Supervisor Thomas Wood opened the meeting with the Pledge of Allegiance

at 7:00 p.m.

 

Roll call: Ruth Drumm, Town Clerk, called the roll.  Supervisor Thomas Wood- present, Councilman Fred Drumm - present, Councilman Charles Hanehan- absent, Councilwoman Betty Koval - present, and Councilman Michael McLoughlin – absent (arrived at 7:03 p.m.).

Also present: Deputy Town Clerk Linda McCabe, Town Attorney William Reynolds, Highway Superintendent Dave Hall, Zoning Officer Gil Albert, Justice Jack Ditch, and many other interested members of the public.

 

Recognitions/Presentations/ Bid openings/ Public Hearings: 

Supervisor Thomas Wood presented the following Resolutions # 95, 96 and 97 to the families of William Robert Smith, Thomas Charles Smith and Donald George Smith:

On a motion by Supervisor Thomas Wood and seconded by Councilman Fred Drumm    the following Resolution #08-95 Recognition of William Robert Smith – WWII Deceased Veteran was adopted by vote: Supervisor Thomas Wood - aye, Councilman Fred Drumm – aye, Councilman Charles Hanehan – absent, Councilwoman Betty Koval – aye, and Councilman Michael McLoughlin – aye.  Carried 4 – 0.

WHEREAS, William Robert Smith was a resident of the Town of Saratoga; and

WHEREAS, he was the eldest son of William Smith Sr. and Margaret Jane Benton Smith born on April 4, 1923 in Leeds, North Dakota; and

WHEREAS, he was a member of the Saratoga Grange and Quaker Springs Methodist Church; and 

WHEREAS, he attended Schuylerville High School; and

WHEREAS, prior to entering the military he worked at the Schenectady Army Depot; and

WHEREAS, he was inducted into the army on January 14, 1943 attaining the rank of Private First Class; and

WHEREAS, he was a member of Company D, 791st Military Police Battalion of Fort Jackson, South Carolina; and

WHEREAS, he was honorably discharged from the Army on March 23, 1945; and

WHEREAS, following his discharge from the army he worked as a mechanic, bus driver, and worked for the New York State Canal System; and

WHEREAS, he died on February 11, 1982 and is buried in Stillwater Union Cemetery; therefore be it

RESOLVED, that the Town of Saratoga extends our belated condolences to all of the members of the Smith Family; and be it further

RESOLVED, that the Town Board of the Town of Saratoga does hereby recognize and honor to the highest degree possible William Robert Smith for his patriotism, devotion, service and sacrifice for his country; and be it further

RESOLVED, that the Town of Saratoga will never let his name and the sacrifice that he made for his country be forgotten and that he will always be held in the highest esteem and remembered as a member of the greatest generation and one of the Town of Saratoga’s best.

 

On a motion by Supervisor Thomas Wood and seconded by Councilman Fred Drumm    the following Resolution #08-96 Recognition of Thomas Charles Smith - WWII Deceased Veteran was adopted by vote: Supervisor Thomas Wood - aye, Councilman Fred Drumm – aye, Councilman Charles Hanehan – absent, Councilwoman Betty Koval – aye, and Councilman Michael McLoughlin – aye.  Carried 4 – 0.

WHEREAS, Thomas Charles Smith was a resident of the Town of Saratoga; and

WHEREAS, he was the son of William Smith Sr. and Margaret Jane Benton Smith born January 21, 1925 in Leeds, ND; and

WHEREAS, he was active in numerous school activities including dramatics, intramurals, new drivers club and the track team; and

WHEREAS, he was a member of the Saratoga Grange, 4H, and Quaker Springs Methodist Church; and 

WHEREAS, he graduated from Schuylerville High School in the Class of 1942; and

WHEREAS, following graduation he worked at the Schenectady Army Depot; and

WHEREAS, he was inducted into the army on April 14, 1943 attaining the rank of Staff Sergeant; and

WHEREAS, he was a member of the 5th Division, 10th Infantry; and

WHEREAS, his unit was engaged in heavy combat during the Battle of the Bulge; and

