PLANNING BOARD DRAFT MINUTES*

February 24, 2021

 

Chairman Ian Murray called the meeting to order at 7:36 p.m.

 

Planning Clerk Linda McCabe called the roll: Chairman Ian Murray – present, Laurie

Griffen – present, Patrick Hanehan – present, Robert McConnell – absent,

Joseph Lewandowski – absent, George Olsen - present, Christopher Koval - present, Alternate Walter Borisenok - present.

 

Due to the absence of Board Members Robert McConnell and Joseph Lewandowski, Alternate Walter Borisenok was elevated to full voting status.

 

Also attending: James Vianna, Colin Stallard, Rebekah Anderson, Terri Korb. (Sign-in sheet is on file in the Clerk's office)

 

A motion was made by Laurie Griffen, seconded by Christopher Koval, to accept the meeting minutes of November 18, 2020 as written.  Chairman Ian Murray – aye, Laurie Griffen – aye, Patrick Hanehan – aye, Robert McConnell – absent, Joseph Lewandowski – absent, George Olsen - aye, Christopher Koval - aye, Alternate Walter Borisenok - aye.

Special Use Permit Pre-Submission Conference

Applicant seeks a special use permit for a storage unit facility, to be located at 5 Louden Rd.

 

Applicant Colin Stallard appeared before the Board seeking a special use permit to open a storage unit facility on Louden Rd. 

 

Chairman Ian Murray stated the Applicant’s property is in the Rural Residential District and that is not a permitted use in that district.  He then reviewed the allowable uses in the Town’s Rural Residential and Rural Districts with the Applicant and explained since that use is not allowable in that district, you then look at allowable uses in the Rural District.  In the Rural District the only storage facility business allowed is boat, RV and motor vehicle storage, and everything must be stored within a structure. 

 

Applicant Colin Stallard questioned about going to the Town Board for a P.U.D (Planned Unit Development).  He said he’s gone through the Comprehensive Plan and it says they’re looking to increase business, so this should be allowed.

 

Chairman Ian Murray responded the property doesn’t meet P.U.D criteria; if the Applicant

 

 

 

could get more land, add half an acre, maybe it could work, but first he’d have to go before the Town Board.  Chairman Ian Murray also added the Town is working on updating the Comprehensive Plan and the Applicant must realize the Comprehensive Plan is a guide, not law and it could be a while for the updates to be complete. 

 

Applicant Colin Stallard questioned if he can do a P.U.D if he’s able to obtain the additional land.

 

Chairman Ian Murray reiterated the Applicant would first have to go to the Town Board for approval of a P.U.D.  If the Town Board gives approval for a planned unit development, the Applicant would then come back to the Planning Board to go through the planning process and then back to the Town Board. 

 

Applicant Colin Stallard stated there are storage units in the Town, there’s one behind the car wash.

 

Chairman Ian Murray responded there are no storage units in the Town, the one behind the car wash is in the Village of Schuylerville, not out in the Town.  There are allowable uses in our regulations for each district, but if something isn’t there, it’s not allowed.  He also explained that the Village of Schuylerville and Village of Victory have their own regulations.

 

After further discussion, Applicant Colin Stallard stated he’ll check back in future to see if regulations change to allow storage units.

Sketch Plan Conference for Minor Subdivision

Applicant seeks a two-lot subdivision of his 107.88+/- acre parcel on the west side of Hanehan Rd.  Lot 4 to become a 10+/- acre parcel for residential use and horse farm, with the remaining lands, Lot 3, staying in agricultural pursuits.

 

Jim Vianna, PLS, appeared before the Board on behalf of the Applicant.  He reviewed the proposed subdivision, explaining this is the old Taras property that was subdivided two years ago and this will be the third split, although this will be tagged as Lot 4.  This is for a single family residence and horse farm.  It meets zoning regulations and he’s hoping to have the deep hole test pit completed for next month, but that’s weather dependent, so maybe April.

He added the previous family had a lot of sand and salt brought in for a septic system for a house that never was built, so he’s all set for that.

 

Chairman Ian Murray questioned if there was interest in the wetlands right there and was told no.

 

Chairman Ian Murray asked if there were any questions from the Board; seeing none, he told

 

 

 

Jim Vianna, PLS, that once the engineering work is complete to come back to the Board and they’ll go forward.

Old Business - None

 

New Business – Saratoga County Planning will not be holding their training conference this year.  He added that Clerk Linda McCabe sent all members the list of organizations that will be holding on-line training classes for those in need of training, although as all members have taken more than required classes over the past several years, each member has enough required hours to get them through this year.

 

A motion was made by Patrick Hanehan, seconded by Laurie Griffen, to adjourn the meeting at 7:57 p.m.  Chairman Ian Murray – aye, Laurie Griffen – aye, Patrick Hanehan – aye, Robert McConnell – absent, Joseph Lewandowski – absent, George Olsen - aye, Christopher Koval - aye, Alternate Walter Borisenok - aye.
