Supervisor Thomas Wood opened the meeting with the Pledge of Allegiance
at 7:00 p.m.
Roll call: Ruth Drumm, Town Clerk, called

Also present: Town Attorney William Reynolds, Deputy Town Clerk Linda McCabe, Zoning Officer Gil Albert, Highway Superintendent David Hall, and other interested members of the public.

WHEREAS, the Town of Saratoga instituted a campaign to
encourage residents to join the four volunteer firefighters and EMS workers’
organizations in the community; and
WHEREAS, the Stewarts Shops has supported that campaign
fiscally by sponsoring two street signs and agreeing to post placards in
businesses; and
WHEREAS, the Town of Saratoga has established website
–www.townofsaratoga.com which is listed on the signs and placards where
individuals can find out more information about joining the various volunteer
firefighters and EMS workers’ organizations in the community; and
WHEREAS, the Stewarts Shops continues to support the community
through their commitment to donating a portion of their profits to the
community; therefore be it
RESOLVED, that the Town of Saratoga extends our appreciation to
the Stewarts Shops for their support of the Town’s efforts to recruit Volunteer
Firefighters and EMS workers.

Betty Koval the following Resolution # 07- 111 Sword Surrender Site was adopted by vote: Supervisor
Thomas Wood - aye, Councilman Fred Drumm – aye, Councilman Charles Hanehan –
aye, Councilwoman Betty Koval – aye, and Councilman Michael McLoughlin – absent. Carried 4 – 0.
WHEREAS, the Town of Saratoga has the opportunity to preserve
and interpret the Sword Surrender site from the Battles of Saratoga, and
WHEREAS, Governor Seymour in 1877 described the site as the
spot where “American Independence was made a great fact in the history of
nations”, and
WHEREAS, efforts to preserve and interpret the Sword Surrender
site honors the participants in the Battles and preserves the battlegrounds
where a major British military offensive in 1777 ended in a British surrender
that heartened the patriot cause and
brought about the
international recognition and aid essential to securing our nation’s freedom,
and
WHEREAS, a wonderful partnership has developed to preserve and
interpret the Sword Surrender site lead by Assembly Members McDonald and
Englebright, Senator Bruno, Saratoga National Historical Park, Open Space
Institute, NYS Office of Parks, Recreation and Historic Preservation, NY
Department of Environmental Conservation, and the Town of Saratoga, and
WHEREAS, the Town of
Saratoga was granted $47,200 dollars through the Heritage NY program in 2002 to
develop the Saratoga Region - Collaborative Regional Interpretive Signage
Project to interpret the Battles of Saratoga and the Revolutionary War history
of the region, and
WHEREAS, the Town of Saratoga has the opportunity in
partnership with the Heritage NY program to redirect that money to focus on the
Sword Surrender site, and
WHEREAS, the Town of Saratoga’s comprehensive plan calls for
preservation of farmland and open space and the Sword Surrender site includes
over 30 acres of open space, and
RESOLVED, that the Town of Saratoga terminates the Saratoga
Region - Collaborative Regional Interpretive Signage Project so that money can
be better directed by NYS Office of Parks, Recreation and Historic Preservation
to further the development of the Sword Surrender site and linkages among
Revolutionary War sites in the area with expectation that the majority of these
funds will be used toward development of a Cultural Landscape inventory and
plan at the Sword Surrender site in cooperation with the National Park Service,
and further be it
RESOLVED, that the Town of Saratoga extends our appreciation to
the Heritage NY program and Director Richard White-Smith and Saratoga National
Historical Park Deputy Superintendent Joseph Finan for their efforts on
preserving and interpreting the Sword Surrender site from the Battles of
Saratoga, and further be it
RESOLVED, that a copy of this resolution will be sent to
Assembly Members McDonald and Englebright, Senator Bruno, Superintendent Frank
Dean at Saratoga National Historical Park, Heritage NY program and Commissioner
Ash at NYS Office of Parks, Recreation and Historic Preservation.

