Supervisor Thomas Wood opened the meeting with the Pledge of Allegiance

at 7:30 p.m.

 

Roll call: Ruth Drumm, Town Clerk, called the roll.  Supervisor Thomas Wood- present, Councilman Bruce Cornell - present, Councilman Michael McLoughlin – present, Councilman Fred Drumm- present and Councilman Charles Hanehan- present.

Also present: Highway Superintendent Grant Seymour, Assessor/Bookkeeper Catherine DeFelice, Jean Casey, Town Attorney William Reynolds, Zoning Officer Robert Hathaway, Bob and Peg Hall, George Sullivan, Patricia Pierce, Justice Jack Ditch, Margaret Ditch, David and Lisa Lord, Veronica Wood, Sean Kelleher, Pat Peck, Dan Craine, Richard Behrens, Geraldine Friedman, and Kathleen Bartholomay.   

 

Supervisor Thomas Wood recognized retiring Supervisor Robert Hall, Town Clerk Jean Casey, and Councilman Philip Griffen for their many years of dedicated service to the town with framed Recognition Resolutions #04-37, 04-38 and 04-39, respectively, which he read and presented to Robert Hall and Jean Casey.  Philip Griffen could not attend and his plaque will be delivered to him. ORGANIZATIONAL APPOINTMENTS AND DESIGNATIONS:

Resolution #04-01, setting the “Rules of the Board” was read by Supervisor Thomas Wood.  A motion to adopt the ”Rules of the Board” was made by Supervisor Thomas Wood and seconded by Councilman Michael McLoughlin. Supervisor Thomas Wood – aye, Councilman Fred Drumm – aye, Councilman Michael McLoughlin – aye, Councilman Bruce Cornell – aye, and Councilman Charles Hanehan - aye.  Carried 5 – 0.

Resolution #04-02, setting the meeting time and place for Town Board meetings as the 2nd Monday of the month, at 7:30 p.m. at the Town Hall, 30 Ferry Street, Schuylerville was read by Supervisor Thomas Wood.  A motion was made by Councilman Fred Drumm to adopt Resolution #04-02 and was seconded by Councilman Bruce Cornell. Supervisor Thomas Wood – aye, Councilman Fred Drumm – aye, Councilman Michael McLoughlin – aye, Councilman Bruce Cornell – aye, and Councilman Charles Hanehan - aye.  Carried 5 – 0.

 

 

Resolution # 04-03, designating the Glens Falls National Bank & Trust Company

as the official bank depository was read by Supervisor Thomas Wood.  A motion was made by Councilman Fred Drumm to adopt Resolution #04-03 and was seconded by Councilman Bruce Cornell. Supervisor Thomas Wood – aye, Councilman Fred Drumm – aye, Councilman Michael McLoughlin – aye, Councilman Bruce Cornell – aye, and Councilman Charles Hanehan - aye.  Carried 5 – 0.

 

Resolution # 04-04, designating The Saratogian as the official newspaper for the Town, was read by Supervisor Thomas Wood.  A motion was made by Councilman Fred Drumm to adopt Resolution #04-04 and was seconded by Councilman Charles Hanehan.  Resolution # 04-05, authorizing the Supervisor to invest idle cash balances was read by Supervisor Thomas Wood.  A motion was made by Councilman Fred Drumm to adopt Resolution #04-05 and was seconded by Councilman Bruce Cornell. Supervisor Thomas Wood – aye, Councilman Fred Drumm – aye, Councilman Michael McLoughlin – aye, Councilman Bruce Cornell – aye, and Councilman Charles Hanehan - aye.  Carried 5 – 0.

 

Resolution # 04-06, authorizing the Supervisor to submit claims for state aid for youth recreation programs was read by Supervisor Thomas Wood.  A motion was made by Councilman Michael McLoughlin to adopt Resolution #04-06 and was seconded by Councilman Charles Hanehan. Supervisor Thomas Wood – aye, Councilman Fred Drumm – aye, Councilman Michael McLoughlin – aye, Councilman Bruce Cornell – aye, and Councilman Charles Hanehan - aye.  Carried 5 – 0.

