Supervisor Thomas Wood opened the meeting with the Pledge of Allegiance
at 10:00 a.m.

New Business:
A motion was made by Councilwoman
Betty Koval and seconded by Councilman Charles Hanehan to adopt the following Resolution #08-52 DETERMINATION THAT ACTION TO PURCHASE REAL PROPERTY
FOR USE AS A TOWN HALL IS NOT SUBJECT TO SEQRA REVIEW was adopted by vote: Supervisor Thomas Wood
aye, Councilman Fred Drumm aye, Councilman Charles Hanehan aye,
Councilwoman Betty Koval - aye, Councilman Michael McLoughlin absent Carried 4 0.
WHEREAS, the Town Board
of the Town of Saratoga, Saratoga County, New York (the "Town") has
enacted a certain resolution authorizing a special election to determine
whether the Town should purchase a certain parcel of real property located at
12 Spring St., Schuylerville, NY for use as a new Town Hall (the Action); and
WHEREAS, pursuant to Article 8 of
the Environmental Conservation Law, Chapter 43-b of the Consolidated Laws of
New York, as amended (the "SEQRA Act") and the regulations adopted
pursuant thereto by the Department of Environmental Conservation of the State
of New York ("DEC"), being 6 NYCRR Part 617, as amended (the
"Regulations"), the Town Board as lead agency desires to determine
whether this Action is subject to the review procedure of the SEQRA Act; and
WHEREAS, the Action involves
the purchase of an existing structure;
NOW,
THEREFORE, BE IT RESOLVED BY THE
TOWN BOARD OF THE TOWN OF SARATOGA, SARATOGA COUNTY, NEW YORK AS FOLLOWS:
1. Based on a review of the SEQRA Act, it is determined that the Action
is a Type II action under Section 617.5 of the SEQRA Regulations, and is
therefore not subject to environmental review under the Environmental
Conservation Law.
2. This resolution shall take effect immediately.
The
foregoing resolution was thereupon declared duly adopted.
A motion was made by Councilman
Fred Drumm and seconded by Councilman Charles Hanehan to adopt the following Resolution #08-53 (Amending Resolution #08-46) PURCHASE OF REAL
PROPERTY was
adopted by vote: Supervisor Thomas Wood aye, Councilman Fred
Drumm aye, Councilman Charles Hanehan aye, Councilwoman Betty Koval - aye,
Councilman Michael McLoughlin absent Carried 4 0.
WHEREAS, the Town Board of the Town
of Saratoga, following several years of study and planning, has determined that
there is a need in the Town of Saratoga for a new town hall to house Town
government functions, and
WHEREAS, the Board has determined that the best option to
satisfy this need is to purchase an existing building located at 12 Spring
Street, Schuylerville, NY, for the sum of $4,300,000., and
WHEREAS,
the Board further has determined that it would be in the public interest to
submit this decision to the electors of the Town of Saratoga at a special
election, and
WHEREAS,
at the regular meeting of the Town Board on March 10, 2008 the
Board passed a certain Resolution #08-46 concerning the purchase of said
property, and
WHEREAS, the Board has subsequently
determined that it would be in the best interest of the public to amend said
resolution by lowering the amount the Town intends to finance by the issuance
of municipal bonds, it is now therefore
RESOLVED, that the Town of Saratoga
purchase the real property premises known as 12 Spring Street, Schuylerville,
NY at a price of $4,300,000. to use such property as a town hall, and be it
further
RESOLVED, that the Town issue bond
obligations in the total amount of
$3,200,000.
to help finance said purchase, and be it further
RESOLVED, that a special
election be held in the Town of Saratoga
on Tuesday, April 29, 2008, at which
the polls will be kept open between the hours of Noon and 8:00 p.m., for
the purpose of voting upon the following proposition:
Shall the Town of Saratoga purchase the
real property located at 12 Spring Street, Schuylerville, NY for use as a Town
Hall at a price of $4,300,000, and shall $3,200,000 of such cost be raised by
issuing bonds of the Town?
A motion was made by Councilman
Fred Drumm and seconded by Councilwoman Betty Koval to adopt the following Resolution #08-54 (Amending Resolution #08-47) SPECIAL ELECTION was
adopted by vote: Supervisor Thomas Wood aye, Councilman Fred
Drumm aye, Councilman Charles Hanehan aye, Councilwoman Betty Koval - aye,
Councilman Michael McLoughlin absent
Carried 4 0.
WHEREAS, the Town Board of the Town
of Saratoga has duly enacted a Resolution #08-47 on March 10, 2008, setting
forth a referendum question to be placed before the electors of the Town of
Saratoga concerning the purchase of real property located at 12 Spring Street,
Schuylerville, NY, and
WHEREAS,
the Board has subsequently determined that it would be in the best interest of
the public to amend said resolution by lowering the amount the Town intends to
finance by the issuance of municipal bonds,
WHEREAS, Section 82 of the Town Law
requires the Board to adopt a resolution designating the date, time and place,
for conducting a special election and setting forth the proposition to be voted
upon, it is now therefore
RESOLVED, that a special election
will be held in the Town of Saratoga on Tuesday, April 29, 2008, at which the polls will be kept open between the
hours of Noon and 8:00 p.m., for the purpose of voting upon the following
proposition:
Shall the Town of Saratoga purchase the
real property located at 12 Spring Street, Schuylerville, NY for use as a Town
Hall at a price of $4,300,000, and shall $3,200,000 of such cost be raised by
issuing bonds of the Town?
The polling
places for such election will be as follows:
Districts 1 and 2 at Saratoga
Town Hall, 30 Ferry Street, Schuylerville, NY
Districts 3 and 5 at Quaker
Springs Fire House, 107 Blodgett Road, Schuylerville, NY
District 4 at Village of
Victory Village Hall, 23 Pine Street, Victory Mills, NY
All
legal residents of the Town of Saratoga, 18 years of age and over, shall be
qualified to vote at such special election.
A motion to adjourn at 10:55 a.m. was made by Councilman Charles Hanehan
and seconded by Councilman Fred Drumm. Supervisor Thomas Wood aye, Councilman Fred Drumm aye, Councilman Charles Hanehan aye, Councilwoman Betty Koval - aye, Councilman Michael McLoughlin absent. Carried 4 0.