WHEREAS, he was killed in action at Luxembourg on December 26, 1944; and

WHEREAS, he was posthumously awarded the Purple Heart; and

WHEREAS, he was initially buried in a military cemetery in Grand Failly, France, and

WHEREAS, on March 24, 1949 his remains were transported to and buried in Fairview Cemetery in Quaker Springs; therefore be it

RESOLVED, that the town of Saratoga extends our belated condolences to all of the members of the Smith Family for the great pain and suffering caused by the untimely death of Thomas Charles Smith; and be it further

RESOLVED, that the Town Board of the Town of Saratoga does hereby recognize and honor to the highest degree possible Thomas Charles Smith for his patriotism, devotion, service and ultimate sacrifice for his country; and be it further

WHEREAS, Donald George Smith was a resident of the Town of Saratoga; and

WHEREAS, he was the son of William Smith Sr. and Margaret Jane Benton Smith; and

WHEREAS, he was born on August 27, 1928 in the Town of Saratoga; and

WHEREAS, he was a member of the Saratoga Grange and Quaker Springs Methodist Church; and 

WHEREAS, he attended Schuylerville High School; and

WHEREAS, he enlisted in the Navy on October 23, 1945 in Albany, NY; and

WHEREAS, he became ill while in the Navy contracting Scarlet Fever and Nephritis; and

WHEREAS, he died on July 28, 1946 at the U.S. Naval Hospital in Portsmouth, VA; and

WHEREAS, he was posthumously awarded the World War II Victory Medal and the Honorable Service Lapel Pin; and

WHEREAS, his body was transported to and buried in Fairview Cemetery in Quaker Springs; therefore be it

RESOLVED, that the town of Saratoga extends our belated condolences to all of the members of the Smith Family for the great pain and suffering caused by the untimely death of Donald George Smith; and be it further

On a motion by Supervisor Thomas Wood and seconded by Councilman Fred Drumm    the following Resolution #08-98 Recognition of Jim Gorman, Chief Ranger 

was adopted by vote: Supervisor Thomas Wood - aye, Councilman Fred Drumm – aye, Councilman Charles Hanehan – absent, Councilwoman Betty Koval – aye, and Councilman Michael McLoughlin – aye.  Carried 4 – 0.

WHEREAS, Saratoga National Historical Park Chief Ranger James Gorman served the National Park Service for 32 years including 22 years at Saratoga National Historical Park; and

WHEREAS, the citizens of the Town of Saratoga have recognized Chief Ranger James Gorman for his contributions to preserve and protect for future generation the Old Saratoga region, and to provide for public enjoyment of thousands of tourists who visit; and

WHEREAS, having served as Saratoga National Historical Park Chief Ranger James Gorman has lead a number of important initiatives including a fire management program, cultural resource protection and natural resource protection; and 

WHEREAS, Chief Ranger James Gorman worked as an ambassador for the Park developing strong relationships with the three local volunteer fire departments, General Schuyler Rescue Squad, the local police departments, and environmental enforcement agencies; and

WHEREAS, Chief Ranger James Gorman worked to foster partnerships with local events in the region including Turning Point Parade, 18th Century Day, and Candlelight Tour; and

WHEREAS, the visitors and the citizens of the Town of Saratoga will greatly miss the leadership of Chief Ranger James Gorman, who leaves his legacy of service to others over endless hours of working with our community each year;

NOW, THEREFORE, BE IT RESOLVED BY THE TOWN OF SARATOGA BOARD, is proud to honor and commend Chief Ranger James Gorman, a man who stands admirably as an example for any Saratogian of a true leader in public service to his community and the country; and

FURTHER BE IT RESOLVED, that the Town of Saratoga Board wishes James Gorman success, health and happiness in his retirement; and

FURTHER BE IT RESOLVED, that the Town of Saratoga hereby declares October 17, 2008, as “Chief Ranger James Gorman – 231st Anniversary of the American Victory at Saratoga Day” in the Town of Saratoga; and

FURTHER BE IT RESOLVED, that a copy of this resolution be spread upon the pages of the Minutes of the Town of Saratoga Board as a permanent record; and

FURTHER BE IT RESOLVED, that a copy of this resolution be dispatched to the Chief Ranger James Gorman, a distinguished and resolute leader and public servant.