 

Resolution # 04-07,authorizing the Supervisor to execute & pay contracts & annual appropriations as provided in the budget was read by Supervisor Thomas Wood.  A motion was made by Councilman Michael McLoughlin to adopt Resolution #04-07 and was seconded by Councilman Charles Hanehan. Resolution # 04-08, approving the salaries & highway scale of wages as set forth in the 2004 budget was read by Supervisor Thomas Wood.  A motion was made by Councilman Fred Drumm to adopt Resolution #04-08 and was seconded by Councilman Michael McLoughlin. Resolution # 04-09, appointing the Supervisor as health insurance administrator was read by Supervisor Thomas Wood.  A motion was made by Councilman Fred Drumm to adopt Resolution #04-09 and was seconded by Councilman Charles Hanehan. Resolution # 04-10, authorizing the Supervisor to pay bills of utility, fuel, gas, oil & any discounted bills without prior audit and providing that bills are presented at first available meeting for audit was read by Supervisor Thomas Wood.  A motion was made by Councilman Fred Drumm to adopt Resolution #04-10 and was seconded by Councilman Bruce Cornell. Resolution # 04-11, authorizing the Highway Superintendent to spend/purchase up to $1,500 without prior notice to town board was read by Supervisor Thomas Wood.  A motion was made by Councilman Fred Drumm to adopt Resolution #04-11 and was seconded by Councilman Michael McLoughlin. Resolution # 04-12 appointing Marshal Truax as Dog Control Officer was read by Supervisor Thomas Wood.  A motion was made by Councilman Michael McLoughlin to adopt Resolution #04-12 and was seconded by Councilman Bruce Cornell. Resolution # 04-13, authorizing the attendance of the following Town Officers at The Association of Town’s meeting, February 15-18, 2004: Supervisor Thomas Wood, Councilman Michael McLoughlin, Councilman Fred Drumm, Councilman Charles Hanehan, Town Justice Jack Ditch, Town Attorney William Reynolds, Assessor Catherine DeFelice, and Town Clerk Ruth Drumm was read by Supervisor Thomas Wood.  A motion was made by Councilman Fred Drumm to adopt Resolution #04-13 and was seconded by Councilman Michael McLoughlin. Resolution # 04-14, appointing Supervisor Thomas Wood as delegate and Councilman Michael McLoughlin as alternate to the Association of Towns’ meeting was read by Supervisor Thomas Wood.  A motion was made by Councilman Fred Drumm to adopt Resolution #04-14 and was seconded by Councilman Charles Hanehan. Resolution # 04-15, setting the mileage rate for actual town business as 37 ½ cents was read by Supervisor Thomas Wood.  A motion was made by Councilman Fred Drumm to adopt Resolution #04-15 and was seconded by Councilman Bruce Cornell. Resolution # 04-16, authorizing the assessor to employ clerical help, Marie Foster, within the budget was read by Supervisor Thomas Wood.  A motion was made by Councilman Fred Drumm to adopt Resolution #04-16 and was seconded by Councilman Charles Hanehan. Resolution # 04-17, setting the election rates to $80 for a Primary and $135 for a General Election was read by Supervisor Thomas Wood.  A motion was made by Councilman Michael McLoughlin to adopt Resolution # 04-17 and was seconded by Councilman Bruce Cornell. Resolution # 04-18, appointing William Reynolds as the Town Attorney was read by Supervisor Thomas Wood.  A motion was made by Councilman Michael McLoughlin to adopt Resolution #04-18 and was seconded by Councilman Charles Hanehan. Resolution # 04-19, appointing the Building Inspector/Code Enforcement Officer as Robert Hathaway was read by Supervisor Thomas Wood.  A motion was made by Councilman Michael McLoughlin to adopt Resolution #04-19 and was seconded by Councilman Bruce Cornell. Resolution # 04-27, appointing a new member, David Hall, to fill a vacancy (Tom Wood’s term 01/01/2004 - 12/31/2006) was read by Supervisor Thomas Wood.  A motion was made by Councilman Fred Drumm to adopt Resolution #04-27 and was seconded by Councilman Michael McLoughlin. Resolution # 04-28, appointing James Burke as an alternate for the Zoning Board (new position, term 01/01/2004 – 12/31/2008) was read by Supervisor Thomas Wood.  A motion was made by Councilman Fred Drumm to adopt Resolution #04-28 and was seconded by Councilman Bruce Cornell. Planning Board – (7 –year terms)

 

Supervisor Thomas Wood read with regret the resignation dated January 6, 2004 of Chairman Bourne Rigano of the Planning Board. He thanked him for his many years of dedicated service to the town.  A motion was made by Supervisor Thomas Wood to accept the resignation of Bourne Rigano as Chairman and member of the Planning Board with regret and was seconded by Councilman Charles Hanehan. Supervisor Thomas Wood – aye, Councilman Fred Drumm – aye, Councilman Michael McLoughlin – aye, Councilman Bruce Cornell – aye, and Councilman Charles Hanehan - aye.  Carried 5 – 0.

