TOWN BOARD MEETING OF THE TOWN OF SARATOGA

Supervisor Thomas Wood opened the meeting with the Pledge of Allegiance at 7:01 p.m.

 

Roll call: Town Clerk Linda McCabe, called the roll.  Supervisor Thomas Wood – present, Councilman Charles Hanehan - present, Councilman Michael McLoughlin – present, Councilman James Jennings – present, Councilman Gary Squires – present.

 

Also present: Deputy Clerk Michelle Conover, Town Attorney William Reynolds, Highway Superintendent Don Ormsby, Stephen and Joann Bodnar,  Marie Traver and Tim Lagoe.

 

Recognitions/Presentations/ Bid openings/ Public Hearings:  

Supervisor Thomas Wood presented Marie Traver, wife of Arthur L. Traver, with a Certificate of Recognition, honoring her husband, the late World War II Veteran, Arthur L. Traver.

 

On a motion made by Supervisor Thomas Wood and seconded by Councilman Charles Hanehan, the following Resolution #16-108, Recognition of Deceased World War II Veteran - Arthur Lucian Traver, was adopted by vote: Supervisor Thomas Wood –aye, Councilman Michael McLoughlin – aye, Councilman Charles Hanehan –aye, Councilman James Jennings – aye, Councilman Gary Squires –aye.  Carried 5-0

WHEREAS, Arthur Lucian Traver was the son born to Humphrey H. and Mary E. (Morehouse) Traver on July 2, 1918 in Saratoga Springs, NY; and

WHEREAS, he was raised and worked on his family's farm on Burke Road in the Town of Saratoga; he attended local country school and graduated from Schuylerville High School in 1936; and

WHEREAS, he worked on his family’s dairy farm as a farm hand for 6 years before entering service; and

WHEREAS, he entered in the Army in Albany, NY on October 5 1942; and 

WHEREAS, following Basic Training he was assigned to the newly formed Airborne Glider Unit and served in the 320th Glider Field Artillery Battalion of the 82nd Army Airborne Division where he drove truck, transporting equipment, supplies and personnel; and

WHEREAS, he served in campaigns in Sicily and Naples-Foggia in 1943, and in June 1944 Arthur, along with the rest of the 82nd Airborne, flew into Normandy, during Operation Overlord in advance of the D-Day Invasion, and he also participated in Operation Market Garden, the Battle of the Bulge, Central Europe Campaign, and the fall and occupation of Germany, and

WHEREAS, after serving 2 years 11 months and 16 days he was honorably discharged on September 20th, 1945 from Fort Dix, New Jersey; and

WHEREAS, he received The World War II Victory Medal, The Distinguished Unit Badge,  European–African-Middle Eastern Service Medal with a Bronze Star Service Arrowhead, and the Good Conduct Medal; and

 

 

 

WHEREAS, following his discharge from the Army, with his wife Marie, owned and operated Art's Service Station and General Store in Quaker Springs for more than 50 years.  He also drove school bus for the Schuylerville Central School District for 25 years, and joined the Quaker Springs Fire Department in 1949, of which he became a lifetime member in 2006, holding many offices including Captain and Chief; and

WHEREAS, he was a member of the Quaker Springs Methodist Church, Old Saratoga Post 278 of the American Legion in Schuylerville, and the Veterans of Foreign Wars Post 420, in Saratoga Springs; and

WHEREAS, he was married to Marie E. Hutchinson on April 17, 1949  and was a loyal and dedicated servant to his family, community and country, always giving and serving everyone in any capacity that he could; and

WHEREAS, he died at the age of 94 on January 13th, 2013 at the Wesley Health Care Facility in Saratoga Springs; now, therefore be it

RESOLVED, that the Town of Saratoga extends our belated condolences to all the family and friends of the Traver Family and; and be it further

RESOLVED, that the Town Board of the Town of Saratoga does hereby recognize and honor, to the highest degree possible, Arthur Lucian Traver for his patriotism, devotion, service and sacrifice for his country; and be it further

RESOLVED, that the Town of Saratoga will never let his name and the sacrifices that he made for his country be forgotten and that he will always be held in the highest esteem and remembered as a member of the greatest generation and one of the Town of Saratoga’s best.