 

Supervisor Thomas Wood opened the sole bid for the 1987 Tandem Truck Mounted Gradall Excavator Model 660C.  Lisa Tracy placed a bid for $4,000 but since it was advertised with a minimum bid of $5,000 the board could not accept the bid. 

 

Approval of Minutes: A motion was made by Councilwoman Betty Koval and seconded by Councilman Michael McLoughlin to accept the minutes of the July 14th regular meeting as written. Supervisor Thomas Wood - aye, Councilman Fred Drumm – aye, Councilman Charles Hanehan – absent, Councilwoman Betty Koval – aye, and Councilman Michael McLoughlin – aye.  Carried 4– 0.  

 

Town Clerk’s report for July 2008: Town Clerk Ruth Drumm reported.  Fees paid to the County Treasurer for Dog Licenses $91.65. Fees paid to the NYS Dept. of Agriculture and Markets for the spay/neuter program $27.00. Fees paid to New York D.E.C. for hunting and fishing licenses $108.63.  Fees paid to the New York State Health Department for Marriage licenses $22.50.  Dog license fees to Supervisor Thomas Wood $253.35. Clerk fees to Supervisor Thomas Wood $131.62. Total State, County, and Local Revenues received were $634.75.

 

Town Clerk Ruth Drumm reported that the 2008-2009 Hunting Licenses will go on sale August 18th. 

 

Zoning Officer’s report for July 2008:  Zoning Officer Gil Albert reported: 14 Building Permits, 0 Building Permit Renewals, 28 Building Inspections, 4 COs, 0 Junk Yard Permits, 0 Complaints, and 7 misc.  A check for $3,183.55 was given to Supervisor Thomas Wood. 

 

Dog Control Officer’s report for July 2008: Supervisor Thomas Wood read the report for DCO Ed Cross.  He answered 31 complaints, traveled 238 miles, issued 20 warnings, took 4 dogs to the shelter, and 2 summonses were issued. 

                                            

Town Court report for July 2008: The following were closed: 104 Vehicle & Traffic, 11 Criminal/Penal Law, 4 DEC/ENCON, 7 Dog cases, 3 DWIs, 2 Town & Village Ordinance, 4 Small Claims/Civil, 2 Evictions, 2 Bench trials, 0 Divestiture Forms (case transfers) sent to County Court, 12 attended the Science of Speed School, 0 Defendants sentenced to probation, 115 hours of community service issued, 15 days of jail time issued, 0 Orders of Protection issued, and $8,945.00 in fees were paid to the NY State Comptroller. 

 

Tax Collector’s report:  No report.

 

Historian’s report:   Historian Sean Kelleher submitted the following report:

We just concluded an educational historical week done in partnership with the Village of Schuylerville and many other fine community organizations.  Highlights of the week were the Turning Point Parade including the Grand Marshals – Deputy Historian Pat Peck and her husband Joe and I should mention that they had their two grandchildren – Henry and Erin accompanying them.    Yesterday was 18th Century Day at the Schuyler House which takes a lot of effort to plan each year by the Old Saratoga Historical Association and the national park. 

 

The office has received a variety of request in the past month – some from Ohio researching ancestors in the Battles of Saratoga and some from local building owners working on National Register nominations.  We are finishing up the grant on Fort Hardy and working on packing up the office for moving to the new building.

 

Assessor’s report: Assessor Victoria Hayner submitted the following report: 

During the month of July we processed 17 sales transfers.  The majority of these transfers (12) were non-valid and the remaining 5 were valid sales.   We have had a couple of splits that have been processed as well.  I believe these numbers are beginning to show the slow-down of sales within our Town.  We will continue to monitor our sales in the coming months.

 

I am working this summer on a couple of courses regarding Commercial Valuation, which should better enable me to value Commercial properties within our town.

