking those wishing to speak to please state their name and address for the record:

 

Doug Niles, 1266 Rt. 9P, questioned the amount of lot coverage.  Zoning Officer Gil Albert responded lot coverage was 20% and now will be 35%, adding that the Zoning Board will stand firm on that. 

 

A motion was made by Supervisor Thomas Wood and seconded by Councilman Charles Hanehan to close the Public Hearing at 7:33 p.m.  Supervisor Thomas Wood – aye, Councilman Michael McLoughlin – aye, Councilman Charles Hanehan – aye, Councilman James Jennings – aye, Councilman Gary Squires - aye.

Approval of Minutes: A motion was made by Councilman Michael McLoughlin and seconded by Councilman Charles Hanehan to accept the minutes of the May 9, 2016 regular meeting as written.   Supervisor Thomas Wood – aye, Councilman Charles Hanehan – aye, Councilman Michael McLoughlin – aye, Councilman James Jennings – aye, Councilman Gary Squires – aye.

Town Clerk’s report for May 2016: Fees paid to the NYS Dept. of Agriculture and Markets for the Animal Population Control Program $86.00.  Fees paid to New York State D.E.C. for hunting and fishing licenses $292.88.   Fees paid to the New York State Health Department for Marriage licenses $0.  Dog license fees to Supervisor Thomas Wood $383.00. Clerk fees to Supervisor Thomas Wood $27.12.  Total State and Local Revenues received were $798.00.

 

Zoning Officer’s report for May 2016: Gil Albert reported: 11 Building Permits, 19 Building Inspections, 3 Certificates of Occupancy, 2 Junk Yard Permits, 1 Orders to Remedy, 0 Fire inspections, 1 Complaint, 4 Building Permit Renewal/s, 0 Property Maintenance Inspections, and 6 miscellaneous appointments.  A check for $2,100.00 was given to Supervisor Thomas Wood. 

 

Dog Control Officer’s report for May 2016: The report was read by Supervisor Thomas Wood:  answered 31 complaints, took 0 dogs to the shelter, 0 bite case, traveled 36 miles, issued 27 warnings and 5 summons were issued. 

 

Town Court report for May 2016: The following were closed: 48 Vehicle & Traffic, 5 Criminal/Penal Law, 2 DEC/ENCON, 3 Dog cases,  3 DWI’s, 0 Town & Village Ordinance, 0 Small Claims/Civil, 2 Evictions, 0 Hearings, 1 (case transfer) Divestiture Forms sent to County Court, 1 Defendant/s sentenced to probation, 0 hours of community service issued, 0 days of jail time issued, 0 Orders of Protection issued, and $6995.00  in fees were paid to the NY State Comptroller.

 

Historian’s report:  May 2016:

In May, there were 24 posts on his website with 224 visitors; two of which were inquiries for research.  He participated in the Association of Public Historians of New York State Mini-conference in Glens Falls, where they learned about historic districts and collections management.  He also attended a talk in Malta on the early conflicts in Saratoga.

He is finishing research on baseball player John Mulligan, deceased veteran Arthur Traver and some National Register nominations.

One of the duties of the Historian is to support tourism promotion, which he believes he does, in part by sharing photos of our community on social media.  This past month, one of the sunrise photos that he took of the Hudson River was shared on the CBS This Morning show.  This is a major accomplishment for any community; to have the beauty of their community shared on a national television show.  The show has an average viewership of 3.870 million viewers. 

There is a resolution before you tonight to apply for a new grant for a marker commemorating Legends and Folklore in New York State through the William G. Pomeroy Historic Roadside Marker Grant Foundation.  This is the same program that he used two years ago for the Dean’s Corner marker, mentioning Fredrick Douglas.  This will call some attention to the mineral springs at Quaker Springs.  He will need the highway crew to erect the marker and Highway Superintendent Don Ormsby has agreed to that. 

The following will take place in June:

June 18th – Heritage Hunters will meet at 1:00 p.m. with Tim Meyers presentation on writing family history.

June 21st – Genealogy Help Group will meet at 10:00 a.m. at the library.

June 23rd – The Old Saratoga Historical Association will meet at 7:00 p.m. at the Prospect Hill Cemetery.

The National Park has opened the Monument and the Schuyler House on Fridays through Sundays. 