 

Supervisor Thomas Wood stated that tonight’s Public Hearing is for some amendments to the Town’s Zoning Regulations – definitions for patio and deck, as well as percentage of lot coverage. 

 

Public Hearing on Local Law #7of 2016- Zoning Regulations Amendments - Proof of notice in the Saratogian on July 28, 2016 having been provided, Supervisor Thomas Wood opened the Public Hearing at 7:16 p.m. for Local Law #7, asking those wishing to speak to please state their name and address for the record.  Seeing as no one spoke, Supervisor Thomas Wood closed the Public Hearing at 7:17 p.m.

 

Approval of Minutes: A motion was made by Councilman James Jennings and seconded by Councilman Gary Squires to accept the minutes of the July 11, 2016 regular meeting as written.   Supervisor Thomas Wood – aye, Councilman Charles Hanehan – aye, Councilman Michael McLoughlin – present, Councilman James Jennings – aye, Councilman Gary Squires – aye.  Carried  5 - 0

 

Town Clerk’s report for July 2016: Fees paid to the NYS Dept. of Agriculture and Markets for the Animal Population Control Program $80.00.  Fees paid to New York State D.E.C. for hunting and fishing licenses $198.40.   Fees paid to the New York State Health Department for Marriage licenses $45.00.  Dog license fees to Supervisor Thomas Wood $350.00. Clerk fees to Supervisor Thomas Wood $183.35.  Total State and Local Revenues received were $856.75.

 

Zoning Officer’s report for July 2016: 13Building Permits, 15 Building Inspections, 4 Certificates of Occupancy, 0 Junk Yard Permits, 0 Orders to Remedy, 0 Fire inspections, 1 Complaint, 0 Building Permit Renewal/s, 0 Property Maintenance Inspections, and 4 miscellaneous appointments.  A check for $1,970.00 was given to Supervisor Thomas Wood. 

 

Dog Control Officer’s report for July 2016: The report was read by Supervisor Thomas Wood:  the Dog Control Officer answered 23 complaints, took 3 dogs to the shelter, 2 bite cases, traveled 145 miles, issued 15 warnings and 7 summons were issued and one bite case. 

 

Town Court report for July 2016: The following were closed: 35 Vehicle & Traffic, 5 Criminal/Penal Law, 3 DEC/ENCON, 3 Dog cases,  0 DWI’s, 0 Town & Village Ordinance, 0 Small Claims/Civil, 0 Evictions, 1 Hearings, 2 (case transfer) Divestiture Forms sent to County Court, 1 Defendant/s sentenced to probation, 0 hours of community service issued, 0 days of jail time issued, 0 Orders of Protection issued, and $5,530.00  in fees were paid to the NY State Comptroller.

 

Historian’s report:  July 2016:  

In July the Historian had 20 posts on his website with 407 visitors, with one inquire for research.  He published a short history of deceased veteran Arthur Traver, which is on the website.  He spent 5 days at the NYS Historical Association Library in Cooperstown, researching mineral springs and Quakers in Saratoga.  He also visited the Memorial Library in Deerfield MA and Historic Deerfield, researching the early Governors and people who fought in the Battles of Saratoga.

 

The Old Saratoga Historical Association will be hosting their annual 18th Century Day at the Schuyler House on Sunday, August 14th. The National Park has opened the Monument and Schuyler House on Fridays, Saturdays and Sundays through Labor Day.

 

Assessor’s report for July 2016:

During the month of July the Assessor processed 13 sales transfers; 4 transfers were valid sales and 9 were non-valid.   The sales represented (9) residential properties and 4 vacant land parcels.

 

The Assessor has 1 small claims hearing, which is for property located on Trask Lane. 

 

The Town has received the 100% equalization rate for the 2016 assessment roll.

  

The Assessor’s Office is open Tuesday and Wednesday 9:00 AM – 1:00 PM.

Insurance:  Supervisor Thomas Wood stated that he met with Dave Meager, Adirondack Trust Insurance Consultant, and reviewed the proposed Town’s Property and Liability Insurance Policy.  Dave Meager recommended  increasing the deductible from $1,000 to $2,500 and adding on a Cyber Rider Policy.  These changes will result in a slight reduction of the proposed premium.