 

We have had one property owner file for a Small Claims Hearing, but I have sent a letter to the County Clerk requesting review of his claim due to the fact that the property is actually an investment property (he currently is renting the property) and Small Claims hearings are for owner occupied properties only.

  

We continue to make ourselves available to the Town for property owners that may have a concern regarding their inventory on their property.

Supervisor Thomas Wood reported that the June Sales Tax Revenue received was $113,516. 

 

Supervisor Thomas Wood reported that a budget workshop has been scheduled for Thursday, August 28th at 6:00 p.m.

 

Supervisor Thomas Wood added that the Final Equalization Rate for 2008 is 65%, down from 68% in 2007. 

 

Highway: Highway Superintendent Dave Hall reported that mowing along the roads  continues. The price of asphalt continues to go up and has risen $11/ ton this month. They are hauling winter sand under last year’s contract.  He added that salt has increased $17 per ton.

 

Public comments on agenda items:  No one commented.

 

Committee reports

 

Landfill: No report.

 

Insurance: Supervisor Thomas Wood reported that he reviewed and renewed our policy with our carrier.  Additional changes will be made once the new building is purchased. 

 

Youth:  Supervisor Thomas Wood reported that the Swimming Program has concluded with over 130 participating. 

 

Buildings:  Supervisor Thomas Wood reported that the bond rating from Standard & Poors for the Town of Saratoga is AA-, which is a very good rating.  Requests have been sent to a number of banks and submissions are due back soon to Fiscal Advisors & Marketing Inc.  Meetings are held weekly to review the progress of the renovations with Frank Studenroth, project manager for Bonacio Construction.  The closing date is September 15th and the move should take place within a couple of weeks thereafter.  Three professional movers are providing quotes.  It is expected to take 4 – 5 days, a couple of days for the departments to box up and label and then 2 days to move.  The movers will move the contents of the offices the first day, and the second day all the records and common areas will be moved.  Then the unpacking will commence.  Talks are being held with the telephone and cable companies.  The move should be done as swiftly as possible with as little interruption of town government as possible. 

 

An accurate appraisal of the value of the current building is needed and then legal steps will be followed for its sale.  A resolution for the appraisal will follow under new business.

 

Senior Citizens:  No report, regular meetings will resume in September. 

 

Park Committee:  Schuyler Park Update – Supervisor Thomas Wood reported on the progress being made at the 27 acre park site. Official survey markers have been placed around the perimeter of the park.  Town Engineer Kenneth Martin is preparing an RFP for clearing of brush and trees and another for excavation.  He is also working with Soil & Water Conservation and DEC to be sure all rules are followed.  Work should commence in September or October.  An archeological review has been completed by Birchwood Archaeological Services and a final report should be available soon.  

An agreement with Leon Reed and the Schuylerville Central School for use of the fields has been finalized.   

 

National Incident Management System Committee (NIMS):  Jim Miers reported that

they have received an invitation to a meeting in Ballston Spa on August 14th regarding a multi-hazard mitigation strategy plan.  The county has received a grant in order to build this plan.  The rain and flooding that impacted Schuylerville resulting in an Emergency Declaration set to expire this Wednesday at 5 p.m. and a request for financial help from the state.  The state will not be providing any financial help.  We will have to rely on individual’s Homeowner’s insurance and the Village’s insurance.  Jim Miers stated that he has received the specification for the automatic external defibrillators (AED’s) and he suggests that we will try to get one under state contract.  As soon as possible we will have one installed in this building and then move it to the new building and consider a second unit at the new building.  There will be a training program on the AED’s which both Sherry Doubleday and Brian Myers would be able to teach. 

Supervisor Thomas Wood added that Jim Miers is very vigilant about monitoring severe weather and keeps him informed so that in the event of a disaster we can respond more quickly. 

  

Committee to Honor Volunteer Firefighters & Emergency Medical Service Workers:  No report.

 

GSES, QSFD, SLPID/SLA, SCFB Reports:

 

Quaker Springs Fire Department (QSFD):  Stephen Bodnar addressed the board reporting that they responded to 12 calls in July.  The bids on the new station will be opened August 14th.  The commissioners are working on the 2009 budget.  The fire department will have a coin drop on Saratoga Lake on Traver’s Day.  The Commissioners have approved an Explorer Program for 14 and 15 year old youths.  The next meeting will be August 18th at 7:00 p.m. at the firehouse.    

