Supervisor Thomas Wood opened the meeting with the Pledge of Allegiance
at 7:00 p.m.
Roll call: Ruth Drumm, Town Clerk,
called the roll. Supervisor Thomas
Wood- present, Councilman Fred Drumm - present, Councilman Charles Hanehan-
present, Councilwoman Betty Koval - present, and Councilman Michael McLoughlin
– absent.

Recognitions/Presentations/ Bid openings/ Public Hearings:
Recognitions: Supervisor Thomas Wood and the board commended the Schuylerville Garden Club for all their beautification efforts in the Town and in the Villages of Schuylerville and Victory. The framed resolution was presented to President Kathleen Turcotte with members Patti Nichols, Ester Blair and Joy Griffen also attending. On a motion by Supervisor Thomas Wood and seconded by Councilman Fred Drumm the following resolution was adopted by vote: Supervisor Thomas Wood - aye, Councilman Fred Drumm – aye, Councilman Charles Hanehan – aye, Councilwoman Betty Koval – aye, and Councilman Michael McLoughlin – absent. Carried 4 – 0.
Whereas, the Schuylerville Garden Club was organized in 1938
and federated in 1951 and
Whereas, the Schuylerville garden Club consists of 31 active,
highly dedicated members and
Whereas, the objectives of the Schuylerville Garden Club are
to stimulate a knowledge and love of gardening, to enhance the study of flower
arrangements and horticulture, to promote conservation, and to encourage
beautification in the community and
Whereas, each year the Schuylerville Garden Club plans,
plants, and cares for flowers in containers, in ground squares, and at
municipal buildings, the visitors center, pocket parks, and the Route 29
triangle and
Whereas, each year the Schuylerville Garden Club presents red
geraniums to spouses or mothers of active service men and women on Flag Day and
Whereas, each year the Schuylerville Garden Club donates a
gardening book and sets up a display at the Schuylerville Public Library during
National Gardening Week and
Whereas, the Schuylerville Garden Club plants spring flowers
and makes winter holiday center pieces
for the seniors at Morgan’s Run and
Whereas, the Schuylerville Garden Club plants spring flowers
with preschoolers each Mother’s Day and
Whereas, the Schuylerville Garden Club sponsors a student to
the NYS DEC summer camp and
Whereas, each year the Schuylerville Garden Club provides a
scholarship to a BOCES Horticulture student and
Whereas, the Schuylerville Garden Club provides flowers for
the SCS High School Graduation Ceremony and
Whereas, each winter the Schuylerville Garden Club provides
wreaths to municipal buildings in Schuylerville, Victory, and the Town and
Whereas, each spring the Schuylerville Garden Club sponsors
an annual spring plant sale and
Whereas, each July the Schuylerville Garden Club sponsors a
two day Flower Show, now therefore be it
Resolved, that the
Town Board of the Town of Saratoga does hereby recognize and honor to the
highest degree possible all of the members of the Schuylerville Garden Club for
their service to the Town of Saratoga and Villages of Schuylerville and
Victory, and be it further
Resolved, that the Town of Saratoga continues to encourage and
vigorously supports the Schuylerville Garden Club and their efforts.
Presentation: Kate Leone presented a Sand Sculpture
project to
the town board.
The
project would build a French and Indian War attraction sculpted in sand. The attraction would bring tourism,
commerce, and media attention to the village, while raising funds to provide
summer employment for the youth through the Greater Schuylerville Youth
Program. She added that she will be
presenting this project to the Village of Schuylerville in the near future and
hopes to locate the sculpture behind the Visitor Center and adjacent to the
Youth Center on the Fort Hardy Park grounds from July 1 through Labor Day
2007. Admission will be charged and
sponsors will be sought.
Public Hearings: Supervisor Thomas Wood read Local Law #6 that extends the terms of
office from 2 years to 4 years for the Tax Collector, Town Clerk and Highway
Superintendent. He added that if passed by the board tonight it will then
be subject to voter approval at the November 7th election.
Proof of Legal Notice by
newspaper on August 3, 2006 having been furnished, the Public Hearing on Local
Law #6, 4-Year Terms for Tax Collector, Town Clerk and Highway Superintendent, was opened by Supervisor
Thomas Wood at 7:24 p.m. as follows:
Roger Sherman asked what the logic behind
the change in term lengths was and Supervisor Thomas Wood responded that the
positions are technical and it takes time to become proficient at the jobs and
it would provide for greater continuity in those positions. Councilman Charles
Hanehan added that many other towns in the county have adopted 4-year terms for
those positions for the same reasons.
Everyone
wishing to speak having spoken the public hearing was closed at 7:26 p.m.
Approval of Minutes: A motion was made by Councilman Fred Drumm and seconded by Councilman
Charles Hanehan to accept the minutes of the regular meeting on July 10th
and the special meeting on July 20th, 2006 as written.

