Supervisor Thomas Wood opened the meeting with the Pledge of Allegiance
at 7:00 p.m.
Roll call: Ruth Drumm, Town Clerk,
called the roll. Supervisor Thomas

– absent (arrived at 8:40 p.m.)
Also present: Town Attorney William Reynolds, Highway Superintendent Dave Hall, Zoning Officer Gil Albert, and many other interested members of the public.

Presentation:
Saratoga Development LLC -Brown Road –PUD
Matt Jones presented the plans for the
development proposed originally by MKN that was referred to the Planning Board
in July of 2006. The Planning Board on
December 19, 2006 gave it a favorable review and it went back to the Town Board. In April 2007, the town board while completing
the SEQR asked for a Storm water Plan concerning the estate lots, 15 & 16,
that are lakeside. Matt Jones stated
that a draft Storm water Plan was given to Town Engineer Kenneth Martin this
evening for his review. They would like
the SEQR completed and a public hearing held at the November meeting. The development is exactly the same as
originally proposed; the only change is the owners. It consists of 2 estate lots lakeside, two clusters of 4 homes
with a farm like look, and 6 Bungalow lots by the pond. There will be private wells and
septics. The common areas will be
maintained by a Homeowners Association.
Stephen Bodnar, QSFD, inquired about
turnarounds and a dry hydrant at the pond.
Matt Jones stated he will look at the plans, if it was in the original
it should still be there.

Supervisor
Thomas Wood explained that the application has been sent to the Sheriff, the
Department of Health, and the town engineer for their review. All was in order.

Supervisor Thomas Wood made a motion, seconded by Councilman Charles

Approval of Minutes: A motion was made by Councilwoman Betty Koval and seconded by
Councilman Charles Hanehan to accept the minutes of the September 8th
regular meeting and the September 24th Budget Workshop meeting as written. Supervisor Thomas Wood - aye, Councilman
Fred Drumm – absent, Councilman Charles Hanehan – aye, Councilwoman Betty Koval
– aye, and Councilman Michael McLoughlin – absent. Carried 3– 0.
Town Clerk’s report for September 2008: Town Clerk Ruth Drumm reported. Fees paid to the County Treasurer for Dog Licenses $69.32. Fees paid to the NYS Dept. of Agriculture and Markets for the spay/neuter program $18.00. Fees paid to New York D.E.C. for hunting and fishing licenses $3,335.44. Fees paid to the New York State Health Department for Marriage licenses $22.50. Dog license fees to Supervisor Thomas Wood $195.68. Clerk fees to Supervisor Thomas Wood $247.56. Total State, County, and Local Revenues received were $3,888.50.
Zoning Officer’s report for September 2008: Zoning Officer Gil Albert reported: 10 Building Permits, 0 Building Permit Renewals, 17 Building Inspections, 6 COs, 0 Junk Yard Permits, 3 Complaints, and 6 misc. A check for $1,432.89 was given to Supervisor Thomas Wood.
Dog Control Officer’s report for September 2008: Supervisor Thomas Wood read the report for DCO Ed Cross. He answered 32 complaints, traveled 134 miles, issued 11 warnings, took no dogs to the shelter, and no summonses were issued.
Town Court report for September 2008: The following were closed: 132 Vehicle & Traffic, 11 Criminal/Penal Law, 11 DEC/ENCON, 1 Dog case, 6 DWIs, 0 Town & Village Ordinance, 5 Small Claims/Civil, 0 Evictions, 1 Bench trial, 0 Divestiture Forms (case transfers) sent to County Court, 14 attended the Science of Speed School, 0 Defendants sentenced to probation, 55 hours of community service issued, 190 days of jail time issued, 3 Orders of Protection issued, and $9,710.00 in fees were paid to the NY State Comptroller.

