ZONING BOARD OF APPEALS MINUTES

January 22, 2007

7:30 PM

 

Chairman Stephen Bodnar called the meeting to order at 7:30 p.m. and led the flag salute.

 

Chairman Stephen Bodnar explained the Rules of the Board. 

 

Zoning Clerk Catherine Cicero called the roll: Chairman Stephen Bodnar – present, Clifford Hanehan – absent, Thomas Carringi – present, Barbara Faraone – absent [Ms. Faraone arrived at 7:49 p.m.], Joyce Waldinger – present, Bill Moreau – absent, James Burke – present, and Alternate Clarence Fosdick – present. 

Also present: Town Zoning Officer Robert Hathaway.

 

Due to the absence of several members of the Board, Chairman Stephen Bodnar recognized Alternate Clarence Fosdick as eligible to vote.

 

Approval of Minutes: All board members present had read the minutes of the September 25, 2006 meeting. A motion was made by Chairman Stephen Bodnar, and seconded by Thomas Carringi, to accept the minutes of the September 25, 2006 meeting as written.  Chairman Stephen Bodnar – aye, Thomas Carringi – aye, Joyce Waldinger – aye, James Burke – aye, and Clarence Fosdick – aye.

Order of Business:

AREA VARIANCE

Applicant requests a side variance of 12 feet in order to put an addition to the kitchen and dining room on her house. Applicant was previously granted a variance of 16’ due to the situation of her house on her property. Public Hearing

 

Ms. Hall and Denis Sheeran appeared before the Board, presenting a sketch of the proposed addition and copies of letters from neighbors stating that they had no objection to the addition.  The letters have been added to the permanent file of this application.

 

In answer to a question from Joyce Waldinger, Ms. Hall explained that the existing deck will be removed to make space for the kitchen addition.  The new dimensions will be less than that of the current deck.

Ms. Hall said that the porch will remain because the porch roofline is a part of the house.  The addition will be single story.

 

 

 

 

Joyce Waldinger noted that, due to the way the neighboring house is situated on its lot, there will be no hindrance to that house.  The neighbor’s house is 60-70’ from the property line.

 

Ms. Hall clarified that the lot size is 2.008 acres in size and submitted a copy of her deed.  Chairman Stephen Bodnar said that he did not see anything on the deed that would prevent the addition.

 

Zoning Officer Robert Hathaway said that he did not see any problem with granting the variance.

 

Proof of notice having been furnished by newspaper on January 12, 2007, Chairman Stephen Bodnar opened the Public Hearing at 7:40 p.m. for public comment.  There were no interested parties; the Public Hearing was closed.

 

Thomas Carringi made a motion, seconded by James Burke, to grant a variance of 12’ on the left side of the house for an addition.  Chairman Stephen Bodnar – aye, Thomas Carringi – aye, Joyce Waldinger – aye, James Burke – aye, and Clarence Fosdick – aye.

Carried 5 – 0 

 

Old Business: There was a brief discussion on the additional language in the Zoning Board of Appeal applications regarding deed restrictions.  Applicants must divulge to the Board the existence of any deed restrictions, easements, or covenants to their property that could effect the granting of a requested variance.

 

[Barbara Faraone arrived at 7:49 p.m.]

 

Chairman Stephen Bodnar reminded the Board members that the State and the Town have passed laws requiring all members of Planning and Zoning Boards to have a minimum of 4 hours of training each year in order to remain on their boards.  There followed a brief discussion on the required training and on the County’s January seminar for Planning and Zoning.

 

Chairman Stephen Bodnar reported that the ZAAC amendments are moving forward.

 

New Business: None

 

The next regular meeting will be February 26, 2007 at 7:30 p.m.

 

Chairman Stephen Bodnar made a motion to adjourn at 8:12 p.m.  The motion was seconded by Barbara Faraone.  Chairman Stephen Bodnar – aye, Thomas Carringi – aye, Joyce Waldinger – aye, James Burke – aye, Barbara Faraone – aye, and Clarence Fosdick – aye.