WHEREAS, the
Town of Saratoga wishes to recognize and honor
Beatrice Cope Brownell on her
100th birthday, and
WHEREAS,
Beatrice was born September 16, 1907, in the Town of Greenfield, and
WHEREAS,
Beatrice married her husband Irving and moved to the Village of Victory nearly
80 years ago, and
WHEREAS,
Beatrice still lives in the same house on Gates Avenue in which she raised her
children Lois, Carol, and John, and
WHEREAS,
Beatrice Brownell worked at the Victory Mill for many years and
WHEREAS,
Beatrice Brownell demonstrated in her daily life the qualities and attributes
which are highly desired and valued by our society and
WHEREAS, Beatrice Brownell was active in the Schuylerville
Methodist Church and was a caring and giving individual, and
WHEREAS,
Beatrice Brownell has stated that the secret to living 100 years is good, clean
living and
WHEREAS, it
is fitting that the longevity and quality of the life of Beatrice Brownell be
honored, recognized and remembered by the Town of Saratoga, now, therefore be
it,
RESOLVED,
that the day of September 16, 2007, is hereby dedicated to the life of Beatrice
Cope Brownell in grateful recognition by the Town Board of The Town of Saratoga
on behalf of all the residents of the town.

the remaining term of 9/10/2007 – 09/30/2009.
Proof
of Notice having been furnished by the Saratogian
on September 4, 2007, Supervisor Thomas Wood opened the Public Hearing on the Mass Gathering Permit Applications by Saratoga
Rowing Association – Regattas on 9/29/2007 and 10/27 & 10/28/2007 at 7:16
p.m. No one came forward to speak. A motion was
made by Supervisor Thomas Wood and seconded by Councilman Charles Hanehan to
close the public hearing at 7:17 p.m. Supervisor Thomas Wood - aye, Councilman
Fred Drumm – aye, Councilman Charles Hanehan – aye, Councilwoman Betty Koval –
aye, and Councilman Michael McLoughlin – absent. Carried 4 – 0.
Approval of Minutes:
A motion was made by
Councilman Charles Hanehan and seconded by Councilwoman Betty Koval to accept
the regular meeting minutes of August 13, 2007 as written. Supervisor Thomas Wood - aye, Councilman
Fred Drumm – aye, Councilman Charles Hanehan – aye, Councilwoman Betty Koval –
aye, and Councilman Michael McLoughlin – absent. Carried 4 – 0.
Town Clerk’s report for August 2007: Fees paid to the County Treasurer for Dog Licenses $75.20. Fees paid to the NYS Dept. of Agriculture and Markets for the spay/neuter program $21.00. Fees paid to New York D.E.C. for hunting and fishing licenses $3,140.72. Fees paid to the New York State Health Department for Marriage licenses $90.00. Dog license fees to Supervisor Thomas Wood $209.80. Clerk fees to Supervisor Thomas Wood $233.03. Total State, County, and Local Revenues received were $3,769.75.
Zoning Officer’s report for August 2007 report: 9 Building Permits, 26 Building Inspections, 8 COs, 2 Zoning Regulation books sold, 1 complaint, 2 perc tests, and 2 misc. A check for $1,455.00 was given to Supervisor Thomas Wood.
Dog Control officer’s report for August 2007: Supervisor Thomas Wood read the report from Ed Cross. He answered 56 complaints, took 4 dogs to the shelter, issued 30 warnings and 4 summonses. He traveled 176 miles. It was a busy month. Due to increasing complaints, he asked the board to consider passing a law prohibiting an owner permitting their dog to deposit waste upon the premises of anyone other than the owner’s. Town Attorney William Reynolds stated that our present law covers that where it states that it is unlawful for the owner to allow their dog to commit a nuisance upon the premises of a person other than the owner or person harboring such dog.
Town Court report for August 2007: Supervisor Thomas Wood read the report stating that the following were closed: 109 Vehicle & Traffic, 10 Criminal/Penal Law, 11 DEC/ENCON, 8 Dog cases, 1 DWI, 0 Town & Village Ordinance, 2 Small Claims/Civil, 1 Eviction, 0 Bench trials, 0 Divestiture Forms (case transfers) sent to County Court, 11 attended the Science of Speed School, 1 Defendant sentenced to probation, 195 hours of community service issued, 0 days of jail time issued, 4 Order of Protection issued, and $7,650.00 in fees were paid to the NY State Comptroller.
We are working with the
Stillwater Historian, Schuylerville Historian and of course Catherine DeFelice
to finish up the Archives Grant. This
has been very successful for the communities in getting our collections in order. In addition, the archives office said that
they would encourage a grant application to retrofit an existing room for
records storage if the Town decides to move to an already constructed building.
In addition, the office has
been working with the Heritage NY to redirect some funding to establish a historic
park on the location of the sword surrender site. This is an exciting partnership with the National Park Service
and a host of other partners including the Open Space Institute, OPRHP, NYDEC
and of course the Town. This location
is where it is thought that Burgoyne surrendered his sword at the end of the
Battles of Saratoga.
Assessor’s report: Supervisor Thomas Wood read
the report for August 2007:
During the month of August we
processed 25 transfers, 14 valid sales and 11 non-valid sales. There was a
revision of one parcel.
I had two small claim hearings
in the month of August. On Wednesday, August 29th, I attended a
small claim hearing in Ballston Spa, the plaintiff was seeking a $49,400
reduction in assessment. On Thursday, August 30th, I attended
another small claims hearing in Ballston Spa, the plaintiff was seeking a
$32,580 reduction in assessment. One claim the town prevailed and one the
resident prevailed.
I went through the files and
sent out 110 STAR applications to residents that still do not have the
exemption.
We are still going out to
take pictures and check parcels for changes; we expect to do all parcels before
the end of the year.
Supervisor’s
report: Financial report: General A
$1,077,088.34, General B $94,662.73, Highway Outside $266,290.14, Youth
Recreation & Services $2,374.67, Highway Equipment Reserve $29,885.93,
Building Reserve $1,004,568.62 and Fire Protection $0. August revenues were $99,475.73 and expenses were $179,818.89. The August balance is $2,474,870.43.
A budget workshop
was scheduled for Thursday, September 20, 2007 at 6:00 p.m.
The public