Historian’s report: Historian
Sean Kelleher submitted the following report:
The office has worked on
various inquiries in the past month.
The history of a property in Quaker Springs, the history of the
community when the Rev. Sharpton visited, and on Schuyler Park. In addition, we have been involved in moving
offices. This year we have less
programming on Surrender Week (due to the move) but the Schuyler House and
Monument has been open on weekends, the Surrender ceremony is on Friday at noon
at Fort Hardy Park and the candlelight tour is Saturday night. At the end of the month, I am presenting at
a conference with County Historian Kristina Reese on running an efficient
Historian’s office and acquisitions.
Historian
Sean Kelleher gave the board a history on the Schuyler Park property.
Assessor’s report: Assessor Vicki Hayner submitted the following report:
During
the month of August and September we processed 23 sales transfers that
consisted of 5 valid sales and 18 non-valid sales. The bulk of the transfers were residential property. There were 4 vacant land transfers and one
multiple residence transfer.
We
had one small claim hearing in August which was dismissed due to its not
meeting the requirements for small claims.
The property was a rental property and that does not qualify for small
claims hearings according to New York State Law.
In
July I attended a course in Commercial Data Collection in Ithaca, New York as
part of my Continuing Education requirements.
I have achieved the required Continuing Education courses for this year.
Danielle
and I spent the end of the month packing and moving and are now settled into
our new office. We plan to continue to
have our office open Monday through Thursday from 9:00 AM until 1:00 PM until
further notice.
As I
“mark” my first year of service to this town, I would like to express my thanks
and appreciation to the Board and the Supervisor for their support and
guidance. I look forward to continued
association with the Town.

Supervisor Thomas Wood reported that the September
Sales Tax Revenue received was $94,792.
Highway: Highway
Superintendent Dave Hall reported
that mowing of the roadsides has been completed for the year. The price of
asphalt has dropped, ditching and patching of the roads continues. The hauling
of winter sand has been completed.
Patrick Burke, was hired and started last Monday. Highway Superintendent Dave Hall stated that
the 3 pt. hitch power broom is worn out.
He would like to purchase a new 2008 3 pt. hitch RHFA Sweepster Broom
with equipment money in the 2008 highway budget. He got 3 quotes and would like to go with a Sweepster from
Capital Tractor for $5,493. Supervisor
Thomas Wood made a motion, seconded by Councilman Charles Hanehan, to authorize
Highway Superintendent Dave Hall to purchase a new 2008 3 pt. hitch RHFA
Sweepster Broom from Capital Tractor for $5,493. Supervisor Thomas Wood - aye, Councilman Fred Drumm – absent,

Youth: No report.
Supervisor Thomas Wood reported that the move on September 30th
to the new town hall at 12 Spring Street went smoothly. The second day of the move for the meal site
and records will occur in November once the 3 stop elevator is installed. Voting in the General Election on November 4th
will be at the old town hall at 30 Ferry Street. Next year they will be held at 12 Spring Street.
Senior Citizens: Councilwoman Betty Koval
reported that the Quaker Springs Senior Citizens met on Monday, October 13th. Approximately 31 attended. A trip to a Vermont Discount Soap Factory
Outlet and Museum is scheduled for October 20th. Participants are to meet the bus at Quaker
Springs Methodist Church at 6:45 a.m. The cost is $35 and reservations are due
to Henrietta Waldinger (584-3429) by October 20th.
The Schuylerville Seniors met
on September 30th for their organizational meeting and 73
attended. On October 14th
they met with 65 attending. Justice
Dave Mathis spoke to the group on the Town of Saratoga’s Court System, how it
functions and the educational aspects offered to students.

