ZONING BOARD OF APPEALS DRAFT MINUTES
April 23, 2018
Due to the absence of Chairman William Moreau, Clifford Hanehan, Standing Chairman, called the meeting to order at 7:00 p.m. and led the flag salute.
Clifford Hanehan welcomed everyone to the meeting and proceeded to review the Rules of the Board.
Zoning Clerk Linda McCabe called the roll: Chairman William Moreau – absent, Clifford Hanehan – present, Thomas Carringi – present, Clarence Fosdick – present, Christopher Benn – present, Nicholas Schwartz - present, Steve Mehan - present, Alternate Member Mark Sullivan - present.
Due to the absence of Chairman William Moreau, Alternate Member Mark Sullivan was elevated to full voting status.
Also present: Zoning Officer Gil Albert, Michael Stewart and Terri Korb. (Sign-in sheet is on file in the Clerk’s office.)
Approval of Minutes: A motion was made by Christopher Benn, seconded by Clarence Fosdick, to accept the meeting minutes of March 26, 2018. Chairman William Moreau – absent, Clifford Hanehan - aye, Thomas Carringi - aye, Clarence Fosdick - aye, Christopher Benn - aye, Nicholas Schwartz - aye, Steve Mehan - aye, Mark Sullivan - aye.

Returning Applicant - Continued Public Hearing

Returning Applicant seeks a 22.75' front setback variance (2' less than last month) and a 3' two-sides setback variance in order to build a new house.
Returning applicant Michael Stewart appeared before the Board and reviewed the amended variances he seeks in order to build his new house. Last month the Board had requested the Applicant to do a cost analysis of redesigning the house and/or digging a new well. The Applicant stated he could not redesign the house due to the existing septic. He spoke with Hawk Drilling Company and as costs vary depending upon the depth, pump, etcetera, he was given an estimate up to $13,000.00, which creates a hardship for him; report was submitted. He wants to keep the well where it is due to water issues in the back and he's trying to position the house in the best location he can.
Zoning Officer Gil Albert questioned the size of the deck and screened porch and told the Applicant if he puts steps going across the entire deck, they have to be included in the percentage of coverage.
The Applicant replied the deck will be 9' with only steps; no staircase going across the whole deck.
Nick Schwartz questioned the scale on the site plan and was told it is ¹/16. A lengthy discussion ensued between the Board and the Applicant, clearing up some confusion with the measurements on the drawings.
Zoning Officer Gil Albert stated he will be receiving a full survey prior to any footings going in and cautioned the Applicant to be sure of placement as he will issue a stop work if they go beyond what the Board may grant this evening.
The Applicant stated he understood.
Clifford Hanehan asked if there were any further Board questions; there were none.
Clifford Hanehan asked for the opinion of Zoning Officer Gil Albert.
Zoning Officer Gil Albert responded he believes the Applicant is trying to make it work and this is better than the original proposal.
Clifford Hanehan asked Attorney William Reynolds for his opinion; he had no opinion at that time.
As the public hearing for this application was opened and tabled at last month's meeting, Clifford Hanehan re-opened the Public Hearing at 7:25 p.m. asking those wishing to speak to please stand, state their name and address to the Clerk:
Terri Korb, Hill Rd., stated she is not opposed although she has concerns if NYS DOT widens Rt. 9P.
Seeing as no one further wished to speak, Clifford Hanehan closed the Public Hearing at 7:27 p.m.
Clifford Hanehan thanked the Applicant for answering all the Board's questions. He then went through the Balancing Act, line by line, with the Board. The Board found in favor of the Applicant.
A motion was made by Clarence Fosdick, seconded by Mark Sullivan, to approve the variances as amended, reflecting the two-side setback as 24'.72" and the front setback as 17'.3". Chairman William Moreau – absent, Clifford Hanehan - aye, Thomas Carringi - aye, Clarence Fosdick - aye, Christopher Benn - aye, Nicholas Schwartz - aye, Steve Mehan - aye, Mark Sullivan - aye.
