OF APPEALS MINUTES

Chairman
Stephen Bodnar called the meeting to order at 7:05 p.m.

– present, Barbara Faraone – absent, Clifford Hanehan – present, Joyce
Waldinger – present, David Hall – present, and Alternate James Burke – present.

Area Variance
97 Lakeview Lane

Jeanine
Stancanelli addressed the board requesting an area variance in order to meet
the FEMA base floodplain level at 97 Lakeview Lane, Saratoga Lake. Base flood
plain elevation required is 210.1’ and 207.9’ exists. She stated that the variance would enable her to obtain and keep
flood insurance on the residence. Chairman Stephen Bodnar asked Jeanine
Stancanelli to provide the board with a copy of the letter from her insurance
company, Allstate, that states her insurance would be cancelled if a variance
were not obtained. After some board
discussion, Tom Carringi introduced a
motion to grant the variance of 2.2’ because the failure to grant the variance
would result in an exceptional hardship.
The hardship resulted because the prior owners were issued a Certificate
of Occupancy in 1986, due to a misinterpretation of the floodplain regulation
at that time, and today it does not meet the base floodplain requirement. David Hall seconded this. Chairman Stephen Bodnar – aye, Joyce
Waldinger – aye, Thomas Carringi – aye, David Hall – aye, Barbara Faraone –
absent, Clifford Hanehan – aye, Alternate James Burke - aye. Carried

Old Business: None
New Business: Chairman Stephen Bodnar
informed the board that Bill Schutz gave his resignation from the board
effective October 1, 2004. He noted
that the Town Board is requesting the names of any interested persons. Joyce Waldinger added that John Deyoe has
mentioned an interest in the position in the past. This information will be passed on to Supervisor Thomas Wood. Chairman Stephen Bodnar also noted that the
board would need to designate a new vice-chairman also.
The
next regular meeting will be October 25, 2004 at 7:30 p.m.
A motion to adjourn was made at 7:50 p.m. by Joyce Waldinger and seconded by
Clifford Hanehan. Chairman Stephen