Committee
reports:
Highway: Highway
Superintendent Dave Hall reported that patching of the roads is continuing. All the culverts on Sweet Road are being
replaced for reconstruction next year.
The newly paved roads have been striped and all road signs have been
cleared of brush and obstructions.
Landfill: No
report.
Insurance: No report.
Youth: No report.
Buildings: Supervisor
Thomas Wood and Councilman Fred Drumm have met with Sonny Bonacio and Larry
Novak regarding the corner school and conversations are continuing. The next Building Committee meeting is
planned for October 3rd.
Senior Citizens: Councilwoman Betty Koval
reported that the Quaker Springs Seniors met today with 37 attending. A bus trip to Aggawar, MA is planned for
Tuesday, October 16, 2007. The Schuylerville
Senior Citizens will meet on Wednesday, September 12th at the Fish Creek
Rod & Gun Club.
Committee to Honor Volunteer Firefighters &
Emergency Medical Service Workers: Sean Kelleher reported that the next meeting is
scheduled for Wednesday, September 26th at 7 pm at the Town Hall.
National Incident Management System Committee
(NIMS): Jim Miers reported that the Reverse 911 system is being
implemented and further testing is being done countywide. The system is used for notification of
safety related issues such as natural or man made disasters. It was tested by calling all the Supervisors
in the county and households will be next.
The system has the capability of contacting countywide or narrowing the
lists to smaller areas such as streets or sub lists such as Fire Chiefs. The next meeting will be on September 20th
at 2:30 p.m.
General Schuyler Emergency
Squad: Sherry Doubleday reported that they
have had 500 runs so far this year with an increasing number on the west
side. The new location will be good for
residents. She added that they are
finalizing financing and the bids are out.
They hope to break ground in the spring.
Quaker
Springs Fire Department: Stephen
Bodnar reported that the Quaker Springs Fire Department responded to 8 calls in
August. He stated that their company
picnic was held. The Commissioners meet
one week from tonight. They are working
with Michael Giovanone and the architect who is writing the bid contracts and
developing a time line for construction of their new building on Rt. 9P. He reported that on September 15th
a farm rescue drill will be conducted at the William Hanehan farm. Seven members completed HAZ MAT
training. He added that the firemen
will be working at the Regattas.
Old
business:
Supervisor Thomas Wood announced that we will
be participating in the Hazardous Waste Collection on October 27th
at Wilton’s Town Highway Garage.
The Towns of Wilton, Moreau, Northumberland, and Saratoga are
participating. Registration forms, with
further details, are available in the Town Clerk’s office. The completed registration form from the Town
Clerk must be received by the coordinator in Wilton by the October 15th deadline.