 

Assessor’s report for May 2016:

The Board of Assessment Review met on May 24th and six town residents attended to grieve their assessments.  The Board also had two mail-in Grievances, four corrections and three stipulations.  After receiving the decisions by the Grievance Board, we will input that data for the assessment roll.  The Final Roll for 2016 will be available July 1st. 

 

The 2017 Roll will be created after the decisions are received from the Board of Assessment review and sales will begin to be entered and verified once again.

The Assessor’s office will be open from June 1st - November 1st on Tuesdays and Wednesdays from 9:00 AM until 1:00 PM.

Insurance:  Supervisor Thomas Wood stated the Resolution for the new insurance plans will be read under New Business.

  

Youth: Councilman Michael McLoughlin stated that the Swim Program will be 7/4/16 – 8/5/2016 at Christ the King Spiritual Center and to date 12 have signed up for the swimming classes.

 

Senior Citizens:  The Old Saratoga Seniors met on May 18th for a sandwich luncheon.  They had their election of officers and voted on Senior of the Year, which will be announced at the birthday celebration.  The Birthday celebration was held on June 8th at the Prime restaurant, Lake Ave., Saratoga Springs, NY with 47 in attendance.  The new President is Donna DeAngelo, the new Vice President is JoAnn Hanna and the new Senior of the Year is Margaret Patt. 

The following trips are planned:

July 22nd – Erie Canal  (Please contact Mary LaMora at #584-7986 for reservations)

September - trip planned to go to Lake George Steamboat

*Meetings will begin again in September.

 

Councilman James Jennings noted that the Veterans were going to the Dave DeHeer house to build a ramp with materials donated by the American Legion.

 

The Quaker Springs Sunshiners met on May 9th with 18 members in attendance for the luncheon.  Nancy Purington presented a video of General Moreau and his wife; a history of his coming here from France, his relationship with Napolean and the town being named after him.  They also had a meeting on June 13th with Virginia Cornell and Cathy Thomas supplying refreshments.

Possible future trips may be to:  Proctors Theater, the Log Cabin in MA or Williams Inn in MA.  Contact Ray Bratage for more information.

 

Parks/Schuyler Park Committee:  Councilman Gary Squires stated the Committee met two weeks ago and they are beginning the process  of looking at quotes for building a new pavilion for the west side of the park, to mirror the existing pavilion.

            RESOLVED, by the Town Board of the Town of Saratoga, to transfer $20,000 from the Transfer to Capital Project, A9950.9 to Schuyler Park, H5031as budgeted.

 

On a motion made by Councilman James Jennings and seconded by Councilman Gary Squires, the following Resolution #16-83 – Transfer of Funds - $3,500 from Demolition of Unsafe Buildings, A3650.4 to Building Equipment, A1620.2 was adopted by vote: Supervisor Thomas Wood – aye, Councilman Michael McLoughlin – aye, Councilman Charles Hanehan – aye, Councilman James Jennings – aye, Councilman Gary Squires – aye.

            RESOLVED, by the Town Board of the Town of Saratoga, to transfer $3,500 from Demolition of Unsafe Buildings, A3650.4, to Building Equipment, A1620.2, for the purchase of a wood chipper and chain saw for the creation and maintenance of recreation trails.

 

On a motion made by Councilman Charles Hanehan and seconded by Councilman                                                   Michael McLoughlin, the following Resolution #16-84 – Designating a ‘Lead Agency’ for the purpose of conducting an environment review of a proposed action, Local Law #6,

2016 - Zoning Amendments in the Lake Commercial and Lake Residential Districts was adopted by vote: Supervisor Thomas Wood – aye, Councilman Michael McLoughlin – aye, Councilman Charles Hanehan – aye, Councilman James Jennings – aye, Councilman Gary Squires – aye. 

Carried 5 – 0.

            WHEREAS, the Town Board of the Town of Saratoga has determined that Zoning Amendments are needed in certain districts, and

            WHEREAS, this is an Action subject to the provisions of the New York State Environmental Quality Review Act (S.E.Q.R) and the regulations promulgated to implement said Environmental Quality Review Act, and

            WHEREAS, the provisions of S.E.Q.R require the designation of a ‘Lead Agency’ to determine the environmental significance of the Action, and

            WHEREAS, this agency has complied with the provisions of S.E.Q.R. pertaining to ‘Lead Agency’ designation, now therefore, be it

            RESOLVED, that the Town Board of the Town of Saratoga is hereby designated the ‘Lead Agency’ for the purpose of conducting the S.E.Q.R. review of the referenced Action.