 

Resolution # 04-29, appointing Ian Murray as chairman of the Planning Board was read by Supervisor Thomas Wood.  A motion was made by Councilman Michael McLoughlin to adopt Resolution #04-29, and was seconded by Councilman Bruce Cornell. Resolution # 04-30, appointing Laurie Griffen to fulfill Bourne Rigano’s term 01/01/2004 – 12/31/2006 was read by Supervisor Thomas Wood.  A motion was made by Councilman Michael McLoughlin to adopt Resolution #04-30 and was seconded by Councilman Charles Hanehan. Approval of Minutes: A motion was made by Councilman Fred Drumm and seconded by Councilman Michael McLoughlin to accept the minutes of December 8th and 29th, 2003 meetings as written. Supervisor Thomas Wood - abstained, Councilman Fred Drumm – aye, Councilman Michael McLoughlin – aye, Councilman Bruce Cornell – aye, and Councilman Charles Hanehan - abstained.  Carried 3 – 0.  (Since Supervisor Wood and Councilman Hanehan were not in office at the time of the December meetings and did not participate in those meetings they chose to abstain from voting.)

 

Town Clerk’s report for December 2003: fees paid to the County Treasurer for Dog Licenses $29.37. Fees paid to the NYS Dept. of Agriculture and Markets for the spay/neuter program $6.00. Fees paid to New York D.E.C. for hunting and fishing licenses $334.74. Fees paid to the New York State Health Department for Marriage licenses $45.00. Dog license fees to Supervisor Thomas Wood $85.63. Clerk fees to Supervisor Thomas Wood $77.76. Total State, County, and Local Revenues received were $578.50.

 

Zoning Officer’s report: Bob Hathaway read his December’s report: 6 CO’s, 4 Building Permits, 1 septic permit and 1 sign permit were issued, and 19 inspections were done.  A check for $501.00 was given to Supervisor Thomas Wood.  Councilman Michael McLoughlin asked who received the sign permit and Bob replied it was issued to The Tint Wizard. Councilman McLoughlin also commented on a complaint about the number of unlicensed vehicles in the yard of the former Traver gas station in Quaker Springs, which is now leased to a car painting business.  Bob Hathaway said he would look into the situation.

 

 

 

 

 

 

 

 

 

 

 

Supervisor’s report: Supervisor Thomas Wood read his State of the Town Address. (This address is available in full text in the 2004 Minutes Appendix in the Town Clerk’s Office.)

 

Supervisor Thomas Wood presented December 2003 balances in Town funds as follows: General A $359,225.07, General B $40,922.68, Highway Outside $398,174.48, Youth Recreation & Services $822.72, Highway Equipment Reserve

$130,458.54, Building Reserve $784,419.24 and Fire Protection $0.03.  December revenues were $105,609.57 and expenses were $169,291.75.  The total December balance is $1,713,146.47.

 

Highway: Highway Superintendent Grant Seymour reported that he would like to order, as budgeted and on State contract, a new New Holland Backhoe Loader and a new Crew Cab Dump Truck.   The board agreed since the money is in the budget and the items are part of the scheduled replacement plan for machinery.  He also requested to put out for bid the purchase of a new Rotary Mower and tractor once he draws up the specifications for them and he would like to purchase a used bucket truck.  The board agreed that he should go forward with those items also.  

 

Town Attorney Bill Reynolds stated that the town has not received the deed to the road at the Eagle’s Roost II Development on Casey Road and County Road 69 and that due to liability concerns the town should discontinue plowing the road since it is private property.  He felt that we should have a contract or deed before going there.  A motion was made by Supervisor Thomas Wood to discontinue plowing the road at Eagles Roost II, effective January 16, 2004, until title for the highway is passed to the Town. Councilman Fred Drumm seconded the motion. Supervisor Thomas Wood – aye, Councilman Fred Drumm – aye, Councilman Michael McLoughlin – aye, Councilman Bruce Cornell – aye, and Councilman Charles Hanehan - aye.  Carried 5 – 0.  Town Attorney Bill Reynolds will send a letter to Whibco and Grant Seymour, Highway Superintendent will notify Chuck Waldron of C&S Construction of our intention not to plow until the deed is received.

Park Committee report: Councilman Michael McLoughlin made a motion at 8:40 p.m. to go into Executive Session to discuss the acquisition of real property for a park. This motion was seconded by Councilman Bruce Cornell.  Supervisor Thomas Wood – aye, Councilman Fred Drumm – aye, Councilman Michael McLoughlin – aye, Councilman Bruce Cornell – aye, and Councilman Charles Hanehan - aye.  Carried 5 – 0.

The regular meeting was reconvened at 8:45 p.m. 

 

Resolution #04-40 was introduced by Councilman Michael McLoughlin and seconded by Councilman Bruce Cornell to hire a Wetlands Specialist to do a wetlands study on the sites being considered for a Town Park with the total expenditure for these services not to exceed $450.00. Supervisor Thomas Wood – aye, Councilman Fred Drumm – aye, Councilman Michael McLoughlin – aye, Councilman Bruce Cornell – aye, and Councilman Charles Hanehan - aye.  Carried 5 – 0.

