ZONING BOARD OF APPEALS MINUTES

September 24, 2007

7:30 PM

 

Chairman Stephen Bodnar called the meeting to order at 7:30 p.m. and led the flag salute.

 

Chairman Stephen Bodnar explained the Rules of the Board.

 

Due to the absence of three regular board members, Chairman Stephen Bodnar recognized Alternate John Deyoe as eligible to vote.

 

Zoning Clerk Linda McCabe called the roll: Chairman Stephen Bodnar – present, Clifford Hanehan – absent, Thomas Carringi – present, Barbara Faraone – absent, Clarence Fosdick – absent, William Moreau – absent, James Burke – present, and Alternate John Deyoe– present. 

 

Also present: Town Zoning Officer Gil Albert and Mr. Thomas Gorman.

 

Approval of Minutes: All Board members present had read the minutes of the August 27, 2007 meeting.  A motion was made by James Burke and seconded by John Deyoe, to accept the minutes of the August 27, 2007 meeting as written.  Chairman Stephen Bodnar – aye, James Burke – aye, Thomas Carringi – aye, John Deyoe – aye

Order of Business:

AREA VARIANCE

 

Thomas N. Gorman  Case # 07-11

1388 Rt. 9 P

Saratoga Springs, NY  12866

Applicant is seeking a 49’ front set back variance in order to build a two-car garage and tool shed at the rear of his property.  He is proposing to place the buildings 1’ off his property line. 

 

Mr. Gorman approached the Board explaining his desire to build a garage and tool shed before winter hits.  He had the Board look at photos of his property where he plans to place the garage and tool shed and also photos of neighboring properties with their garages.  Mr. Gorman also told the Board that after meeting with his builder, the garage would be 28’ x 28’ and the tool shed would be 6’ x 16’.  The reason for the size changes is Mr. Gorman wants to place these buildings between mature trees instead of having to cut them down.  The Board proceeded to discuss with Mr. Gorman his options: He can continue with this Board or he can merge his two parcels into one and then all he needs to do is see the Zoning Officer for a building permit.  Mr. Gorman would prefer not to merge his properties because he is fearful of the tax implications.  After much discussion between the Board members and Mr. Gorman, it was decided this project would not infringe on anything.

 

 

 

After providing Proof of Notice in The Saratogian on September 12, 2007, Chairman Stephen Bodnar opened the Public Hearing.  No one came forward, the Public Hearing was closed.

 

Chairman Stephen Bodnar read the letter from the Saratoga County Planning Board stating that there would be no significant county wide or intercommunity impact.

 

Thomas Carringi made a motion, seconded by James Burke, to grant the 49’ setback variance to build a 28’ x 28’ two car garage with no inhabitable storage space and a 6’ x 16’ tool shed with no further construction allowed on this property.

New Business: John Deyoe mentioned that Clarence Fosdick will be bringing his maps for the Board to look at after next months meeting.  Chairman Stephen Bodnar said they are open to public review also.

 

Chairman Stephen Bodnar made a motion to adjourn the meeting at 8:17 p.m., seconded by James Burke.  Chairman Stephen Bodnar – aye, James Burke – aye, Thomas Carringi – aye, John Deyoe - aye   Carried 4 - 0.
