OF APPEALS MINUTES
June 25, 2007

Chairman
Stephen Bodnar called the meeting to order at 7:30 p.m. and led the flag
salute.
Chairman
Stephen Bodnar explained the Rules of the
Board.
Due
to Clerk Catherine Cicero’s resignation, Chairman Stephen Bodnar
recognized
Linda McCabe as the newly appointed Zoning Clerk. Chairman Stephen Bodnar also
recognized Catherine Cicero for all her hard work.
Zoning
Clerk Linda McCabe called the roll: Chairman Stephen Bodnar – present, Clifford
Hanehan – absent, Thomas Carringi – absent, Barbara Faraone – present, Joyce
Waldinger – absent, Bill Moreau – absent, James Burke – present, and Alternate
Clarence Fosdick – present.
Also
present: Town Clerk Ruth Drumm, Town Attorney William Reynolds and Town Zoning
Officer Robert Hathaway.
Due
to the absences of regular board members, Chairman Stephen Bodnar recognized
Alternate Clarence Fosdick as eligible to vote.
Approval
of Minutes: All board members present had read the minutes of the April 23,
2007 meeting. James Burke, seconded by
Barbara Faraone, made a motion to accept the minutes of the April 23, 2007
meeting as written. Chairman
Stephen Bodnar–aye, James Burke–aye, Barbara Faraone–aye and Clarence
Fosdick-aye.

Applicant John Hayes
addressed the Board seeking a 50’ road frontage variance and a sideline
variance of 26’ in order to meet zoning regulation requirements. He wants to replace the existing singlewide
mobile home with a 28’ x 76’ doublewide mobile home for his son. After a lot
line adjustment granted by the Planning Board, he increased his acreage from
2.1 acres to 3.21 acres. He has 200’ of
frontage with his lot and 150’ with his son’s lot once subdivided, which leaves
him lacking 50’ of road frontage and the need of a 26’side variance. He has not yet had it surveyed, but hopes to
have that completed within 2 weeks. Applicant presented photos to the board of
the demolition of the single mobile home that was on site.
Chairman Stephen Bodnar read
the Saratoga County Planning Board’s letter stating their approval and that
there would be no significant county wide or inter community impact.
After providing the Proof of
Notice in The Saratogian on June 14, 2007, Chairman Stephen Bodnar
opened the Public Hearing. No one came forward.
The Board discussed whether
to require a survey before approval. Town Attorney William Reynolds stated that
approval could be subject to review of the deed to confirm dimensions as
presented.
Barbara Faraone made a motion, seconded by James
Burke, to grant a 50’ frontage variance and a 26’ sideline setback variance.
The plan presented will improve the property.
Approval granted conditioned on Town Attorney William Reynolds’ review
of the survey or deed.

Melvin Ikler, Applicant #07-08

Mr. Ikler’s architect, Mike Roth, addressed the Board seeking a 41’ front variance and a combined sideline variance of 32.5’ in order to demolish his current home to build a new, larger, year round home on a private road to meet zoning regulations. In the front, the house is 9’ off the property line. He wants to put new house with an open porch on that same line which requires the 41’ front variance. The new house will be narrower than the existing house. This will increase both side setbacks, (west side to 6’, east side to 11.5’) but still won’t meet the required side setback of 20’ and 50’combined. To do this Mr. Ikler is asking for a combined 32.5’ side variance. Lot coverage with garage is 12.6%, below the maximum 15% allowed. A neighbor petition with ten signatures stating they have no objection to the proposal was presented to the Board (one neighbor, 4 doors down on corner, did not sign). The petition has been included in the permanent file of this application.

questioned why he’s replacing the home.
Mr. Roth replied that it was used as a summer home but Mr. Ikler wants
to move here from Albany, NY and the current house needs repairs to become a
year round home. Chairman Stephen
Bodnar questioned if the house will be a 2-story structure and Mr. Roth
answered only in the back section. Mr.
Roth presented a photo of the house to Chairman Stephen Bodnar. Chairman Stephen Bodnar asked for the square
footage of the new house and Mr. Roth answered 1928’ without garage and an
additional 3600’ with second story.
Barbara Faraone commented this is on a flood plain and Mr. Roth said its
3’ above. Chairman Stephen Bodnar
questioned who maintains the private road?
Mr. Ikler responded the homeowners do. Chairman Stephen Bodnar has
concerns of fire hazards due to the structure size, the narrow road and houses
that are too close together. They are making the house less wide to give more
of a side lot set back, which is an improvement.
Clarence Fosdick made a motion, seconded by Barbara
Faraone, to grant the 41’ front variance, the 32.5’ combined sideline
variance. It will improve the side set
backs and the front set back remains the same. Chairman
Stephen Bodnar-aye, Barbara Faraone-aye, James Burke-aye, Clarence
Fosdick-aye. Carried 4-0 Granted.
Old Business: None
New Business: Clarence Fosdick asked if it would be
suitable to present his map at end of next meeting for Board input. Chairman Stephen Bodnar agreed.
Chairman Stephen Bodnar made a motion to adjourn the
meeting at 8:35 p.m. and seconded by Barbara Faraone. Chairman
Stephen Bodnar-aye, Barbara Faraone-aye, James Burke-aye, Clarence
Fosdick-aye. Carried 4-0.