 

On a motion made by Councilman Charles Hanehan and seconded by Councilman Michael McLoughlin, the following Resolution #16-85 – Determining that Action to Enact an Amendment to the Zoning Ordinance of the Town of Saratoga will have no significant effect on the environment – Local Law #6 of 2016 – Zoning Amendments in the Lake Commercial and Lake Residential was adopted by vote: Supervisor Thomas Wood – aye, Councilman Michael McLoughlin – aye, Councilman Charles Hanehan – aye, Councilman James Jennings – aye, Councilman Gary Squires – aye.  Carried 5 – 0.

            WHEREAS, the Town Board of the Town of Saratoga, Saratoga County, New York (the "Town") is considering enacting certain amendments to the Zoning Ordinance of the Town of Saratoga (the “Action”); and

            WHEREAS, pursuant to Article 8 of the Environmental Conservation Law, Chapter 43-b of the Consolidated Laws of New York, as amended (the "SEQR Act") and the regulations adopted pursuant thereto by the Department of Environmental Conservation of the State of New York ("DEC"), being 6 NYCRR Part 617, as amended (the "Regulations"), the Town Board as lead agency desires to determine whether this Action may have a significant effect on the environment and therefore require the preparation of an environmental impact statement; and

               WHEREAS, there has been prepared a short environmental assessment form for the Project (the "EAF"), a copy of which was previously reviewed by the Town Board and a copy of which is on file in the office of the Town Clerk; and

               WHEREAS, pursuant to the Regulations, the Town has examined the EAF in order to make a determination as to the potential environmental significance of Action; and

               WHEREAS, the Action appears to constitute a "Type I Action" (as defined by the Regulations); now, therefore, be it

               RESOLVED, by the Town Board of the Town of Saratoga, Saratoga County, New York, as follows:

 

               1. Based on an examination of the EAF and based further upon the Town's knowledge of the area and such further investigation of the proposed zoning amendment and its environmental effects as the Town has deemed appropriate, the Town makes the following findings:

(a)   The zoning amendment is described in the EAF;

(b)    The Action constitutes a "Type 1 Action" (as defined in the Regulations);

(c)   No potentially significant effect on the environment is noted in the EAF for this Action, and none are known to the Town;

(d)   This Action will not have a significant effect on the environment; and the Town will not require the preparation of an environmental impact statement with respect to the Action; and

(e)  As a result of the foregoing, the Town has prepared a negative declaration with respect to the Action.

                2. The Town Clerk is hereby directed to file a Negative Declaration with respect to the Action (said negative declaration attached hereto); and a copy of the negative declaration shall be maintained in the office of the Town Clerk in a file that will be readily accessible to the public.

               3.  This resolution shall take effect immediately.

The Zoning Ordinance of the Town of Saratoga is hereby amended in the following respects:

 

 

Section 1 – Section 400-40 of the Town Code is amended to read as follows:

 

Section 7         Lake Commercial District (LC)

 

A.        District Preamble:  It is the purpose of this zoning district to recognize the northeast area of 9P along Saratoga Lake as an existing built up area consisting of mixed land uses at a higher density than that in the surrounding area of the Town.

 

B.         Intent:  It is the intention of this district to accommodate additional land uses at such densities that is in keeping with the essential character of the hamlet and its ability to accommodate them.

 

C.         Public Sewer and Water: Hook up to public sewer and water is required for all uses.

A.        District Preamble:  It is the purpose of this zoning district to insure orderly development and redevelopment of seasonal and year-round dwelling units, and recreational uses in that area of the town where such development occurs.

 

B.         It is the intent of this zoning district to encourage the redevelopment and rehabilitation of seasonal dwellings and customary associated land uses, the reduction of densities and larger waterfront lots.

RESOLVED, that the town of Saratoga create the part-time position of Recreation Maintenance Worker.

            RESOLVED, that the Town Board of the Town of Saratoga, hire Martha Allen of Schuylerville, NY, for the position of part- time Recreation Maintenance Worker, at the rate of $10.00 per hour.

WHEREAS, the Town of Saratoga Highway Superintendent is in need of a deputy; therefore be it

RESOLVED, that the Town Board of the Town of Saratoga appoints James Jennings as Deputy Highway Superintendent from June 13, 2016 – December 31, 2016.