Parks:
Laurie Griffen and Ian Murray reported on Schuyler
Park. The Schuyler Park Committee meets the last Tuesday of
the month. Laurie Griffen reported that
she and Dan Gale, Co-Chairman, visited all the neighbors bordering the park and
that it was a good and positive meeting with the neighbors. The by-laws are being updated along with the
website, 50C3 status is still being pursued and another newsletter is planned.
Galusha & Sons are clearing and grinding stumps. Ian Murray stated that David Meager, our insurance agent, has
recommended that contractors be required to carry an additional Owners
Contractors Protection Policy and that the committee feels that it is excessive
for the size of the projects being done at the park and it should not be
required. The archeological review (1A
& 1B) by Birchwood Archaeological Services has been done. The report suggested that further testing
be done where the road is but the Schuyler Park Committee does not feel it is
necessary because the area where the road is will not be further disturbed,
will be blocked off, and eventually will be encapsulated. The committee would like the town board to
review the archeological report; complete the Part II SEQR at the next agenda
meeting; and declare a Negative Declaration at the regular meeting so they can
complete the Master Plan and continue working on the site. Ian Murray noted that they have lots of
volunteers that would like to help this fall with the earthwork.

Emergency Medical Service Workers: No

General Schuyler Emergency Squad: Dee
Macica reported that the call volume was 45 calls, 34 transports, 1 med flight,
and several standbys for September.
There have been 538 calls year to date.
They have had 3 new member applications submitted this month which makes
9 new members so far this year. OSHA
training has been completed. They will
be covering the Saratoga Rowing Association’s Regattas on October 25th
and 26th.
Quaker
Springs Fire Department (QSFD): Stephen
Bodnar addressed the board reporting that they responded
to 7 calls in September. The new 4WD
pickup is now in service and will be used to pull the boat. The smorgasbord is
10/19 from noon to 3 p.m. They
participated in the Fire Prevention Programs at the school on October 10th,
and will participate with the Regattas on October 25th and 26th.
The farm rescue drill will be held in November at the Hanehan Farm. There is a Boaters Safety Course at the
Quaker Springs Fire House on November 15th from 8 a.m. to 4 p.m. and
is open to the public. The bids for the
new Substation on Rt. 9P were opened on September 29th. The low bid was
$905,000 and building could possibly start December 1. The next commissioners meeting is October 20th
and a public hearing on the budget will be held on October 21st at
7:00 p.m. There will be a Halloween
Party for the children on October 26th. The first explorer member has joined on October 6th. The stand pipe on Bryants Bridge has been
repaired.

Bid for Screened Winter Sand from Peckham Materials for $6.25 per ton was introduced. Following input by Highway Superintendent
Dave Hall who stated that the bid by Tracy Materials Inc. for $6.75 will result
in the lowest overall cost to the town once you consider the time and fuel used
to go to Peckham Material’s Plant for pick up in Greenfield Center. Tracy Materials is in Greenwich. Councilman Michael McLoughlin made a motion
to rescind the motion to accept the bid from Peckam Materials and Councilwoman
Betty Koval seconded it. Councilman
Michael McLoughlin then made a motion, seconded by Councilwoman Betty Koval to
adopt the following Resolution #08- 119 Accept Bid for Screened Winter Sand. Supervisor

public hearing on October 15, 2008 for input by interested persons, and
WHEREAS, the event is desirable for the town, therefore be
it,
RESOLVED, by the Town Board of the Town of Saratoga that the
permit is granted conditional upon the Town of Saratoga receiving a Certificate
of Insurance for the above event naming the Town of Saratoga as additional
insured in the amount of $2 million, at least 5 business days prior to the
event, and that the event is found to be in compliance with the NYS Department
of Health regulations of Chapter 1, Title 10, Part 18 by the NYS DOH when
required, and further be it,
RESOLVED, by the Town Board of the Town of Saratoga to return
within 30 days following the event a portion of the application fee after
expenses for the legal advertising, insurance, and any other costs incurred in
the review and overseeing of the event.

Town’s 2007 financial operations and procedures audited by Richard Dinolpho,
CPA, and
WHEREAS, the Town Board of the Town of Saratoga has reviewed
the findings, therefore be it,
RESOLVED, by the Town Board of the Town of Saratoga to accept
the findings as presented (the audit is on file in the Town Clerk’s
office).