Parks/Schuyler Park Committee:  The Schuyler Park Committee received one bid last month and are awaiting two others that will be coming in shortly for the construction of the second pavilion.   

 

Office of Emergency Management:  none

 

GSES, QSFD, SLPID/SLA Reports: Quaker Springs Fire Department has responded to 56 calls to date this year.

New Business:

On a motion made by Councilman Michael McLoughlin and seconded by Councilman Gary Squires, the following Resolution #16-106 – Authorization for the Town Board to pursue Grant Funding to develop a Municipal Farmland Protection Plan, was adopted by vote: Supervisor Thomas Wood – aye, Councilman Michael McLoughlin – aye, Councilman Charles Hanehan – absent, Councilman James Jennings – aye, Councilman Gary Squires – aye. 

Carried 4 – 0.

WHEREAS, the New York State Department of Agriculture and Markets encourages local municipalities to apply for available funding to develop municipal farmland protection plans to foster and promote agriculture through sound planning practices, and

            WHEREAS, it is in the best interest of the municipalities who wish to protect farmland, to develop a Municipal Farmland Protection Plan and have it become a part of their local comprehensive plans, and

            WHEREAS, the New York State Department of Agriculture and Markets invites municipalities to submit applications for financial assistance in the development of municipal agricultural farmland protection plans, and

            WHEREAS, the Town of Saratoga has a significant agricultural land base, a diverse agricultural community with strong family farms that have helped to preserve and protect residents’ quality of life as well as natural resources, and

            WHEREAS, the Town of Saratoga has been successful in securing farmland protection grants to purchase development rights through the New York State Farmland Protection Implementation Grant Program (FPIG) through the New York State Department of Agriculture and Markets grant funding, now, therefore, be it

            RESOLVED, that the Town Supervisor is hereby authorized to contact local planning consultants with expertise in farmland protection plans to provide cost proposals to the Town for completion of the aforementioned RFA for the development of an agricultural and farmland protection plan with financial assistance from the New York State Department of Agriculture and Markets.

 

On a motion made by Councilman James Jennings and seconded by Councilman Michael McLoughlin, the following Resolution #16-107 – Authorization for a Municipal Agricultural Farmland Protection Plan was adopted by vote: Supervisor Thomas Wood – aye, Councilman Michael McLoughlin – aye, Councilman Charles Hanehan – absent, Councilman James Jennings – aye, Councilman Gary Squires – aye.

            WHEREAS, the New York State Department of Agriculture and Markets invites applications for financial assistance in the development of municipal agricultural farmland protection plans, and which applications need to conform to the format and content specified in a department created Request for Applications (RFA), and

            WHEREAS, it is in the best interest of the municipalities having an interest in processing an RFA to hire a consultant to develop such farmland protection plan, and

            WHEREAS, the Town has worked with The LA Group located in Saratoga Springs, New York, who has the necessary expertise and experience to prepare and file an RFA on behalf of the Town of Saratoga, and

            WHEREAS, The LA Group is willing to complete the RFA in order  to determine the possible funding for the Town of Saratoga to be used to develop an agricultural and farmland protection plan for said Town of Saratoga, which services will be at no cost to the Town of Saratoga, but with the understanding that should the Town of Saratoga receive a grant from the New York State Department of Agriculture and Markets, the Town Board will retain the services of The LA Group to complete the plan on behalf of the Town of Saratoga and paid from the funds received through this grant program.

            NOW, THEREFORE, BE IT RESOLVED, that the Town Supervisor is hereby authorized to contact The LA Group and advise the company that they are authorized to complete the aforementioned RFA, on behalf of the Town and at no cost to the Town, and in order to determine if the Town is eligible and will receive funding from the New York State Department of Agriculture and Markets for the development of an agricultural and farmland protection plan, and

            BE IT FURTHER RESOLVED, that should the Town of Saratoga receive such funding from the New York Department of Agricultural and Markets, The LA Group are appointed to complete the plan and will be paid with the funds received through the referenced municipal grant, and

            BE IT FURTHER RESOLVED, that the Town Supervisor is authorized to sign any grant application (RFA) that may be prepared by The LA Group pursuant to this resolution.

