Supervisor Thomas Wood opened the meeting with the Pledge of Allegiance
at 7:00 p.m.
Roll call: Ruth Drumm, Town Clerk,
called the roll. Supervisor Thomas
Wood- present, Councilman Fred Drumm - present, Councilman Charles Hanehan-
present, Councilwoman Betty Koval - present, and Councilman Michael McLoughlin
– present.
Also present: Highway Superintendent Dave Hall, Town Attorney William Reynolds, Deputy Town Clerk Linda McCabe, Assessor/Bookkeeper Catherine DeFelice, Zoning Officer Robert Hathaway and other interested members of the public.
Recognitions/Presentations/ Bid openings/ Public Hearings:
Quaker Springs Fire Department
Presentation: Architect Don Davis gave a power point
presentation of the design for the new QSFD fire house at Route 9P, Saratoga
Lake.
The
building will be 3,600 sq. ft. and will have 3 bays. It will be a metal fabricated building with a metal roof. It will have a radiant heat slab. It will also be used for a voting location
along with plans for an emergency generator so that it could also be used as an
emergency shelter. A public hearing on
the project is scheduled for June 5th at 7:00 p.m. and a vote on the
project will occur on June 12th from 6:00 to 9:00 p.m. They hope to finalize plans and to start
construction in August or September.
The estimated cost is $725,000.
Justice David Mathis
presented town court interns Juan Carlos Manrique Moya, a licensed attorney
from Mexico City, and Tiffany Schaen, a Skidmore College student, with
Completion of Internship Awards.
Supervisor Thomas Wood
reported that Planning and Zoning fees were reviewed and compared with other
towns in the county. It was determined that
increases were in line and needed to help keep up with the costs associated
with the applications. He reviewed the
increases proposed in Local Law #1 and 2.
Proof
of Notice having been provided by newspaper, The Saratogian, on 5/3/2007, the Public Hearing on Local Law #1 of 2007 – amending the Zoning
Ordinance of the Town of Saratoga (LL#1 of 1981) in respect to certain fees and
charges was opened at 7:30 p.m.
Zoning Officer Robert
Hathaway
asked for clarification on the ZBA application fees and requested that under
fees for pools that it include above ground pools also. It was decided to amend
the law to include above ground pools also.
He also asked that temporary and accessory buildings be addressed in the
future.
Zoning Board Chairman
Stephen Bodnar
asked for clarification on the fees regarding Gazebos and other small
outbuildings.
Supervisor
Thomas Wood made a motion to close the public hearing at 7:40 p.m. and
Councilman Fred Drumm seconded it. Supervisor

Proof
of Notice having been provided by newspaper, The Saratogian, on 5/3/2007, the Public Hearing on Local Law #2 of 2007 – amending the
Subdivision Regulations of the Town of Saratoga in respect to certain fees and
charges was opened at 7:41 p.m.
Tim Raymond questioned if the
engineering fees were being raised high enough. Supervisor Thomas Wood responded that once used up more money is
requested of the applicants.
Barbara Faraone suggested that we spell out
that another fee will be collected once the initial engineering fees are
depleted and that work will cease until the additional fees are collected. It was decided to amend the law to include
language to that effect. Town Attorney
William Reynolds will add the language to the law.
All
persons wishing to speak having spoken Supervisor Thomas Wood made a motion to
close the public hearing at 7:50 p.m. and Councilman Charles Hanehan seconded
it.

Approval of Minutes:
A motion was made by
Councilwoman Betty Koval and seconded by Councilman Michael McLoughlin to
accept the regular meeting minutes of April 9, 2007 and the special meeting
minutes of April 26th as written.