RESOLVED by the Town Board of the Town of Saratoga that Sean
Kelleher acting as Historian of the Town of Saratoga is hereby authorized and
directed to file an application for funds from the New York State French and Indian War 250th Anniversary
Commemoration Commission or the New York State Department of Economic
Development in accordance with the Dickinson Sponsorship in an amount not to exceed
$3,800 for a temporary, portable exhibit and children/family activity guide on
the history of Fort Hardy, and upon approval of said request to enter into and
execute a memorandum of agreement and contract with the New York State French
and Indian War 250th Anniversary Commemoration Commission or the New
York State Department of Economic Development for such financial assistance to
this organization.

Community Designation was

WHEREAS, Preserve
America is a White House initiative developed in cooperation with the
Advisory Council on Historic Preservation, the U.S. Department of the Interior,
and the U.S. Department of Commerce; and
WHEREAS, the goals of this initiative include a greater shared
knowledge about our Nation’s past, strengthened regional identities and local
pride, increased local participation in preserving the country’s irreplaceable
cultural and natural heritage assets, and support for the economic vitality of
communities; and
WHEREAS, this initiative is compatible with our community’s
interests and goals related to historic preservation; and
WHEREAS, designation as a Preserve
America Community will improve our community’s ability to protect and
promote its historical resources; now therefore be it
RESOLVED, that the Town Board of the Town of Saratoga will
apply for the designation of the Town of Saratoga as a Preserve America Community; and be it further
RESOLVED, that Town Board of the Town of Saratoga will protect
and celebrate our heritage, use our historic assets for economic development
and community revitalization, and encourage people to experience and appreciate
local historic resources through education and heritage tourism programs.

RESOLVED, by the Town Board of the Town of Saratoga to transfer
$176.80 from Repairs and Maintenance DB5110.4 to DB9055.8 Disability Insurance.

Agreement with Independent Towers
was adopted by vote: Supervisor Thomas Wood - aye, Councilman Fred Drumm –

Councilman Michael McLoughlin – aye.

WHEREAS, the Town Board has determined that the Town has no
present need for use of certain real property, to wit, a parcel of 10,000 sq.
ft. located at the site of the former Town Landfill off Hayes Road, and
WHEREAS, the Town has received an offer from Independent
Towers, LLC, seeking an option from the Town to lease said property for the
purpose of constructing a wireless communication facility, it is now therefore:
RESOLVED, that Supervisor Thomas Wood is authorized to
enter into a lease option agreement for the aforesaid real property with
Independent Towers, LLC, for a term of one year, in the amount of $6000.00,
payable in monthly installments of $500.00, and it is further
RESOLVED, that the form of said lease option shall be
subject to review and approval by the Town Attorney.

$1,000 from Contingency Account # A1990.4 to Unallocated Insurance Account

Workshop on Friday, November 7, 2008 at Hudson Valley Community College.

Ambassador Program – Richard Beresford has been appointed as Ambassador for the
Northeast area of NYS.
Privilege of the floor:
Wendy
Lucas, addressed the board with concerns regarding the sale
of the old town hall property at 30 Ferry Street. She gave the history of the ownership of the property over the
years. She would like it to remain the
towpath and asked the board if they would consider deeding it back to the
Village of Schuylerville.
Stephen
Bodnar suggested that more lights be put up in the parking
lot. He thanked the board for their
efforts getting us into the new town hall.
It is a bargain considering the cost of new construction today and what
the fire department has been facing with their new substation.

following Resolution #8-127- Approving the payment of bills in Abstract 10G was
adopted by vote: Supervisor Thomas Wood - aye, Councilman Fred Drumm –
absent, Councilman Charles Hanehan – aye, Councilwoman Betty Koval – aye, and
Councilman Michael McLoughlin – aye.
Carried 4 – 0.
RESOLVED, by the Town Board of the Town of Saratoga to authorize
payment of the bills listed in Abstract 10G (10/15/2008) in the following
amounts: General A $37,455.39, General B $11,022.68, Building Reserve BR
$4,054,721.10, Youth Y $386.70 and Highway Outside DB $26,642.66, for a total
of $4,130,228.53.
