Applicant is seeking an area (height) variance to build a 3-story home with a height of 42 at 1374 Rt. 9P. Duane Rabideau, of Gilbert VanGuilder, Land Surveyor, addressed the Board, stating that, two years ago the Applicant was approved a variance to erect a two-story home on the same lot. Due to flood plain constraints, the Applicant is unable to use the first floor as living space, and proposes to add a third story to the structure, using the lowest floor as a garage/storage area. He also presented the Board with statements from the Applicants neighbors, saying they had no objections to the proposed structure. Chairman Bodnar voiced concern over the magnitude of the variancea 40% increaseas well as fire safety issues.
Proof of Notice having been furnished, Chairman Stephen Bodnar opened the Public Hearing: Ed Dweck spoke against granting the variance.
Robert McConnell made a motion, seconded by Thomas
Carringi, to table the application until the next meeting after more
information can be obtained. Chairman Stephen Bodnar

Applicant is seeking an area variance to build a garage outside the original footprint. The plans would take the third story with normal roofline and make a two-story home with garage. Applicant requests 16 variance on the front, and 7 variance on the back.
Richard Oliver and Brian Hall explained to the Board that, by removing the third story of the existing structure and adding a two-story garage, the house would be more salable and less objectionable to the neighbors. Chairman Stephen Bodnar noted that the County had responded to the application by asking for more information, including a plot plan.
Proof of Notice having been furnished, Chairman Stephen Bodnar opened the Public Hearing: The following people spoke against granting the variance:
V.J. Bachmann, Esq., representing Muriel Massiah
David Lord, Wilton, NY
Hermina. Clemente, 1243 Rte 9P, Saratoga Springs, NY