Town Clerk’s report for July 2006: Fees paid to the County Treasurer for Dog Licenses $104.57. Fees paid to the NYS Dept. of Agriculture and Markets for the spay/neuter program $33.00. Fees paid to New York D.E.C. for hunting and fishing licenses $53.85. Fees paid to the New York State Health Department for Marriage licenses $45. Dog license fees to Supervisor Thomas Wood $285.43. Clerk fees to Supervisor Thomas Wood $50.15. Total State, County, and Local Revenues received were $572.
Zoning Officer’s report: Supervisor Thomas Wood read the Zoning Officer’s July 2006 report: 16 Building Permits and 10 CO’s were issued, 15 building inspections were done, 1 ZBA appearance for a variance, and no complaints were addressed. A check for
$4,474.60 was given to Supervisor Thomas Wood.
Dog Control officer’s report for July 2006: The report was read by Supervisor Thomas Wood which stated Rick Sullivan answered 14 complaints, responded to 2 dog bite incidences, took 2 dogs to the shelter, traveled 166 miles, issued 25 warnings and 13 summons’ were issued.
Town Court report: Justice Jack Ditch read the court report and the following cases were closed in July 2006: 128 Vehicle & Traffic, 18 Criminal/Penal Law, 4 DEC/ENCON, 1 Dog case, 4 DWI, 3 Town & Village Ordinances, 1 Small Claims/Civil, 0 Evictions, 2 Bench trials, 2 (case transfers) Divestiture Form sent to County Court, 8 attended the Science of Speed School, 0 Defendants sentenced to probation, 121 hours of community service issued, 9 days of jail time issued, 3 Orders of Protection issued, and $9,350 in fees were paid to the NY State Comptroller.
Historian’s
report: Highlights of Sean Kelleher’s report are as follows: He
reported that last week’s Historical Week was a smashing success. The Turning Point Parade Committee and
Chamber of Commerce did a great job with the events. The week had a number of
walking tours, a genealogy workshop and an open house at the Visitor’s
Center. The week finished up with 18th
Century Day at the Schuyler House.
Planning has begun for Surrender Week from October 10th
through 17th.
He reported that the town
donated a cloth star, that was discovered during the historian’s index project
grant work, which was cut from the historic flag that hung at the Marshall
House Hotel in Alexandria, VA on May 24, 1861 to the New York State Military
Museum’s collection where it will be reunited with the original Marshall House
flag which has been part of the Museum’s collection since the 1860’s. The New York State Military Museum’s battle
flag collection is the largest state flag collection in the country.
The next round of the NYS
Archives grant of $12,935 will concentrate on improving access to the
historical records in the historians’ offices in the Towns of Saratoga and
Stillwater, and the Villages of Schuylerville and Stillwater.
Supervisor’s report: Supervisor Thomas Wood presented July 2006 balances in Town funds as follows: General A $971,928.68 ($50,000. of this is Park Reserve), General B $57,985.13, Highway Outside $101,685.12, Youth Recreation & Services $7,120.42, Highway Equipment Reserve $89,882.72, Building Reserve $967,080.45 and Fire Protection $0. July revenues were $107,803.68 and expenses were $209,184.95. The total July 2006 balance is $2,195,682.52.
Assessor’s report: Assessor Catherine DeFelice reported that the final 2006 state equalization rate is 78.00%. She stated that 21 property sales were processed in July and they continue to update property record cards and pictures. Address changes have been sent to the schools for the upcoming school tax bills. She added that she attended a class at Cornell on the Evaluation of Waterfront Property that was very informative.