 

            On a motion made by Councilman  James Jennings and seconded by Councilman Gary Squires, the following Resolution #16-109– Designating a “Lead Agency” for the purpose of Conducting an Environmental Review of a Proposed Action,  Local Law #7 of 2016 - Zoning Amendments - Certain Definitions and Uses in the Zoning Districts, was adopted by vote: Supervisor Thomas Wood – aye, Councilman Michael McLoughlin – aye, Councilman Charles Hanehan – absent, Councilman James Jennings – aye, Councilman Gary Squires – aye.  Carried 4 – 0

            WHEREAS, the Town Board of the Town of Saratoga has determined that a Zoning Amendment is needed, and

            WHEREAS, this is an Action subject to the provisions of the New York State Environmental Quality Review Act (SEQR) and the regulations promulgated to implement said Environmental Quality Review Act, and

            WHEREAS, the provisions of SEQR require the designation of a “Lead Agency” to determine the environmental significance of the Action, and

            WHEREAS, this agency has complied with the provisions of SEQR pertaining to “Lead Agency” designation, now, therefore, be it

            RESOLVED, that the Town Board of the Town of Saratoga is hereby designated the “Lead Agency” for the purpose of conducting the SEQR review of the referenced Action. 

 

                         On a motion made by Councilman James Jennings and seconded by Councilman Gary Squires,             the following Resolution #16-110 – NEGATIVE DECLARATION: Determining that action to enact an amendment to the Zoning Ordinance of the Town of Saratoga will not have a significant effect on the environment – Local Law #7 of 2016 - Zoning Amendments – Amendments and Certain Definitions in the Zoning Districts, was adopted by vote: Supervisor Thomas Wood – aye, Councilman Michael McLoughlin – aye, Councilman Charles Hanehan – absent, Councilman James Jennings – aye, Councilman Gary Squires – aye.

WHEREAS, the Town Board of the Town of Saratoga, Saratoga County, New York (the "Town") is considering enacting a certain amendment to the Zoning Ordinance of the Town of Saratoga (the “Action”); and

               WHEREAS, pursuant to Article 8 of the Environmental Conservation Law, Chapter 43-b of the Consolidated Laws of New York, as amended (the "SEQR Act") and the regulations adopted pursuant thereto by the Department of Environmental Conservation of the State of New York ("DEC"), being 6 NYCRR Part 617, as amended (the "Regulations"), the Town Board as lead agency desires to determine whether this Action may have a significant effect on the environment and therefore require the preparation of an environmental impact statement; and

               WHEREAS, there has been prepared a full environmental assessment form for the Project (the "EAF"), a copy of which was previously reviewed by the Town Board and a copy of which is on file in the office of the Town Clerk; and

               WHEREAS, pursuant to the Regulations, the Town has examined the EAF in order to make a determination as to the potential environmental significance of Action; and

               WHEREAS, the Action appears to constitute a "Type I Action" (as defined by the Regulations);

               NOW, THEREFORE, BE IT RESOLVED BY THE TOWN BOARD OF THE TOWN OF SARATOGA, SARATOGA COUNTY, NEW YORK AS FOLLOWS:

 

               1.    Based on an examination of the EAF and based further upon the Town's knowledge of the area and such further investigation of the proposed zoning amendment and its environmental effects as the Town has deemed appropriate, the Town makes the following findings:

 

(a)   The zoning amendment is described in the EAF;

 

(b)    The Action constitutes a "Type 1 Action" (as defined in the Regulations);

 

(c)   No potentially significant effect on the environment is noted in the EAF for this Action, and none are known to the Town;

 

(d)   This Action will not have a significant effect on the environment; and the Town will not require the preparation of an environmental impact statement with respect to the Action; and

 

(e)  As a result of the foregoing, the Town has prepared a negative declaration with respect to the Action.

 

                2.    The Town Clerk is hereby directed to file a Negative Declaration with respect to the Action (said negative declaration attached hereto); and a copy of the negative declaration shall be maintained in the office of the Town Clerk in a file that will be readily accessible to the public.