Town Clerk’s report for April 2007: Fees paid to the County Treasurer for Dog Licenses $146.65. Fees paid to the NYS Dept. of Agriculture and Markets for the spay/neuter program $36.00. Fees paid to New York D.E.C. for hunting and fishing licenses $203.10. Fees paid to the New York State Health Department for Marriage licenses $67.50. Dog license fees to Supervisor Thomas Wood $391.35. Clerk fees to Supervisor Thomas Wood $82.90. Total State, County, and Local Revenues received were $927.50.
Zoning Officer’s report: April 2007 report: 11 Building Permits, 13 Building Inspections, 3 COs, 1 Complaint, 3 Zoning regulation books sold, 1 ZBA appearance and no Orders to Remedy were issued. A check for $2,268.40 was given to Supervisor Thomas Wood.
Dog Control officer’s report for April 2007: Supervisor Thomas Wood read the report from Ed Cross. He answered 19 complaints, took 8 dogs to the shelter, issued 13 warnings and 3 summonses and traveled 388 miles. One dog was seized by the sheriff and one dog bite was reported.
Town Court report for April 2007: Supervisor Thomas Wood read the report. The following were closed: 95 Vehicle & Traffic, 21 Criminal/Penal Law, 2 DEC/ENCON, 4 Dog cases, 1 DWI, 0 Town & Village Ordinances, 2 Small Claims/Civil, 1 Eviction, 1 Bench trial, 2 Divestiture Forms (case transfers) sent to County Court, 18 attended the Science of Speed School, 0 Defendants sentenced to probation, 290 hours of community service issued, 14 days of jail time issued, 5 Orders of Protection issued, and $5,170 in fees were paid to the NY State Comptroller.
Historian’s report:
Sean Kelleher submitted the following
report:
The Historians' office has
been involved in assisting on the Old Saratoga Historical Association programs
in April on Schuylerville fires and June on the Prospect Hill Cemetery. The program for Historical and Surrender
Weeks are starting to firm up. The
office is continuing to work with the Grange on protecting their older records
and with the Saratoga Lake Association on historical markers. The Town has received grant extension with
the Battlefield Protection Program and Heritage NY.
Finally, I understand with
the new State administration, there is an increased interest in protecting the
view shed of Saratoga National Historical Park. I would just like to caution the Town Board that there is still
little known about the Battles of Saratoga sites in the Town of Saratoga. Potential earthworks are being recently
identified and informally researched by historians. The reason that I mention this is that the first priority in
preservation must be to identify research and if appropriate preserve sites
that remain related to the Battles of Saratoga before work is undertaken on
view sheds. It is my fear, that this
work on identifying sites beyond the National Park related to the Battles of
Saratoga will miss out in the charge to protect larger land masses in view
sheds. This is hard work since many
historians in the past have not focused on the time the troops were in our
community. But this does not detract
from what a truly special place our community is because as Governor Seymour noted
“on this spot, American Independence was made a great fact in the history of
nations.” I think the community should
be clear that we are interested in finding the proper mix of research on these
Battles, preservation of sites related to the Battles where appropriate, and
THEN view shed protection.
Assessor’s report: No report. Supervisor Thomas Wood stated that the Board of Assessment
Review will meet on Tuesday, May 22, 2007 from 4:00 to 8:00 p.m. at the town
hall.
Supervisor’s
report: Supervisor Thomas Wood presented April 2007 balances in Town funds
as follows: General A $1,109,394.44, General B $58,930.10, Highway Outside
$303,130.52, Youth Recreation & Services $7,001.66, Highway Equipment
Reserve $44,862.47, Building Reserve $1,002,871.60 and Fire Protection $0. April
revenues were $202,516.61 and expenses were $263,254.69. The April balance is $2,526,190.79.
The public
commented on the following agenda items:
New law in effect in NYS requiring the inspection and evaluation of all non-residential buildings, including old barns. Supervisor Thomas Wood noted that the town is very much aware of this. The NYS Farm Bureau is fighting the legislation and pushing to exempt agricultural buildings. Washington County has unilaterally voted against the new legislation and there is a bill in the state senate that would exempt agricultural buildings.
Committee
reports:
Highway: Highway
Superintendent Dave Hall reported that the new generator has been
installed. Patching of roads is
continuing and sweeping of the town roads is complete. Ditching and replacing culverts on Trombley
and Chapman Hill Roads is being done.
“Don’t Litter” signs were
discussed for the entranceways to the Town of Saratoga. Highway Superintendent Dave Hall stated that
he will check into the signs and Town Attorney William Reynolds will check into
the dollar amount of the fine that is on the books. Supervisor Thomas Wood will check with Joe Ritchey at the county
to see what the procedure would be on county roads.
The new truck has been put in
service. Highway Superintendent Dave
Hall asked the board to keep the old dump truck as a spare as it sometimes
takes days to get parts to repair a truck and during an emergency/storm it
would be great to have a truck available so work can continue. A
motion was made by Councilman Charles Hanehan and seconded by Councilman Fred
Drumm to keep the 1997 Ford single axle Dump truck for a
spare.