Fosdick spoke in favor of the proposed 3 and 4 way stop
signs along Burgoyne Road at the DeGarmo Rd., Hayes Rd. and Bryant’s Bridge
intersections.
Yarislov Zujovic asked how many votes are needed to pass the PUD application when only 4
board members are present. Supervisor
Thomas Wood responded that a majority of the full board, which would be 3.
Committee
reports:
Highway Superintendent Dave Hall showed the board pictures of the problems with the road construction of Trask Lane at Nielson Landing and how it is not up to town specifications. Supervisor Thomas Wood made a motion and Councilman Charles Hanehan seconded it to direct Zoning Officer Robert Hathaway to cease issuing building permits until Trask Lane at Nielson Landing is brought up to town specifications. Supervisor Thomas Wood - aye, Councilman Fred Drumm – aye, Councilman Charles Hanehan – aye, Councilwoman Betty Koval – aye, and Councilman Michael McLoughlin – absent. Carried 4 – 0.
Landfill: Supervisor Thomas Wood reported that the quarterly report from Hudson Environmental Services shows no unusual conditions at the town landfill and all tests are within acceptable limits.
Insurance: Supervisor Thomas Wood reported
that our policy was renewed August 1st.
Youth: Supervisor Thomas Wood noted that Jeannie
Duval reports that the swim program is going well. There are 80 children signed up for the first 4-week session and
60 for the second 4-week session.
Committee to Honor Volunteer Firefighters &
Emergency Medical Service Workers: Sean
Kelleher reported that the committee has a memorial design and has decided that
they would like the memorial built at the current location of Town Hall on
Ferry St. The committee has a rough
budget that will be submitted to the town.
They will not meet in August but will resume meetings in September.
GSES,
QSFD, SLPID/SLA Reports:
Quaker
Springs Fire Department: Stephen Bodnar
reported that they responded to 8 calls in July, one was a barn collapse. He stated that budget workshops are being
held and site work at 9P is progressing.
The department has one new applicant and one new person is undergoing
training.
Old
business:
Supervisor Thomas Wood explained that George Pravda’s PUD application was tabled at the July 10th meeting. Councilman Fred Drumm made a motion to remove Resolution #06-73, Lakeside Narrows PUD, from the table and Councilwoman Betty Koval seconded it. Resolution #06-73 – Lakeside Narrows PUD, George
Pravda, 1460 Rt. 9P – SBL #180.18-1-2
& 3- Seven 2,000 sq. ft. townhouse units on 1.02 +/- acres – Lake
Commercial District was then voted on and defeated as follows:
WHEREAS, the Town Board of the Town of Saratoga has received
an application for a PUD rezoning, project name is Lakeside Narrows, George
& Gertrude Pravda, owners, 1460 Rt. 9P, S/B/L# 180.18-1-2 & 3; and
WHEREAS, the Town Board of the Town of Saratoga has
determined that the proposal merits further review, therefore be it,
RESOLVED by the Town Board of the Town of Saratoga to refer
the application to the Planning Board for its review and recommendation.

RESOLVED by the Town Board of the Town of Saratoga to adopt Local
Law #6 of 2006 as follows:
A local
law to extend the terms of office for Town Clerk, Superintendent of
Highways and Tax Collector from 2 years to 4 years.
Be it enacted by the Town Board of the Town
of Saratoga as follows:
Commencing with the next biennial Town
election to be held in November 2007, the terms of office for the positions of
Town Clerk, Superintendent of Highways and Tax Collector in the Town of
Saratoga shall be extended from 2 years to 4 years.
SECTION 2: Mandatory Referendum
A proposition to approve this Local
law shall be submitted to the voters of the Town at the general election to be
held November 7, 2006.
SECTION 3: Effective Date
This
local law shall take effect upon approval of the voters in the general election
to be held November 7, 2006.
Supervisor Thomas Wood
announced a vacancy on the Board of Assessment Review as of October 1st. Jean Nolan does not wish to be
reappointed. Anyone wishing to serve on
the Board of Assessment Review, which has a five year term from October 1, 2006 through
September 30, 2011, is asked to contact Supervisor Thomas Wood.
Supervisor Thomas Wood explained that our insurance carrier requested that we have a financial and procedural audit done and it has been completed. On a motion by Councilman Fred Drumm and seconded by Councilwoman Betty Koval the following resolution was adopted by vote: Supervisor Thomas Wood - aye, Councilman Fred Drumm – aye, Councilman Charles Hanehan – aye, Councilwoman Betty Koval – aye, and Councilman Michael McLoughlin – absent. Resolution #06-83,
Accepting Audit Findings:
WHEREAS, the Town Board of the Town of Saratoga had the
Town’s 2005 financial operations and procedures audited by Bollam, Sheedy,
Torani & Co. LLP, and
WHEREAS, the Town Board of the Town of Saratoga has reviewed
the findings, therefore be it,
RESOLVED, by the Town Board of the Town of Saratoga to accept
the findings as presented (the audit is on file in the Town Clerk’s
office).
On a motion by Councilman Fred Drumm and seconded by Councilwoman Betty Koval the following resolution was adopted by vote: Supervisor Thomas Wood - aye, Councilman Fred Drumm – aye, Councilman Charles Hanehan – aye, Councilwoman Betty Koval – aye, and Councilman Michael McLoughlin – absent. Resolution #06-84,
adopting the list of Corrective Actions from the Financial Operations and
Procedures Audit:
WHEREAS, the Town Board of the Town of Saratoga had the
Town’s 2005 financial operations and procedures audited by Bollam, Sheedy,
Torani & Co. LLP, and
WHEREAS, the Town Board of the Town of Saratoga has reviewed
the findings and has identified corrective actions needed, therefore be it,
RESOLVED, by the Town Board of the Town of Saratoga to accept
the corrective actions as recommended as a result of the audit (the audit is on
file in the Town Clerk’s office).
Supervisor Thomas Wood
explained as a result of the favorable audit the following Resolution #06-85 reduction in excess
indemnity insurance on Supervisor & Tax Collector was introduced by
Councilman Fred Drumm and seconded by Councilwoman Betty Koval and adopted with