 

On a motion made by Councilman  James Jennings and seconded by Councilman Gary Squires, the following Resolution #16-90 – Agreement between the Town Board of the Town of Saratoga and the Town of Saratoga Highway Superintendent for the Expenditure of Highway Moneys, Pursuant to the Provisions of Section 284 of the Highway Law, was adopted by vote: Supervisor Thomas Wood – aye, Councilman Michael McLoughlin – aye, Councilman Charles Hanehan – aye, Councilman James Jennings – aye, Councilman Gary Squires – aye.  Carried 5 - 0

                                    RESOLVED, Pursuant to the provisions of Section 284 of the Highway Law, the Town Board

                       

the Town Highway Superintendent agree that moneys levied and collected in the Town for the

                        repair and improvement of highways, and received from the State for State Aid for the repair and

                        improvement of highways, shall be expended as follows:

                       

1.      GENERAL REPAIRS:  The sum of $100,000.00 shall be set aside to be expended for primary work and general repairs upon 60 miles of town highways, including sluices, culverts and bridges having a span of less than five feet and boardwalks or renewals thereof.

2.      PERMANENT IMPROVEMENTS:  The following sums shall be set aside to be expended for the permanent improvement of Town Highways:

a.        On the road commencing at NYS Rt. 32 and leading to NYS Rt. 29, a distance of 1.80 miles, there shall be expended not over the sum of $120,000.00; using Blacktop type 6, 20’ width of traveled surface, 1.5” T & L thickness, subbase of gravel, stone & oil, blacktop and shimming.  (DEGARMO RD.) 

b.      On the road commencing at NYS Rt. 32S and leading to Minnie Bennett Rd, a distance of .65 miles, there shall be expended not over the sum of $63,000.00; using Blacktop type 6, 20’ width of traveled surface, 1.5” T & L thickness, subbase of gravel, stone & oil, blacktop and shimming. (HATHAWAY RD.)

c.       On the road commencing at Wilbur Rd. and leading to the National Cemetery, a distance of .75 miles, there shall be expended not over the sum of $67,000.00; using Blacktop type 6, 22’ width of traveled surface, 1.5” T & L thickness, subbase of gravel, stone & oil, blacktop and shimming.  (DUELL RD.)

WHEREAS, the Town has excess space in the Town Hall at 12 Spring St, Schuylerville, NY which is unneeded for Town purposes, and which has been leased previously, and

WHEREAS, the Town Board desires to lease such excess space for fair and adequate consideration, it is hereby

            RESOLVED, that Office 3E-1, 420 square feet of space in the North wing, second floor of the Town Hall, be leased to Flatley-Read, LLC on a month to month basis, with a base rental of $428.75 (includes “triple net charges”), excluding utilities, said rent and other terms to be as set forth under a form of lease agreement presently in use for other business tenants in the Town Hall, and it is further,

            RESOLVED, that the Town Supervisor is authorized to enter into a lease agreement to carry out this resolution subject to approval of the Town Attorney as to form.

 

On a motion made by Councilman Michael McLoughlin and seconded by Councilman              Gary Squires, the following Resolution #16-92 – Authorization to Apply for a $300,000 Housing Rehabilition Grant, was adopted by vote: Supervisor Thomas Wood – aye, Councilman Michael McLoughlin – aye, Councilman Charles Hanehan – aye, Councilman James Jennings – aye, Councilman Gary Squires – aye.  Carried 5 – 0

                                    WHEREAS, the Town Board finds it in the best interests of the Town to seek grant funding

                        for community revitalization in a target area that incorporates the Town of Saratoga, including both

                        the Villages of Schuylerville and Victory; and

                                    WHEREAS, the Affordable Housing Corporation (AHC) Program provides funding for

                         such projects to municipal applicants; and

                                    WHEREAS, the Town has determined that a Housing Rehabilitation Program to be in the best

                        interest of supporting community and economic revitalization in the target area; and

                                    WHEREAS, the Housing Rehabilitation Program will help support continued sustainable

                        economic growth in the community, by alleviating pockets of blight throughout the residential areas

                         in all three participating municipalities; now, therefore, be it

                                    RESOLVED, that the Town of Saratoga has agreed to submit an AHC application, prepared by Flatley Read at a cost of $500.00 and as such, the Supervisor is hereby designated as the representative for the grant and is further authorized to sign such documentation and provide such information as may be required for timely completion of the application.