Highway Superintendent Dave Hall stated that the
highway employees will be attending a mine safety course offered by Pallette
Stone on May 16th. He noted
that construction has begun on the Louden Road subdivision. Safety concerns are
still an issue at the Louden Road and Route 29 intersection. A meeting will be set up with Jay Janczak of
the NYS DOT to see if a solution can be worked out as the state owns the land.
In response to resident
requests for trash and brush pick up, Highway Superintendent Dave Hall will
look into how the Town of Stillwater handles their trash pick up. Springer
Waste has provided its rates. It was suggested
to extend the hours that the brush dump is open in the spring to accommodate
yard clean up. It was decided to
revisit the issue at budget time.
Landfill: No report.
Insurance: No report.
Youth: No report.
Buildings: Supervisor Thomas Wood reported that a
committee meeting was held on May 9th. Three issues were discussed.
The first was the estimated cost to hire SD Atelier to do additional
construction design work for the Ferry Street and Route 32 sites. It was estimated to cost from $12,000 to
$15,000. The second issue was modular
construction for the new town hall. No
feedback has been received from the modular dealers. The third issue was the corner school. A revised layout of the building was reviewed and the proposed
price is $4.3 million which included all renovations needed to accommodate the
town offices. The price did not include
an offer for the purchase of the present town hall property. Further conversations will take place with
Mr. Bonacio. The next Building
Committee meeting will be on Wednesday, June 6th at 6:00 p.m.
Senior Citizens: Councilwoman Betty Koval reported that the Schuylerville Senior
Citizens met on May 8th and had a Tea Cup auction. There will be a birthday dinner party on
June 12th at the American Legion.
The Saratoga County Senior Citizen dinner will be May 17th at
the Saratoga Springs City Center. The
next meeting is on May 22nd in Schuylerville. A Tea Cup auction will be held featuring
items from Jackie Martin’s estate.
The Quaker Spring’s seniors
met today with 32 attending. Frank
Pemberton from the Saratoga County Cornell Cooperative Extension discussed lawn
care and other horticultural subjects.
Stephen Bodnar spoke regarding the upcoming vote for the new Route 9P
fire house which will occur June 12th from 6 to 9:00 p.m. at the
Quaker Springs Firehouse. Architect Don
Davis also participated in the presentation.
Applications for public monies through Senator Kirsten Gillibrand for
$200,000 and for a loan from the United States Department of Agriculture (USDA). Stephen Bodnar stated that the property tax
increase resulting from the new fire house is estimated at 20 cents a thousand
assessed value. The Route 9P firehouse
will serve as a voting place and emergency shelter in addition to its fire
protection functions.
The committee recognizes the
sad passing of Douglas Root who was an appointed member of this Town Committee
representing the David Nevins Fire Department.
The committee continues to
work forward although we have suspended meetings until a decision is made on
the new town hall. The town has a new plaque that will go up recognizing the
Supervisor’s Award recipients. We have
ordered the street signs and they will be put up soon. We are starting
work on a brochure that could go out to each new resident to encourage them to
volunteer.
Quaker
Springs Fire Department: Stephen
Bodnar addressed the board. He reported
that the fire department responded to 10 calls in April. An open house was held on April 28th. Five firefighters attended a Training School
in South Glens Falls and eight attended Fire Police School in West Glens
Falls. Twenty-six firefighters
completed OSHA training at the Quaker Springs Fire House. Crews worked the Regattas. Fire personnel will be taking an Emergency
Vehicles Operators Course on May 19th and 20th. Firefighters are currently taking their
yearly physicals.
Stephen Bodnar reported that they have been working
on substation plans. They met and
presented to the Quaker Springs seniors today and will meet with the Lake people
on June 2nd. A public
hearing is set for June 5th at 7:00 p.m. and the vote is scheduled
for June 12th from 6 to 9:00 p.m.
Saratoga
Lake Association: Barbara
Faraone reported that their annual meeting is scheduled for July 27th
at Panza’s Restaurant. The annual
Lakeside Yard Sale will be on June 2nd and a roadside cleanup is
planned for May 19th.
Old
business:
Supervisor
Thomas Wood reported that he has had conversations with Penelope Benson-Wright
regarding the Southard Road Development project. She addressed the board and provided them with a
memo defining her concerns about errors/omissions/violations of the Conditioned
Negative Declaration of the project.
She requested that the town have an independent
professional hydrologist evaluate the facts.
Supervisor Thomas Wood stated that he has shared her concerns with Town
Engineer Kenneth Martin and he will address the omissions and errors to bring
full compliance with their agreement.
There will be no building permits issued until it is resolved. Highway Superintendent Dave Hall reported
that some field tiles were damaged and the contractor will fix them and they
will drain into the storm water retention area. Lloyd Van Arnum added that the old tiles in the area were dug by
hand. He also noted that the well
testing was done in one of the wettest years we’ve had.
Supervisor
Thomas Wood reported that the fire damaged house of Calvin Gong’s at 1390 Rt.
9P has been demolished and the lot cleaned up.
All personal possessions were stored in a tractor
trailer and will be stored for 30 days.
The town is monitoring the site closely. Mr. Gong is working with an architect to design a house and
garage within codes so that building permits can be obtained.
New
business:
Supervisor
Thomas Wood in response to security concerns during court nights spoke with
Sheriff Bowen about hiring a sheriff to attend the sessions.
On a motion by Supervisor
Thomas Wood and seconded by Councilman Fred Drumm,
the
following Resolution #07-66 – Authorization to Hire a Saratoga County
Sheriff’s Deputy for Security during Court Nights, was adopted by vote: Supervisor Thomas Wood - aye, Councilman Fred Drumm –
aye, Councilman Charles Hanehan – aye, Councilwoman Betty Koval – aye, and
Councilman Michael McLoughlin – aye.
Carried 5 – 0.
RESOLVED, by the Town Board of the Town of Saratoga to authorize
the hiring of a Saratoga County Sheriff’s Deputy to provide security during
Town Court for 4 hours on DA Night and 2 hours on regular court nights. They will be paid by voucher at the rate of
$15 per hour from Police Account # A 3120.4 starting May 15, 2007.