WHEREAS, the Town Board of the Town of Saratoga had the
Town’s 2005 financial operations and procedures audited by Bollam, Sheedy, Torani
& Co. LLP, and
WHEREAS, the Town Board of the Town of Saratoga has reviewed
the findings regarding bonding of town officials and employees and has
determined that the prior insurance limits were adequate for the Tax Collector
and Town Supervisor, therefore be it,
RESOLVED, by the Town Board of the Town of Saratoga to reduce
the excess indemnity insurance from $100,000 to $50,000 for the Town Supervisor
and from $1,500,000 to $1,000,000 for the Tax Collector with Adirondack Trust
Insurance.

Resolution #06-86 –
Authorization to apply for a NYS Canal Corp. Grant for a Rt. 4 Boat Launch:
WHEREAS, the New York State Canal Corporation is soliciting
projects to implement Governor George E. Pataki’s vision for an Erie Canal
Greenway, first proposed by the Governor in May 2005, and
WHEREAS, the December 2005 report released by the New York
State Canal Corporation Interagency Task Force, entitled “Report on the Future
of New York State Canals”, recommended a voluntary, collaborative strategy for
providing assistance to communities along all four canals of the New York State
Canal System through a canal-wide “greenway” program, and
WHEREAS, funding for a grant program to implement the vision
of the Governor and the recommendations of the Task Force was approved in the
2006-2007 New York State Budget, and $6 million is available under four grant
categories, and now therefore be it,
RESOLVED as follows: The Town of Saratoga supports the creation of a voluntary
Erie Canal Greenway, as proposed by the Governor and recommended in the Report by the Interagency Talk Force,
based upon six (6) principles, including: (1) waterfront public access, (2)
tourism, (3) recreational development, (4) natural and cultural resource
protection, (5) local and regional planning, and (6) economic revitalization,
and
The Town of Saratoga supports
the submission of an application for funding from the New York State Canal
Corporation through the Erie Canal Greenway Grant Program in the amount of
$258,716 for the project entitled “Boat Launch on Route 4”.
On a motion by Supervisor Thomas Wood and seconded by Councilwoman Betty Koval the following resolution was adopted by vote: Supervisor Thomas Wood - aye, Councilman Fred Drumm – aye, Councilman Charles Hanehan – aye, Councilwoman Betty Koval – aye, and Councilman Michael McLoughlin – absent. Resolution #06-88 - $500 to LA Group to the Rt. 4 Boat Launch Grant and the
Champlain
Canal Towpath Trail Grant:
WHEREAS, the New York State Canal Corporation is soliciting
projects to implement Governor George E. Pataki’s vision for an Erie Canal
Greenway, and
WHEREAS, the Town of Saratoga is seeking funding for the Rt.
4 Boat Launch and the Champlain Canal Towpath Trail, therefore be it,
RESOLVED, by the Town Board of The Town of Saratoga to
authorize payment to the LA Group in the amount of $500 from Parks A7010.4 for
writing the grant applications for the Rt. 4 Boat Launch and the Champlain
Canal Towpath Trail that will be submitted to the New York State Canal
Corporation through the Erie Canal Greenway Program.
On a motion by Councilman Fred Drumm and seconded by Councilwoman Betty Koval the following resolution was adopted by vote: Supervisor Thomas Wood - aye, Councilman Fred Drumm – aye, Councilman Charles Hanehan – aye, Councilwoman Betty Koval – aye, and Councilman Michael McLoughlin – absent. Resolution #06-89 – Historic Records Grant Appointments:
WHEREAS, the Town of Saratoga has been awarded for a second
year a Historical Records Grant from the Local Government Records Management
Improvement Fund in the amount of $12,935.
WHEREAS, the Town of Saratoga is the lead agency on behalf of
a cooperative which includes the Towns of Saratoga and Stillwater and the
Villages of Schuylerville and Stillwater and the grant funding will support
planning and inventory the historical records in the various municipal
Historians' offices.
WHEREAS, the employees and consultants, who worked on the
prior grant, are willing to continue the work and they were hired according to
the policy and procedures of the Town of Saratoga.
WHEREAS, the grant provides for the hiring of a Historical
Records Clerks, therefore be it
RESOLVED,
that the Town Board of the Town
of Saratoga appoints Linda Palmieri,
Kristina Saddlemire Reese, Patricia Peck, and Sean Kelleher as the Historical Records Clerk at $15 an hour with
no benefits as provided in the grant.
Each applicant has experience working as a municipal historian and more
than one year experience with historical or archival records. The Records Clerk will sort and organize the
historical and archival records by record series, label boxes, number shelving
units/boxes, remove duplicate and obsolete information, and complete
destruction forms.
WHEREAS, the grant provides for the hiring of a Historical
Records Management Consultant, therefore be it
RESOLVED,
that the Town Board of the Town
of Saratoga appoints Field Horne as
the Historical Records Management Consultant for up to $2,100 as provided in the grant. He is an expert in the field and will provide training,
development of policies and procedures for historical record storage, develop a
need assessment and a program plan, and will help with the close out
reporting.
Supervisor
Thomas Wood stated that it is 2007 budget time and memos have been sent to
department heads for their budget requests. The first Budget Workshop is scheduled for Thursday, August 24th
at 7:00 p.m.
Supervisor Thomas Wood reported that there was a recent accident at the Hayes & Burgoyne Road intersection that has prompted a request for a 4-way stop at that intersection. A 3-way stop was also requested for the Bryant’s Bridge Road & Burgoyne Road intersection. After board discussion, it was decided to include the DeGarmo Road & Burgoyne Road intersection in the request to the County. A motion was made by Supervisor Thomas Wood and seconded by Councilman Fred Drumm to send the requests to Joe Ritchey, Saratoga County Public Works Commissioner, for review of the 4-way stops at the Burgoyne Road intersections with DeGarmo Road and Hayes Road along with a 3-way stop at Burgoyne Road and Bryant’s Bridge Road. Supervisor Thomas Wood - aye, Councilman Fred Drumm – aye, Councilman Charles Hanehan – aye, Councilwoman Betty Koval – aye, and Councilman Michael McLoughlin – absent. Carried 4 – 0.
Communications:
Paul Lent, Director of
Saratoga County Office of Emergency Services sent a memo to advise town residents that
they can call 884-4769 (M-F, 9-5) to verify that their 911 information is
correct.
The Saratoga Lake Protection
& Improvement District has accepted a Draft Environmental Impact Statement
(EIS) on
the proposed Saratoga Lake Invasive Species Long-Term Management Plan. Public Hearings will be held on the Draft
EIS on August 17th and 24th at 6:30 p.m. at the Malta
Town Hall. Comments are requested and
will be accepted until September 15, 2006.