 

Old business: None

 

New business:

On a motion by Councilwoman Betty Koval and seconded Councilman Michael McLoughlin the following Resolution #08-99 Five Year Agreement with SCSD for use of Facilities at Schuyler Park was adopted by vote: Supervisor Thomas Wood - aye, Councilman Fred Drumm – aye, Councilman Charles Hanehan – absent, Councilwoman Betty Koval – aye, and Councilman Michael McLoughlin – aye.  Carried 4 – 0.

WHEREAS, the Towns of Saratoga and Northumberland have entered into a certain inter-municipal agreement to jointly construct and operate a town park to be known as “Schuyler Park”, and

WHEREAS, the Schuylerville Central School District (“SCSD”) has offered to lease field space at Schuyler Park for use by its students for after-school athletics, and

WHEREAS, this use by SCSD will not unreasonably interfere with the planned use by the Towns, and

WHEREAS, the proposed agreement with SCSD is for a term of five years with a one-time payment of $50,000.00, and

WHEREAS, the Board finds that it is in the best interest of the Town to approve such an agreement, it is now therefore,

RESOLVED, that the Town of Saratoga enter into an agreement with the SCSD and the Town of Northumberland to allow the SCSD use of facilities at Schuyler Park on the terms set forth above, and that Supervisor Thomas Wood is authorized to sign such an agreement on behalf of the Town, the form of agreement subject to approval by the Town Attorney.

 

On a motion by Councilman Fred Drumm and seconded Councilman Michael McLoughlin the following Resolution #08-100 Authorization to Apply for a Justice Court Assistance Program Grant was adopted by vote: Supervisor Thomas Wood - aye, Councilman Fred Drumm – aye, Councilman Charles Hanehan – absent, Councilwoman Betty Koval – aye, and Councilman Michael McLoughlin – aye.  Carried 4 – 0.

WHEREAS, the Town Board of the Town of Saratoga recognizes the need for

additional and upgraded office equipment, security equipment, and computer support items for the town court, therefore be it

RESOLVED, that the Town Board of The Town of Saratoga authorizes Justice David Mathis to apply for a Justice Court Assistance Program Grant for up to $30,000 to purchase and install additional and upgraded office equipment, security equipment, and computer support items for the town court.

 

 

On a motion by Councilman Fred Drumm and seconded Councilwoman Betty Koval the following Resolution # 08-101 Appraisal of the Current Town Hall was adopted by vote: Supervisor Thomas Wood - aye, Councilman Fred Drumm – aye, Councilman Charles Hanehan – absent, Councilwoman Betty Koval – aye, and Councilman Michael McLoughlin – aye.  Carried 4 – 0.

WHEREAS, the Town Board of the Town of Saratoga recognizes the need to have an appraisal of the town hall at 30 Ferry Street in preparation for its sale; therefore be it

RESOLVED, that the Town Board of the Town of Saratoga accepts the lowest proposal from Neil Cherkosley of Upstate Appraisal Services for an amount not to exceed $1,000 for the appraisal of the town hall at 30 Ferry St.

 

On a motion by Supervisor Thomas Wood and seconded Councilman Fred Drumm the following Resolution #08-102 Support for the Hanna PDR was adopted by vote: Supervisor Thomas Wood - aye, Councilman Fred Drumm – aye, Councilman Charles Hanehan – absent, Councilwoman Betty Koval – aye, and Councilman Michael McLoughlin – abstained.  Carried 3 – 0.