 

Town Attorney William Reynolds advised the board that he has not yet received the deed for the Quaker Springs Mineral Springs property and he asked if Councilman Michael McLoughlin could check with Attorney Trevor Coulter on the status of this.  Councilman McLoughlin agreed to check into it.

 

Cable TV Committee: Councilman Fred Drumm stated that no real progress has been made and that we have another month before we need to extend the contract for another 6 months.  Supervisor Thomas Wood commented that the County did not approve money for training on cable franchise negotiating.  A list of items to bargain for is being made.  Kathleen Bartholomay suggested that we contact Sue Buske who is an expert in negotiating these contracts.  Supervisor Thomas Wood said that through Jackie Pardon we would contact Sue Buske to see what she could do for us and what it would cost.

  

Old Business: None.

 

New Business: Resolution #04-35, authorizing a Blanket Official Undertaking for Town Officers as provided by Policy number B-175385 issued by the Selective Ins. Co. was introduced by Councilman Fred Drumm and seconded by Councilman Charles Hanehan. Supervisor Thomas Wood – aye, Councilman Fred Drumm – aye, Councilman Michael McLoughlin – aye, Councilman Bruce Cornell – aye, and Councilman Charles Hanehan - aye.  Carried 5 – 0.  (Full text of this resolution is in the 2004 Resolution Book in the Town Clerk’s Office.)  Supervisor Thomas Wood explained that we have had this insurance on town officers and that we are just formally adopting this resolution that provides coverage in the event of the failure of town officers to faithfully perform their duties or to account for all moneys or property received by them by virtue of their positions, and for their fraudulent or dishonest acts. 

 

 

 

 

 

 

Resolution #04-36, authorizing a transfer of funds from A200.1 account to the A210.1 account, establishing a Town Clerk’s Petty Cash Change Fund in the amount of $50.00 was introduced by Councilman Bruce Cornell and seconded by Councilman Michael McLoughlin. Supervisor Thomas Wood – aye, Councilman Fred Drumm – aye, Councilman Michael McLoughlin – aye, Councilman Bruce Cornell – aye, and Councilman Charles Hanehan - aye.  Carried 5 – 0.

 

Communications: Supervisor Thomas Wood read a letter from The State of New York Department of Agriculture and Markets informing us that our FY 2003/2004 Agricultural and Farmland Protection Implementation Grants application was not selected for funding. Thirty-five applications were received and only sixteen were selected. (A copy of this letter will be in the 2004 Minutes Appendix.)

 

Supervisor Wood also read a letter from Jerry Rosenbrock, Proprietor of Lois Lanes, of his intent to renew his alcoholic beverage license for the bowling alley known as Lois Lanes at 116 Broad Street, Schuylerville, serving beer only.

 

Councilman Bruce Cornell mentioned that the Friends of the Battlefield would be holding a fundraiser in April, which is “March for Parks”. 

 

Privilege of the floor: David Lord of 1241 Route 9P, Saratoga Springs, commented on the possible major financial burden to the taxpayers of the town if the City of Saratoga Springs succeeds in using Saratoga Lake as a public water source. He stated that he would like to see the Town Board of the Town of Saratoga assume the role of an “involved agency” with respect to the SEQR process for the proposed project. David Lord gave each board member a copy of his letter.

 

Robert Hall added that the county has acted on this as a group on our behalf to stop Saratoga Lake from becoming a reservoir.

 

Lisa Lord of Fairway Boulevard, Gansevoort and 1241 Route 9P, Saratoga Springs, spoke against the City of Saratoga Spring’s proposed plan to use Saratoga Lake as a public water source and she mentioned that the Town was not identified as an agency in regards to the SEQR process on the project.  Mayor of Victory, George Sullivan, commented that since Fish Creek goes through the Village of Victory he is also interested in being involved. 

 

Supervisor Thomas Wood stated that he would check with the County and see based on their actions where that leads us.

 

Jean Casey thanked Robert Hathaway for encouraging her to come to work for the Town of Saratoga as Deputy Town Clerk under Joyce Ryan twenty- one years ago. 

 

Supervisor Thomas Wood announced that the next regular board meeting would be held February 9th, 2004.

 

 

 

Audit the Bills: Per abstract for the period 1/12/2004 to 1/12/2004 (1G): General A $5,568.23, General B $266.50, Highway Outside $7,771.62, and Building Reserve $707.69, for a total expense of $14,314.04.

 

Audit the Books of Town Officers.  Justice Jack Ditch presented the board with an annual report for 2003 of the court and his books.  Justice Jack Ditch reported that the court had implemented many improvements over the past year including becoming computerized and instituting a Youth Court.

 

A motion to adjourn at 10:05 p.m. was made by Councilman Fred Drumm and seconded by Councilman Michael McLoughlin.