 

3.            This resolution shall take effect immediately.

 

 

On a motion made by Councilman Gary Squires and seconded by Councilman Michael McLoughlin, the following Resolution #16-111 – Local Law #7- Adoption of Local Law #7 of 2016 - Zoning Amendments to Certain Definitions and Uses in the Zoning Districts, was adopted by vote: Supervisor Thomas Wood – aye, Councilman Michael McLoughlin – aye, Councilman Charles Hanehan – absent, Councilman James Jennings – aye, Councilman Gary Squires – aye.  Carried 4 – 0

WHEREAS, the Town Board has recognized the need to amend the Zoning Ordinance pertaining to certain definitions and uses in the zoning districts; and

WHEREAS, the Town Board of the Town of Saratoga has held a public hearing and received input from the townspeople; now therefore be it

RESOLVED, by the Town Board of the Town of Saratoga to adopt Local Law #7 of 2016 – Zoning Amendments to certain definitions and uses in the zoning districts;

            Town of                                  Saratoga                                                     as follows:  

 

The Zoning Ordinance of the Town of Saratoga is hereby amended in the following respects:

 

Section 1 – Appendix A – Definitions 

 

“LOT COVERAGE” is amended to read as follows:

 

LOT COVERAGE – The percentage of the lot area that is occupied by the ground area of any buildings, accessory buildings, porches, or decks. Patios, as defined in this chapter, shall not be included in lot coverage.

 

Section 2 – Appendix A – Definitions

 

The following definitions are hereby added:

 

DECK – An exterior floor, having no roof, supported on at least two opposing sides by an adjacent structure and/or posts, piers, or other independent supports.

 

PATIO – A flat area of ground that is covered with a hard material such as brick, stone or concrete, used for outdoor sitting and living.

 

Section 3 – Effective Date

 

This local law shall take effect immediately.

 

On a motion made by Councilman James Jennings and seconded by Councilman Michael McLoughlin, the following Resolution #16-112 - Zoning Board of Appeals Appointment – Steve Mehan, was adopted by vote: Supervisor Thomas Wood – aye, Councilman Michael McLoughlin – aye, Councilman Charles Hanehan – absent, Councilman James Jennings – aye, Councilman Gary Squires – aye. 

Carried 4 – 0

WHEREAS, there is a vacancy for an Alternate Member of the Zoning Board of Appeals, therefore be it

            RESOLVED, that the Town Board of the Town of Saratoga appoints Steven Mehan as Alternate Member of the Zoning Board of Appeals, fulfilling the five year term of the previous Alternate Member, Christopher Benn, from 01/01/2014 – 12/31/2019.

 

On a motion made by Councilman James Jennings and seconded by Councilman Michael McLoughlin, the following Resolution #16-113 - Accept Contract Proposal – Adirondack Trust Insurance with New York Municipal Insurance Reciprocal (NYMIR), was adopted by vote: Supervisor Thomas Wood – aye, Councilman Michael McLoughlin – aye, Councilman Charles Hanehan – absent, Councilman James Jennings – aye, Councilman Gary Squires – aye.  Carried 4 – 0

WHEREAS, the Adirondack Trust Insurance Agency has been the insurance agent for the Town’s property-casualty insurance for the past 28 years; and

WHEREAS, said agency has offered superior service and advice to the Town and has marketed the insurance again this year for the Town’s benefit; and

WHEREAS, this year, the agent has sought proposals from our incumbent insurer, Houston Casualty Company, as well as NYMIR; and

WHEREAS, the analysis of the proposals by said agency has shown that NYMIR has offered the lowest premium with improved coverage, now therefore

BE IT RESOLVED, that the Town of Saratoga hereby accepts the agency’s property-casualty proposal through NYMIR (Crime with Travelers) for the upcoming year, 8/13/2016-8/13/2017, up to $40,478.61; and

BE IT RESOLVED, that the Town of Saratoga expresses its intention to make this award to the agency and NYMIR for a five year period as long as premiums remain stable; and

BE IT RESOLVED that the Town of Saratoga reserves the right to rescind this multi-year award at any time it is deemed appropriate for the Town to do so, therefore

BE IT FURTHER RESOLVED, that the Supervisor is authorized to sign the Subscriber’s Agreement with NYMIR after review and approval by the Town Attorney.

