ZONING BOARD OF APPEALS DRAFT MINUTES

January 22, 2018

 

 

Chairman William Moreau called the meeting to order at 7:00 p.m. and led the flag salute. 

 

Chairman William Moreau welcomed everyone to the meeting and proceeded to review the Rules of the Board.

 

Zoning Clerk Linda McCabe called the roll: Chairman William Moreau – present, Clifford Hanehan – absent (arrived at 7:08 p.m.), Thomas Carringi – absent (arrived at 7:03 p.m.), Clarence Fosdick – present, Christopher Benn – present, Nicholas Schwartz - absent, Steve Mehan - present, Alternate Member Mark Sullivan - present.

 

Alternate Mark Sullivan was elevated to full voting status due to the absence of a couple of Board members.

 

Also present: Zoning Officer Gil Albert, Michael Phinney, Nicole Numpano and Tamara Rapisarda.  (Sign-in sheet is on file in the Clerk’s office.)

 

Approval of Minutes: A motion was made by Clarence Fosdick, seconded by Christopher Benn, to accept the meeting minutes of November 27, 2017.   Chairman William Moreau – aye, Clifford Hanehan -absent, Thomas Carringi - absent, Clarence Fosdick - aye, Christopher Benn - aye, Nicholas Schwartz - absent, Steve Mehan - aye, Mark Sullivan - aye.

Public Hearings for Area Variance

Location:  1237 Rt. 9P

 

Applicant seeks an 11'8" front setback variance in order to demolish the existing residence and build a new two-story residence. 

 

Mike Phinney, Phinney Design Group, appeared on behalf of the Applicant.  He reviewed the application with the Board stating the Applicant would like to remove the existing house and build a new house with a connecting two car garage and a deck on the lakeside.  He went over the survey map, showed the Board the issues with the land and stated that the LA Group is working with the Applicant to shore up the erosion areas and stated that due to the steepness of the slope they cannot move the house further back.  He said they will be at 18.9% land coverage when completed.  He showed photos of the existing house and driveway, as well as neighboring homes.

 

Chairman William Moreau asked if there were any Board questions; seeing none he asked for the opinion of the Zoning Officer.

 

Zoning Officer/Building Inspector Gil Albert stated he is fine with this, they're improving the property, they have more frontage than most at the lake and it is in accordance with the neighboring properties.

 

Chairman William Moreau asked if there was any input from the Town Attorney. 

 

Clerk Linda McCabe stated that Town Attorney William Reynolds called at 6:34 p.m. and said he was unable to be here due to the icy weather where he lives, but he stated he reviewed the application and was fine with it.

 

After providing Proof of Notice in the Saratogian on January 12, 2018, Chairman William Moreau opened the Public Hearing at 7:11 p.m. asking those wishing to speak, to please stand and state their name and address.   Seeing as no one spoke, Chairman William Moreau closed the Public Hearing at 7:12 p.m.

 

Chairman William Moreau questioned if there was any input from the Saratoga County Planning Board.  Clerk Linda McCabe showed proof of filing with them and stated according to the Saratoga County Planning Board, this falls within the MOU (Memorandum of Understanding) and needs nothing from them.

 

Chairman William Moreau asked if there were any further questions or concerns of the Board; there were none. 

 

A motion was made by Clarence Fosdick, seconded by Thomas Carringi, to approve the application as presented and grant the variance.  Chairman William Moreau – aye, Clifford Hanehan -aye, Thomas Carringi - aye, Clarence Fosdick - aye, Christopher Benn - aye, Nicholas Schwartz - absent, Steve Mehan - aye, Mark Sullivan - aye.