#1 of 2007 – amending the Zoning Ordinance of the Town of Saratoga (LL#1 of

At

the Town of Saratoga, the Zoning Ordinance, is hereby amended in the following
respects:
SECTION 1 – BUILDING PERMIT

Article VIII, Section 3
is hereby amended by adding a new Subdivision D as follows:

Fees for Special
Permit Applications: An application for
a special permit for a home occupation or home industry shall be accompanied by
a $200.00 application fee. An
application for a special permit for mining activity shall be accompanied by a
$2,000.00 application fee. All other
applications for a special permit
(If additional space is needed, attach pages the same size as this sheet, and number each.)
shall be accompanied by a $500.00 application fee.
In addition to an application fee, the Planning Board may require the applicant
to pay for engineering costs incurred by the Town for review, consultation and
inspections on behalf of the Town.
SECTION 3 –
PLANNED UNIT DEVELOPMENT FEES
Article X, Section 3(A) is hereby
amended as follows:
A. The owner of the land or agent thereof shall submit an application for a PUD rezoning to the Town Board. An application fee of $3,000.00 shall accompany the application. A sketch plan, drawn to scale, together with a narrative description, shall also accompany the application. The Town Board at its next regularly scheduled meeting may, if it determines the proposal merits review, refer the application with a copy of the sketch/plan to the Planning Board for its review and recommendation within 40 days of the date of the application. Any such referral to the Planning Board should not be construed as an approval of the application. If the Town Board determines that
the proposal does not merit review because it does not meet the purposes of this Article, it shall not refer the application to the Planning Board and no further action on the application shall be taken. The application fee will be refunded to the applicant.
Article X, Section 3(K) is amended as follows:
K. Where any proposed PUD contains residential development, if the Town Board makes a finding that there is a present and anticipated future need for park and recreational facilities for the Town, and further that a suitable park or parks of adequate size cannot be located on such PUD, the Town Board may require a Payment in Lieu of Park Land Fee in the amount of $500.00 per residential dwelling unit. Such fees so collected shall be placed by the town into a trust fund to be used exclusively for park, playground or other recreational purposes, including the acquisition of property.
Article X, Section 4 is amended as follows:
Section
4-Engineering and Legal Fees:
The applicant will be responsible to reimburse the Town for any engineering or legal expenses that are incurred to evaluate the plans and documentation for the PUD. At the time that the preliminary plat is submitted to the Board secretary the applicant shall establish an escrow in the amount of $3,000.00 to cover these costs. All costs of reviewing the application by the Town Counsel, The Town Engineer, and/or an engineering consultant retained by the Planning Board, will be charged against this account. The account shall be administered through the Supervisors Office. A positive balance must be maintained in the account until the project receives final approval and is filed with the County Clerk’s Office. If at any time the cost of the review exceeds the funds available, the applicant will be advised and the review stopped until the escrow is renewed. All funds remaining in the account at the time that the subdivision is filed at the County will be returned to the applicant.
SECTION 4 – ZONING BOARD OF APPEALS FEES
Article XI, Section 6 is amended as follows:
Section 6 – Fees
Applications to the Zoning Board of Appeals for an area or use variance shall be accompanied by a fee of $150.00.
SECTION 5 – TELECOMMUNICATION TOWER FEE
Article IV, Section 7(C)(1)(a), is amended as follows:
A completed application for a special permit, together with an application fee in the amount of $5,000.00.