WHEREAS, The Saratoga Town Board wishes to advance projects consistent with the Town of Saratoga’s 2002 Comprehensive Plan, and the draft American Battlefield Protection Plan; and 

WHEREAS, The Town of Saratoga values a partnership with Saratoga P.L.A.N. to implement projects consistent with the plans outlined above and to work cooperatively to structure projects to maximize efficiency of administration and transactions and to minimize overall costs; and 

WHEREAS, The Town of Saratoga is supportive of the Saratoga County Farmland/Open Space Preservation Program and is interested in developing a partnership with the county to implement projects consistent with plans outlined below; be it therefore

RESOLVED, That the Town of Saratoga hereby formally supports the application for funding prepared by Saratoga P.L.A.N. to the Saratoga County Farmland/Open Space Preservation Program as follows: 

·        The purchase of development rights on 192.2 acre Hanna Farm to preserve the land for agriculture.  The Town is seeking $636,930 toward the $747,700 total project cost. (Bargain Sale)

Communications:

v     Town Board’s & Planning Board Members invitation to Tour (East End of Long Island)– On the Road to Planning a Future for Farms- October 2-3, 2008

v     US EPA – Region 2 – Information telling that further sampling and testing for PCB’s in Hudson River Floodplain soils will occur this summer from Fort Edward to the Troy Dam.  Supervisor Thomas Wood encouraged all residents who have land in the floodplain to contact the EPA for testing of their soil. 

 

Privilege of the floor:

Sean Kelleher addressed the board regarding the testing of the Hudson River floodplain soils by the EPA.  One of the sites in the initial sampling was incorrectly noted as in the Village of Schuylerville when it was outside the village in the town, the property of Dave Mathis.  He suggested that it should be clarified with the EPA.  He also added that an AED program needs a medical director that oversees its use.  Jim Miers will check into that and Town Attorney William Reynolds suggested that our Health Officer could become the medical director that is needed.  

Roger Sherman asked the board to share the letter from the EPA with the Village of Schuylerville.  He also inquired about the liability insurance to cover Schuyler Park and how that is being handled.  Supervisor Thomas Wood responded that after some investigation it was decided to have a stand alone policy on Schuyler Park that is paid for by the two towns (Northumberland and Saratoga) and then the current towns’ & school’s general liability policies would be a back up for additional coverage if needed.  

Clarence Fosdick inquired who defines the floodplain area.  Jim Miers stated that it is the Army Corp. of Engineers using the 500 year floodplain.  He then inquired about the work being done at Lock 5.  He stated that the steps leading to the new dock have not been completed and wondered why they have stopped working.  Supervisor Thomas Wood responded that is the Hudson Crossing Project and the Town of Northumberland is fronting the money for the grant.  The state is slow reimbursing them and they are waiting for that reimbursement before going further. Clarence then asked where the Hanna farm (PDR applicant) is located and Councilman Michael McLoughlin responded that it is at Rt. 32 and Wilbur Road. 

Stephen Bodnar asked for an update on the asbestos investigation at the old town highway garage and Supervisor Thomas Wood responded that asbestos was found in the roof and window glazing.  Town Engineer Kenneth Martin is drafting an RFP for the cost of the removal.  Steve also suggested that a quick turnover of the current town hall would be best, since vacant buildings deteriorate fast and getting the property  back on the tax rolls would also help the town.

Audit the Bills: On a motion by Councilman Fred Drumm and seconded by Councilman Michael McLoughlin the following Resolution #8-103- Approving the payment of bills in Abstract 8G was adopted by vote: Supervisor Thomas Wood - aye, Councilman Fred Drumm – aye, Councilman Charles Hanehan – absent, Councilwoman Betty Koval – aye, and Councilman Michael McLoughlin – aye.  Carried 4 – 0.

RESOLVED, by the Town Board of the Town of Saratoga to authorize payment of the bills listed in Abstract 8G (08/11/2008) in the following amounts: General A $54,038.32, Youth Y $2,257.00 and General B $3,986.11, and Highway Outside DB $26,799.10, for a total of $87,080.53.

A motion to adjourn at 9:13 p.m. was made by Councilwoman Betty Koval and seconded by Councilman Fred Drumm.  Supervisor Thomas Wood – aye, Councilman Fred Drumm – aye, Councilman Charles Hanehan - absent, Councilwoman Betty Koval – aye, and Councilman Michael McLoughlin - aye.  Carried 4 – 0.