Roger
Sherman asked the board to provide for the collection and
disposal of hazardous substances, such as paint, antifreeze, fertilizers and
pesticides, at least once a year. He
suggested they contact the Town of Milton to see how they handle the collection
of hazardous substances. It was
suggested that it could be a cooperative effort with the cost being shared with
the villages.
James
Gorham also voiced the need for the disposal of hazardous
waste and wondered where it is taken. Supervisor Thomas Wood responded that it
is taken to special toxic material landfills in the state. Much more information about the process is
needed and will be looked into.
Stephen
Bodnar thanked the town for clearing intersections of
trees and brush to improve the site distances.
He noted that during swimming lessons on Casey Road there are cars
parked on both sides of the road making it difficult for emergency vehicles to
get through. He asked that Supervisor
Thomas Wood speak to Swim Program Director Jeannie Duval. He suggested that cars park on only one side
of the road.
Stephen Bodnar reported
that Fire District regulations have been changed by the State of New York. They now require budgets over $200,000 to
have an outside audit done at the department’s expense. He also stated that reserve funds will be
done away with.
He reported that Stephanie
Ferrandino, representing the MKN Development, LLC that is proposing a
subdivision on Brown Road, contacted him requesting a meeting to discuss fire
safety issues of the subdivision.

Carried 4 – 0.

-Approving the payment of bills on Abstract 8G dated 8/14/2006 as follows: General A
$33,610.94, General B $489.94, Highway Outside $11,301.38, Building Reserve
$6,975, and Youth $1,404.25 for a total expense of $53,781.51.
