ZONING BOARD OF APPEALS MINUTES

October 22, 2007

7:30 PM

 

Chairman Stephen Bodnar called the meeting to order at 7:30 p.m. and led the flag salute.

 

Chairman Stephen Bodnar explained the Rules of the Board.

 

Due to the absence of two regular board members, Chairman Stephen Bodnar recognized Alternate John Deyoe as eligible to vote.  Barbara Faraone is stepping down from the roll of Board member into Applicant status at this meeting while her case is before the Board.

 

Zoning Clerk Linda McCabe called the roll: Chairman Stephen Bodnar – present, Clifford Hanehan – absent, Thomas Carringi – present, Barbara Faraone – present as applicant, Clarence Fosdick – present, William Moreau – absent, James Burke – present, and Alternate John Deyoe– present. 

 

Also present: Town Zoning Officer Gil Albert, Town Attorney William Reynolds and Mr. Lou Galarmeau.

 

Approval of Minutes: A motion was made by James Burke and seconded by Thomas Carringi, to accept the minutes of the September 24, 2007 meeting as written.  Chairman Stephen Bodnar – aye, James Burke – aye, Thomas Carringi – aye, Clarence Fosdick – aye, John Deyoe – aye.

Applicant proposes to remove existing residence in order to construct a new home on this private road parcel.  She is seeking a 36’ two side set back and a 14’ side set back area variance because she cannot meet the zoning regulation set back requirements.

 

After providing Proof of Notice in The Saratogian on October 12, 2007, Chairman Stephen Bodnar opened the Public Hearing. No one came forward; Chairman Stephen Bodnar closed the Public Hearing.

 

Applicant Barbara Faraone and her builder Mr. Lou Galarmeau appeared before the Board.  The Applicant explained the history of her house and presented photos to the Board members, showing where her neighbors are in relation to her property.  She also went over the drawings and maps as the parcel currently is, and with the overlays of how it will be if approved.  She told the Board she will have the shed removed from the property and that she will keep what she calls the barn, nearest the road, for storage.  The Applicant also presented a letter to the Board signed by her neighbors, stating they have no problem with this project.  Chairman Stephen Bodnar read the letter to the Board; it is on file in the Clerk’s office.  Chairman Stephen Bodnar questioned the percentage of coverage.  Mr. Galarmeau said he believes it is 24%. Chairman Stephen Bodnar asked if the 24% includes the garage.  Mr. Galarmeau answered yes it includes the garage and believes even with the deck, the coverage will be about the same as it is now.  Chairman Stephen Bodnar and Mr. Galarmeau had a discussion on the coverage and after some calculations, Chairman Stephen Bodnar told the Board the coverage is little more than current coverage and agreed with Mr. Galarmeau.  Attorney William Reynolds asked the Applicant if she has deeded access to the private road and the Applicant answered yes, that she and the three other homeowners own the road and they also have 25’ on the lake. Chairman Stephen Bodnar asked Mr. Galarmeau if he had anything more to say and he answered he believes this is an improvement to the property.  Zoning Officer Gil Albert questioned if the footings will be lower and was told by Mr. Galarmeau they will be 2’ lower.  Zoning Officer Gil Albert raised concerns about the flood plain and was told they are not in a flood plain, the lake is 60’ below this parcel.  Zoning Officer Gil Albert then stated he sees nothing wrong with this and it is an improvement.

 

Chairman Stephen Bodnar read the letter from the Saratoga County Planning Board stating that there would be no significant county wide or intercommunity impact.

 

Clarence Fosdick made a motion, seconded by Thomas Carringi, to grant the area variance as applied for, because it will make the side setbacks greater, it will improve the property and the percentage of coverage will only be slightly more than current coverage. Chairman Stephen Bodnar – aye, James Burke – aye, Thomas Carringi- aye, Clarence Fosdick – aye, John Deyoe - aye.      Carried 5 – 0.

 

Chairman Stephen Bodnar stated that Board member Barbara Faraone can now rejoin the Board. 

                                                 

Old Business:  Zoning Officer Gil Albert told the Board that he put Mr. Gong on notice today; he must clean up his property by the end of this week.

 

New Business:

 

Barbara Faraone made a motion to adjourn the meeting at 8:15 p.m., seconded by Clarence Fosdick.  Chairman Stephen Bodnar – aye, James Burke – aye, Barbara Faraone – aye, Thomas Carringi – aye, Clarence Fosdick – aye, John Deyoe - aye   Carried  6- 0.