 

On a motion made by Councilman James Jennings and seconded by Councilman Gary Squires, the following Resolution #16-114 – Authorization for the Development of a Cyber Security Policy, was adopted by vote: Supervisor Thomas Wood – aye, Councilman Michael McLoughlin – aye, Councilman Charles Hanehan – absent, Councilman James Jennings – aye, Councilman Gary Squires – aye.  Carried 4 – 0

            WHEREAS, the Town Board of the Town of Saratoga is required to develop a Cyber  Security Policy for the protection of computers, networks, programs and data from unauthorized access, it is hereby

            RESOLVED, that the Town Board of the Town of Saratoga develop and adopt the attached Cyber Security Policy.

 

On a motion made by Councilman Gary Squires and seconded by Councilman Michael

McLoughlin, the following Resolution #16-115 – Accept Audit Findings, was adopted by vote: Supervisor Thomas Wood – aye, Councilman Michael McLoughlin – aye, Councilman Charles Hanehan – absent, Councilman James Jennings – aye, Councilman Gary Squires – aye.

WHEREAS, the Town Board of the Town of Saratoga had the Town’s 2015 Financial Operations and Procedures audited by SaxBST LLC; and

            WHEREAS, the Town Board of the Town of Saratoga has reviewed the findings with no exceptions noted in any department, therefore be it,

RESOLVED, by the Town Board of the Town of Saratoga to accept the findings as presented (the audit is on file in the Town Clerk’s office).   

 

On a motion made by Councilman Michael McLoughlin and seconded by Councilman Gary Squires, the following Resolution #16-116 – Transfer of Funds- $400.00 from Tax Collector - A1330.1, to Tax Collector – A1330.4, was adopted by vote: Supervisor Thomas Wood – aye, Councilman Michael McLoughlin – aye, Councilman Charles Hanehan – absent, Councilman James Jennings – aye, Councilman Gary Squires – aye.

            RESOLVED, by the Town Board, of the Town of Saratoga, to transfer $400.00 from Tax Collection – A1330.1 to Tax Collection – A1330.4 for the purchase of stamps.

 

On a motion made by Councilman James Jennings and seconded by Councilman Gary Squires, the following Resolution #16-117 – Authorization to Enter into a Contract with James Vianna, PLS, to survey the Northern portion of the Old Champlain Canal, was adopted by vote: Supervisor Thomas Wood – aye, Councilman Michael McLoughlin – aye, Councilman Charles Hanehan – absent, Councilman James Jennings – aye, Councilman Gary Squires – aye.  Carried 4 – 0

RESOLVED, by the Town Board of the Town of Saratoga, to enter into a contract with James Vianna, PLS, to survey the northern portion of the Old Champlain Canal Towpath across from the Germain property along US RT. 4 for a sum of $3000.00.

 

On a motion made by Councilman Michael McLoughlin and seconded by Councilman Gary Squires, the following Resolution #16-118-Transfer of Funds-$15,401.00 from Highway Equipment Reserve Fund, to Highway Equipment-DB5132.2, for the purchase of a 2016 Case 721F Z-Bar Wheel Loader, was adopted by vote: Supervisor Thomas Wood - aye, Councilman Michael McLoughlin - aye, Councilman Charles Hanehan - absent, Councilman James Jennings - aye, Councilman Gary Squires - aye.

RESOLVED, by the Town Board of the Town of Saratoga, to transfer $15,401.00 from Highway Equipment Reserve Fund, to Highway Equipment – DB5132.2, for the purchase of the 2016 Case 721F Z-Bar Wheel Loader, from Monroe Tractor.

the following Resolution #16-119 – Supporting the Town of Malta in Saving Nelson Avenue Extension Bridge, was adopted by vote: Supervisor Thomas Wood – aye, Councilman Michael McLoughlin – aye, Councilman Charles Hanehan – absent, Councilman James Jennings – aye, Councilman Gary Squires – aye.