#07- 108 Saratoga Country Inn PUD Application – 59 day

WHEREAS, on February 14, 2005, the Town Board of the Town of
Saratoga granted final approval for the Saratoga Country Inn PUD, by amending
the Zoning Ordinance of the Town, and
WHEREAS, Article X, Section 3(J) of the Zoning
Ordinance provides that approval for a PUD development project shall become
null and void if construction has not begun within two years of the Town Board
approval, and
WHEREAS, due to circumstances beyond control of the
owner and applicant, said construction work has not begun as planned, and for
good cause shown to the Town Board, it is therefore
RESOLVED, that there is hereby granted an extension
of time until November 8, 2007 within which construction work must begin for the
Saratoga Country Inn PUD and such
construction must
be completed on or before eighteen (18) months of issuance of the first
building permit, and it is further
RESOLVED, that if the aforesaid time limitations are
not met, then the approval for this development project shall become null and
void.

and reviewed the application for a Mass

WHEREAS, the required information has been submitted, as
required by Local Law #2 of 2006, reviewed and deemed satisfactory, and
WHEREAS, the Town Board of the Town of Saratoga has held a
public hearing on September 10, 2007 for input by interested persons, and
WHEREAS, the event is desirable for the town, therefore be it,
RESOLVED, by the Town Board of the Town of Saratoga that the
permit is granted conditional upon the Town of Saratoga receiving a Certificate
of Insurance for the above event naming the Town of Saratoga as additional
insured in the amount of $2 million, at least 5 business days prior to the
event; that the event is found to be in compliance with the NYS Department of
Health regulations of Chapter 1, Title 10, Part 18 by the NYS DOH when
required; and contingent on the implementation of all involved agency
recommendations.

WHEREAS, the Town Board of the Town of Saratoga has received
and reviewed the application for a Mass
Gathering Permit by the Saratoga Rowing Association for a Rowing Regatta as

#07-112 – Authorization to contract with James Vianna P.L.S. to Survey Canal
Lands 209.-1-9.1 for $4,000 was adopted by vote: Supervisor Thomas
Wood - aye, Councilman Fred Drumm – aye, Councilman Charles Hanehan – aye,
Councilwoman Betty Koval – aye, and Councilman Michael McLoughlin –absent. Carried 4 – 0.
WHEREAS, the Town Board of the Town of Saratoga recognizes the
need for a survey done on the Canal parcel SBL # 209.-1-9.1 on town land lying
southerly of Wilbur Road, therefore be it
RESOLVED, that
the Town Board of the Town of Saratoga authorizes Supervisor Thomas Wood to
enter into a contract with James Vianna P.L.S. for professional services to
survey the aforementioned parcel for $4,000 taken from Parks Account # A
7110.4.
On a motion by Councilman
Fred Drumm and seconded by Councilwoman Betty Koval, the following Resolution
#07-113 – Authorization to contract with James Vianna P.L.S. to do
Topographical Mapping Services on the Canal Parcel in Coveville for $1,000 was adopted by vote: Supervisor Thomas Wood - aye, Councilman Fred Drumm –
aye, Councilman Charles Hanehan – aye, Councilwoman Betty Koval – aye, and
Councilman Michael McLoughlin –absent.

