The Schuylerville Victory
Board of Water Management held a meeting on September 9, 2008 at 7pm in the
Village of Victory.
Chairman
Colvin led the meeting.
Present: Chairman Colvin, Commissioners Kahnle,
Lloyd, and Pink.

Executive Session:
To start the regular meeting Commissioner Lloyd made a motion to go into executive session to discuss liquidated damages for contractor #1 for the Victory Plant Rehab., due to the deadline not being met, it was seconded by Commissioner Pink, all ayes, motion passed.
Commissioner Kahnle
made a motion to come out of executive session as liquidated damages were
discussed, it was seconded by Commissioner Pink, all ayes, motion passed.
Announcements:
The second meeting for
September will be Tuesday, September 23rd in Schuylerville, 7pm.
There was some discussion on
the meetings for October. Due to
conflicts there will only be one meeting for October and it will be Tuesday
night, October 21, 2008, 7pm in Victory and this meeting will have public
comment.
Minutes:
July 22, 2008, August 12,
2008 and August 26, 2008 were provided for approval.
Commissioner Lloyd made a motion to approval 7/22,
8/12, and 8/26/2008 meeting minutes and they were seconded by Commissioner
Pink, all ayes, motion passed.
Treasurer’s Report:
There was a resolution #2008.2009-8 presented to
transfer $45,000 to apply to the outstanding vouchers, payroll and for those
miscellaneous expenses this month and prior to the next meeting for the water
department. This is to authorize the
transfer from the water savings account to the water checking account. Commissioner
Lloyd made a motion to approve and sign this resolution #2008.2009-8 to
transfer $45,000 from Savings to Checking, and it was seconded by Commissioner
Kahnle, all ayes, motion passed.
There was a resolution #2008.2009-9 a budget
transfer is required in order to transfer money between appropriations for
those costs associated with the reimbursement to Victory for insurance coverage
related to the Victory Water treatment Plant (builders risk insurance) and
vehicle coverage for the 1985 GMC, 2006 Ford truck and the 2004 New Holland
Backhoe. From J1990.4 Contingent
Account to J1910.4, Unallocated Insurance in the amount of $2,438.00. Commissioner
Pink authorized the treasurer to transfer within the budget as stated to
reconcile the appropriations and it was seconded by Commissioner Lloyd, all
ayes, motion passed.

There was a resolution
#2008.2009-10 presented as followed:
The S/V BOWM has determined that it is in the public interest to settle
certain litigation, entitled “Thomas Derby v. Schuylerville/Victory Board of
Water management, Saratoga County court (Small claims) file No. 0800034. Be it resolved that the board hereby
authorized the amount of $350.00 to Thomas Derby in exchange for a release from
liability and in settlement of such litigation. Commissioner Pink made a
motion to pass and sign this resolution #2008.2009-10 in the amount of $350.00
to Thomas Derby and it was seconded by Commissioner Kahnle, all ayes, motion
passed.

Project Identification
Plaque: Decision still pending: Quotes yet to be received by Chairman Colvin
from three vendors. Chairman Colvin
stated that he did not get any response from any of the vendors. After a short discussion Commissioner Lloyd made a motion to rescind
the last motion on this issue and go back to the original spec’s in the
contract and it was seconded by Commissioner Kahnle, all ayes, motion passed.
Victory Project/DEC/Erosion
Control Notice: a letter was received
from DEC and forwarded to the Village of Schuylerville address. However Laberge received this directly from
DEC and a fax was sent to Contract #1 (WM Schultz Construction) to remedy the
disturbed areas and isolated mounds of soil by isolating from the protected
waters by silt fence until stabilized.
Corrective measurers are to be completed by September 20, 2008 and notification is required to Laberge as
outlined.
Change Order #3 (WM Schultz
Construction): this is to extend the
contract completion date from September 1, 2008 to October 13, 2008.
Change Order #1 (Stilsing
Electric): this is to extend the
contract completion date from September 1, 2008 to October 13, 2008.
Both Change Order #1 and #3
were tabled.
Chief Water Operator’s Report:
There was a discussion on the
valve installation that has been considered for Broadway in Schuylerville. Mr. Dennison stated the manpower that would
be needed, the equipment that would be needed and the materials that would be
required to complete the job. After a
discussion Chairman Colvin stated that the Schuylerville DPW does not have the
time to do this right away and the black topping is going to be started very
soon. He didn’t think it could be done
before the back topping. After further
discussion on this issue it was determined to take no action at this time.

Lightning Protection for the
Schuylerville Treatment Plant. Mr.
Dennison is working on getting some written estimates or reports on this. He stated he will get them forwarded to the
Chairman as soon as possible.
Training classes were stated
as followed:
--Sept. 9th
Mueller Waterworks Product Training School:
Attended: Ted Derby, Bill
Lloyd, Corey Helwig.
--Sept. 11th CNA
Environmental Operator Training class:
Scheduled to Attend: Mark Dennison, Ted Derby, Bill Lloyd, Hugh Bruce
and Michael Patrick.
--Sept. 25th Grade
A Lab Course: Scheduled to attend: Mark
Dennison and Ted Derby.
--October 21st
NYSRWA Distribution System Water Quality.:
Scheduled to attend Mark Dennison and Bill Lloyd. There was some discussion on when someone
signs up for a class and does not attend.
Water Leak at 1 Jay Street,
Victory Mills: Mr. Dennison reported he
investigated a possible water leak at 1 Jay St. There was an Audibly device placed on the curb valve stem to
determine water flow. Slight presence
detected with valve in open position, one in closed position. Determination was made that leak is on owner
side of curb valve. Line may be leaking
near foundation wall, water is seeping through the wall and activating sump
pump which is discharging water on to Jay Street. Valve remains open at this time.
Occupant has been notified of leak test results.
Victory Plant: Paving of Road at the Victory Plant: no
update, Chairman Colvin stated he would look into it this week.
Old Business:
Personnel
Manual: no update
Hiring: Chief Water Operator Dennison asked about
the status of the hiring as he stated Ted Derby will be out the whole month of
February and he would like to know if he will have anyone by then. There was a discussion on the re-advertising
of this position. Chairman Colvin
stated he would call and put it on the NYS employment Service. There was a discussion on a letter to go to
the other applicants that are no longer in consideration for the position. Chairman Colvin stated he would draft a
letter for this purpose.
Helwig
CDL request: no update
New Business:
Use unit in question; Cave
Realty- Corner Broad and Burgoyne St. they are currently being charged 8 units,
seems to be 9 apartments. After a
discussion, Chairman Colvin stated he would ask the Village of Schuylerville
Code Enforcement Officer at their next meeting.
There was also a discussion
on 120 Broad St. Schuylerville as Saratoga Safety is now renting the second
floor of this building. It was
determined to increase the current 2 units to 3 units to reflect the increase.

Commissioner Lloyd stated
that there is a Class D water operator course being offered October 16 &
17. This would be to work on the
distribution system. There was a
discussion for Corey Helwig from the Village of Victory to take this
course. This class is at a cost of
$350.00, this would include a two night stay at a hotel, as this is out of
town. Commissioner Kahnle made a motion to approve the attendance for Corey
Helwig to take this Class D water operator course, to include approval of the
cost of the class, a two night stay at a hotel, meals, travel expenses, and
lost salaries. This motion was seconded
by Commissioner Lloyd, all ayes, motion passed.