WHEREAS, the Town Board of the Town of Saratoga has been advised that the existing bridge crossing of Nelson Avenue Extension over the Adirondack Northway is slated to be closed, and

            WHEREAS, immediately upon this plan becoming known by the public, Malta Town Government has been inundated with calls, correspondence and visitors all expressing their dismay and distress at this plan, and seeking the help of the Town in registering their opposition to such closure; now, therefore it is

            RESOLVED, by the Town Board of the Town of Saratoga, on behalf of the residents of the Town who will be negatively affected by the closure of the Nelson Avenue Extension over the Adirondack Northway, and on behalf of those who are not residents of the Town, but have expressed their distress to us, requests that the New York State Department of Transportation reconsider the planned closure of the bridge, keeping in mind that it constitutes a vital link for daily access to our employment and a link to the services of the Saratoga Hospital and other health-care providers.  Further, the Town Board of the Town of Saratoga echoes the point raised in a petition being circulated among those affected by the planned closure that, due to the expense of bridge construction, once this bridge has been removed, it will not be replaced.  The cost of refurbishment and repair is within reach, whereas the cost of replacement is not.

 

On a motion made by Councilman Michael McLoughlin and seconded by Councilman Gary Squires, the following Resolution #16-120 – Demolition of Unsafe Building, was adopted by vote: Supervisor Thomas Wood – aye, Councilman Michael McLoughlin – aye, Councilman Charles Hanehan – absent, Councilman James Jennings – aye, Councilman Gary Squires – aye.  Carried 4 – 0

WHEREAS, it is reported to the Town Board of the Town of Saratoga that there may exist an “unsafe building” as defined in Section 182-2(B) of the Town Code, located at 131 Lafayette Street in the Town of Saratoga, it is now, therefore

RESOLVED, that the Town Engineer Ken Martin, is directed to inspect said building and report as to whether it is dangerous to the life, health or property of the public because it is so damaged and structurally unsafe, and it is further

RESOLVED, that if said report determines this is an “unsafe building”, as defined, the Attorney for the Town is authorized to prepare and cause service of a notice to the owner of said property, to wit: John Casey, prepared in accordance with Section 182-3(A) of the Town Code, directing that the building be made safe and secure, or if necessary, be demolished and removed, and that any occupants of the building immediately vacate the same, and that all rubbish and debris be removed from the exterior of the property, and it is

RESOLVED, that a hearing be held before the Town Board on September 8, 2016 at 7:00 p.m., at the Saratoga Town Hall, 12 Spring Street, Schuylerville, NY, at which hearing the said owner may present proof in opposition to the claim that the building is unsafe and dangerous, and it is further

RESOLVED, that the Town Attorney file a copy of the aforesaid notice in the Office of the Saratoga County Clerk, as provided by law.

 

On a motion made by Councilman James Jennings and seconded by Councilman Gary Squires, the following Resolution #16-121 – Transfer of Funds from Highway Garage Equipment - A5132.2 to Highway Traffic Control – A3310.4, was adopted by vote: Supervisor Thomas Wood – aye, Councilman Michael McLoughlin – aye, Councilman Charles Hanehan – absent, Councilman James Jennings – aye, Councilman Gary Squires – aye.

WHEREAS, expenditures for the Highway Traffic Control Account # A3310.4

have exceeded the budgeted amounts; therefore be it

RESOLVED, by the Town Board of the Town of Saratoga, to transfer $128.69 from Highway Garage Equipment Account #A5132.2 to Highway Traffic Control Account # A3310.4.   

 

On a motion made by Councilman Michael McLoughlin and seconded by Councilman Gary Squires, the following Resolution #16-122 – Zoning Violation was adopted by vote: Supervisor Thomas Wood – aye, Councilman Michael McLoughlin – aye, Councilman Charles Hanehan – absent, Councilman James Jennings – aye, Councilman Gary Squires – aye.

WHEREAS, the Town Board of the Town of Saratoga has been made aware of a violation of the Zoning Laws of the Town by Harold Hulett at 87 Rodgers Lane, in regards to the parking of commercial vehicles and equipment; and

            WHEREAS, the Zoning Officer has issued an Order to Remedy this violation, it is now, therefore

RESOLVED, by the Town Board of the Town of Saratoga that if the Order to Remedy is not complied with, legal action by the Attorney for the Town is hereby authorized to enforce the Town laws.