WHEREAS, the Town Board of the Town of Saratoga recognizes the
need for topographical mapping services done on the Canal parcel in Coveville,
SBL # 183.-1-13, therefore be it
RESOLVED, that the Town Board of the Town of Saratoga authorizes
Supervisor Thomas Wood to enter into a contract with James Vianna P.L.S. for
professional services to survey the aforementioned parcel for $1,000 taken from
Parks Account # A 7110.4.
On a motion by Supervisor

#114 - Authorization to contract with the LA Group for
professional services for consulting and assisting in the administration of the
NYS Canal Corporation grant for the
Town of Saratoga’s Hudson River Boat Launch in the amount of $77,603 plus
reimbursable expenses was

WHEREAS, the Town of Saratoga has been awarded a grant in the amount of $225,000 from the NYS Canal Corporation’s 2006 Erie Canal Greenway Grant Program, and
WHEREAS, the Town Board of the Town of Saratoga recognizes the
need for professional services to consult and administer the NYS Canal Corporation
Grant for the Town of Saratoga’s Hudson River Boat Launch Project, therefore be
it
RESOLVED, that the Town Board of the Town of Saratoga authorizes
Supervisor Thomas Wood to enter into a contract with the LA Group for
professional services for consulting and
assisting in the administration of the
NYS Canal Corporation Grant for the
Town of Saratoga’s Hudson River Boat Launch in the amount of $77,603 plus
reimbursable expenses.

WHEREAS, the Town Board of the Town of Saratoga recognizes the
need for professional services for the Phase 1
Environmental Site Assessment and a Preliminary Subsurface Investigation at the
Rt. 29 Schuyler Park Site,
and
WHEREAS,
the lowest proposal was provided by C.T. Male Assoc.,
50 Century Hill Drive, P.O. Box 727, Latham, NY for $4,300 (Aztech
Technologies, Inc., 5 McCrea Hill Road, Ballston Spa, NY for $4,839.50 and CA
Smith, LLC., 49 Front Street, Ballston Spa, NY for $5,350), now therefore be it
RESOLVED, by the Town Board of the Town of Saratoga to accept
the lowest proposal from C.T. Male Assoc., 50 Century Hill Drive, P.O. Box 727,
Latham, NY for $4,300 to be paid from Parks A7110.4, contingent upon securing
permission to access the property to perform the aforementioned services and
sharing the cost with the Town of Northumberland (50% – 50%).

Bob
Guay asked the town board if he could put up a fence with
2 post rails to place a sign on pointing to his Alcove Marina. It would be located on the town’s property
line. Town Attorney William Reynolds
noted that private signs are not allowed in the town’s right-of-way but there
are no restrictions on the property line.
It would be up to the town board.
Supervisor Thomas Wood and Councilman Fred Drumm will visit the site and
make a recommendation to the rest of the board for further consideration.
Bob Guay also stated that there is no Building
Permit for the neighbor’s building owned by Neubauer and Wilbur. He stated that
he has a court order dated April 2006 and that Zoning Officer Robert Hathaway has
confirmed that they still have not obtained a building permit or met
regulations. Supervisor Thomas Wood
stated that they would have Zoning Officer Gil Albert check it out and confer
with the justices and the town attorney.
Jim
Miers emphasized the importance of placing an In Case
of Emergency (ICE) number in cell phones.
Steve
Bodnar stated that he feels that it is not suitable for
Real Estate people to serve on the Board of Assessment Review. He stated that he has had about 20 calls
regarding the high school taxes that are hurting people. He feels that there are many unfair
assessments in the town, including his own.

Audit the Bills: On a motion by Councilman Fred Drumm and
seconded by Councilwoman Betty Koval the
following Resolution #07-116 - Approving the payment of bills in Abstract 9G
was adopted by vote: Supervisor Thomas Wood - aye, Councilman Fred
Drumm – aye, Councilman Charles Hanehan – aye, Councilwoman Betty Koval – aye,
and Councilman Michael McLoughlin – absent.
Carried 4 – 0.
RESOLVED, by the Town Board of the Town of Saratoga to authorize
payment of the bills listed in Abstract 9G (09/10/2007) in the following
amounts: General A $24,557.45, and General B $4,348.72, Youth $950.00, and
Highway Outside $18,733.73 for a total expense of $48,589.90.
