Supervisor Thomas Wood opened the meeting with the Pledge of Allegiance
at 9:10 a.m.
Roll
call: Ruth Drumm, Town Clerk, called the roll.
Supervisor Thomas Wood- present, Councilman Fred Drumm- present,
Councilman Charles Hanehan- present, Councilwoman Betty Koval present,
Councilman Michael McLoughlin absent
Also present: Town Attorney William Reynolds
New Business:
The board reviewed the report
by Town Engineer Kenneth Martin regarding the building of Calvin Gongs at 1390
Route 9P that is leaning and in danger of collapsing.
A motion by Councilman
Charles Hanehan and seconded by Councilman Fred Drumm to adopt the following Resolution #08-42 - Calvin Gong, 1390 Rt.
9P property Unsafe Structure was adopted by vote: Supervisor Thomas Wood
aye, Councilman Fred Drumm aye, Councilman Charles Hanehan aye,
Councilwoman Betty Koval - aye, Councilman Michael McLoughlin absent Carried 4 0.
WHEREAS, the Town Engineer, Kenneth Martin, has submitted a
report to the Town Board concerning property located at 1390 Route 9P in the
Town of Saratoga owned by Calvin Gong, and
WHEREAS, said report concludes that the aforesaid property
located at 1390 Route 9P located in the Town of Saratoga is in imminent danger
to life, safety or health within the meaning of Section 182-4 of the Town
Code, unless such building is immediately repaired, secured or demolished, it is now therefore
RESOLVED,
that the Building Inspector, with the advice and consent of the Town Board, be
authorized to immediately repair or demolish, as may be reasonably necessary,
the property at 1390 Route 9P, in order to remove the safety hazard which
exists thereon, and it is further
RESOLVED,
that the cost of contracting such work be charged against the premises, and be
levied and collected as an additional Town property tax.
On a motion by Councilman
Fred Drumm and seconded by Councilwoman Betty Koval the following Resolution
#08-43 - Calvin Gong, 1390 Rt. 9P property Court Action was adopted by
vote: Supervisor Thomas Wood

Councilwoman Betty Koval - aye, Councilman Michael McLoughlin absent Carried 4 0.
RESOLVED,
that the Town Board of the Town of Saratoga authorizes Town Attorney William
Reynolds to initiate court action against Calvin Gong due to his
failure to comply with the Order to Remedy issued on
January 30, 2008 by Zoning Officer Gil Albert regarding his property at 1390
Route 9P.
On a motion by Councilman
Fred Drumm and seconded by Councilwoman Betty Koval the following Resolution
#08-44 Professional Services Bonding
was adopted by vote: Supervisor Thomas Wood aye, Councilman Fred
Drumm aye, Councilman Charles Hanehan aye, Councilwoman Betty Koval - aye,
Councilman Michael McLoughlin absent
Carried 4 0.
RESOLVED,
that the Town Board of the Town of Saratoga authorizes hiring Lemery Greisler
LLC, Attorneys at Law, to be the bond counsel for the legal work necessary for
the bonding for a new town hall.
Payment in accordance with their quote will not exceed $9,000.