The Subdivision Regulations
of the Town of Saratoga are hereby amended in the following respects:
SECTION 1 - FEES:
Application Fee (includes advertising fees) - $300.00 for 2
lots; $400.00 for 3 lots; $500.00 for 4 lots
Engineering Escrow Deposit - $500.00 (to hold as a deposit to pay the cost for engineering review, consultation and inspections on behalf of the Town. Any unused portion will be refunded to the applicant. Additional funds required must be paid prior to further consideration of the application).

Major Subdivision
Application Fee (including advertising fees) - $1,000.00 plus $250.00 for each resulting lot.

3. Payment

Construction of Saratoga Country Inn PUD,

WHEREAS, on February 14, 2005, the Town Board of the Town of
Saratoga granted final approval for the Saratoga Country Inn PUD, by amending
the Zoning Ordinance of the Town, and
WHEREAS, Article X, Section 3(J) of the Zoning
Ordinance provides that approval for a PUD development project shall become
null and void if construction has not begun within two years of the Town Board
approval, and
WHEREAS, due to circumstances beyond control of the
owner and applicant, said construction work has not begun as planned, and for
good cause shown to the Town Board, it is therefore
RESOLVED, that there is hereby granted an extension
of time until July 13, 2007 within which construction work must begin for the
Saratoga Country Inn PUD and such construction must be completed on or before
eighteen (18) months of issuance of the first building permit, and it is
further
RESOLVED, that if the aforesaid time limitations are
not met, then the approval for this development project shall become null and
void.

Revolutionary War Heritage Trail Grant – Authorization to Enter into and

RESOLVED, that Thomas
N. Wood III, as Supervisor of the
Town of Saratoga, is hereby
authorized and directed to enter into and execute a project agreement on behalf
of the Town of Saratoga with the
New York State Office of Parks, Recreation and Historic Preservation in
accordance with the provisions of the Heritage New York’s Revolutionary War
Heritage Trail Grant Program Guidelines in the amount of $47,200, for Saratoga Region CRISP.

from LA Group for plans required for the Grant Program Contract between the NYS

aye, Councilman Charles Hanehan – aye, Councilwoman Betty Koval – aye, and
Councilman Michael McLoughlin – aye.

WHEREAS, the Erie Canal Greenway Grant Program contract
between the New York State Canal Corporation and the Town of Saratoga’s
Recreational Trail System Project in the amount of $117,000 requires copies of
plans, specifications, maps, and cost estimates prepared by a professional
licensed in the State of New York; therefore be it
RESOLVED, that the
proposal from the LA Group is accepted for the aforementioned services in the
amount of $39,068 plus miscellaneous expenses pending review and approval by
Town Attorney William Reynolds.
On a motion by Councilman Charles Hanehan and seconded by Councilman Michael McLoughlin, the following Resolution #07-63 – Authorizing the Schuyler Hose Co. to use the turnaround off Hayes Road in Grangerville along Fish Creek to conduct a Fishing Tournament on June 30th, 2007, was adopted by vote: Supervisor Thomas Wood - aye, Councilman Fred Drumm – aye, Councilman Charles Hanehan – aye, Councilwoman Betty Koval – aye, and Councilman Michael McLoughlin – aye. Carried 5 – 0.

Schuyler
Hose Fishing Tournament – questioned if the town owned property by
Roadhouse 29 where some trees were in the creek. Response: Yes they do, but
they cannot disturb the wetlands to get to the trees.
Property
Tax Reform Resolutions – questioned who they were sent to. Response: The Town of Saratoga has passed
the resolution in February and it was distributed to many, including local
municipalities, Saratoga County Board of Supervisors, and to all NYS
legislators representing the County of Saratoga.
Request
that the Town of Saratoga boards (town, planning, and zoning) file financial
disclosures.
Response: The board has reviewed
the county’s form and Town Attorney William Reynolds will research the law and
advise the board on financial disclosure rules.
An
e-mail from the SLA was given to Supervisor Thomas Wood regarding the procedure
for regulating the water levels of Saratoga Lake.
Thanks
to whoever removed the tree at the intersection of DeGarmo Road and Route 29
which has greatly improved the site distance and made a safer
intersection. Response: National Grid
removed the tree. A compliment was
given to the Highway Crew for the clean up of trees on and along the
roadways.
Request
for the status of the Saratoga Farms Subdivision in light of a SEQR procedural
problem.
Response: Preliminary approval
is expected to be rescinded at the next Planning Board Meeting and SEQR review
to continue.