WHEREAS, the Town of Saratoga, as a part of its Comprehensive Plan, encourages the protection and preservation of Historic Places within the Town of Saratoga, and

WHEREAS, the Mineral Springs at Quaker Springs have a long and rich history, dating back to Native Americans and early American settlers of the eighteenth and nineteenth centuries, and

WHEREAS, the Town of Saratoga owns the Mineral Springs at Quaker Springs, and

WHEREAS, the Town of Saratoga has recently invested time and money in the beautification and preservation of the mineral springs, and

WHEREAS, the Town of Saratoga wishes to permanently protect and preserve the historic mineral springs, now therefore be it

RESOLVED, that the Town Board of the Town of Saratoga supports a resolution requesting that the Mineral Springs at Quaker Springs be added to the National Registry of Historic Places.

WHEREAS, the Town Historian has identified a grant opportunity which he’d like to apply for, commemorating Legends and Folklore in New York State.  The grant will fully pay for the fabrication of an historic roadside marker along Quaker Springs Road, informing the public of the Native Americans that drank from the Mineral Springs as well as the Spring's healing powers; and

            WHEREAS, the William G. Pomeroy Foundation Historic Roadside Marker Grant Program pays for the creation of such an iron roadside marker, along with the New York Folklore Society, and

            WHEREAS, the Town and Deputy Town Historian have documented and completed all requests necessary for the grant award, therefore, be it

            RESOLVED, that the Town Board of the Town of Saratoga authorizes the Town Historian to apply for the grant award from the William G. Pomeroy Foundation and to sign any and all documents related to such application.

WHEREAS, the Town of Saratoga, as a part of its Comprehensive Plan, continues to develop its trails and parks for the enjoyment and benefit of town residents, and

            WHEREAS, the Town of Saratoga Comprehensive Plan encourages the development of parks and trails recreational areas within the Town, and

            WHEREAS, the Champlain Canalway Trail Action Plan identifies desired trails within theTown that should be developed, and

            WHEREAS, the Old Saratoga on the Hudson Waterfront Revitalization Plan recommends the construction of a trail connecting the National Historical Park Battlefield Unit with the Old Saratoga Unit in Schuylerville, and

            WHEREAS, the Town of Saratoga has acquired a section approximately 1 mile long of Old Champlain Canal property, just south of the Village of Schuylerville, and desires to develop this property as a hiking trail, and

            WHEREAS, the Town of Saratoga is in need of financial assistance to complete this project, now therefore be it

            RESOLVED, that the Town Board of the Town of Saratoga supports this resolution that the Town of Saratoga apply for a grant from the Historic Hudson Hoosic Partnership in the amount of $5,000 to be used to pay in part for the construction  of this section of hiking trail.

WHEREAS, on an annual basis the Town Board enters into an insurance contract/s to provide health insurance coverage for eligible employees; and

WHEREAS, the Board has reviewed proposals for contracts to commence August 1, 2016; now, therefore be it 

            RESOLVED, that the Town Supervisor is authorized to sign a contract for health insurance benefits for eligible active employees with Capital District Physicians Health Plan for their CDPHP SILVER 320 HDEPO with a high deductible effective August 1, 2016 for a one year term. The high deductible will be reimbursed by the Town through a special account that CDPHP can withdraw deductibles from as needed.  Due to the increase of premium, the Town will pay the first $1500.00 of deductibles for single plans and the first $3,000.00 for Family Plans as currently being done.  In the future, if the deductibles increase beyond the $1,500.00/$3,000.00, then the employee and the Town will each pay 50% of the increased deductible; and be it further

            RESOLVED, that the Town Supervisor is authorized to sign a contract for Health

Insurance Benefits for pre-medicare retirees with Capital District Physicians Health Plan for their CDPHP GOLD EPO 220 PLAN with the Town and employee splitting the $500 deductible 50/50; $250 town, $250 insured for the single plan employee.

Communication:  Supervisor Thomas Wood noted that the $125,000 grant through Assemblywoman Carrie Woerner has been awarded to the Town of Saratoga and the Village of Schuylerville.  The grant will be awarded $75,000 to the Town of Saratoga and $50,000to the Village of Schuylerville.  It will go through the Dormitory Authority, so release of the funds is most likely to take place within 6 months – 1 year.  He stated the Town appreciates Assemblywoman Carrie Woerner for her help and support of this grant.
